TOM HUTCHINS-Good evening Board, I am Tom Hutchins, Hutchins Engineering here with
Rich Gordon from Dunham's Bay Lodge. Yea, it's pretty straight forward. There's an existing
holding tank system. The controls and alarms have recently been updated and they're functional

to current standards with water shutoff and such. It's desirable to have some additional volume
such that pump outs are a little less frequent. And it would be same controls, similar system.
We'd be adding a 1500 gallon tank in addition to the system.

SUPERVISOR STROUGH-Okay, any questions from the Board before I open the public
hearing? Alright, I'll open the public hearing on this sewage disposal variance application of an
additional holding tank to service two seasonal cabins. Anybody present like to speak to this?
Anybody, there's no attendees, I imagine they gave up after 15 minutes of trying, I don't blame
them. Alright, seeing no interest as far as the public goes for the public hearing, I will close the
public hearing.

VARIANCES FOR SWORDFISH REALTY LLC

WHEREAS, Swordfish Realty LLC (Applicant) applied to the Town of Queensbury Local
Board of Health for a variance from Chapter 136, §136-11 which requires applicants to obtain a
variance for holding tanks, as the Applicant wishes to add an additional 1,500 gallon capacity holding
tank to an existing holding tank system to serve two (2) seasonal cabin rental units at the Dunham's
Bay Resort located on property situated at 2999 Route 9L in the Town of Queensbury, and
WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's
official newspaper and the Local Board of Health conducted a public hearing concerning the variance
requests on Monday, July 25 h, 2022, and
WHEREAS,the Town Clerk's Office advised that it duly notified all property owners within
500 feet of the subject property,
NOW, THEREFORE, BE IT
RESOLVED,that:
1. due to the nature of the variance, it is felt that the variance would not be materially
detrimental to the purposes and objectives of this Ordinance or other adjoining
properties nor otherwise conflict with the purpose and objectives of any Town plan or
policy; and
2. the Local Board of Health finds that the granting of the variance is necessary for the

reasonable use of the land and is the minimum variance which would alleviate the
specific unnecessary hardship found by the Local Board of Health to affect the
Applicant; and
BE IT FURTHER,

Realty LLC (Applicant) for a variance from the Sewage Disposal Ordinance to allow installation of
an additional 1,500 gallon capacity holding tank to an existing holding tank system to serve two (2)
seasonal cabin rental units at the Dunham's Bay Resort located on property situated at 2999 Route
9L in the Town of Queensbury and bearing Tax Map No.: 252.-1-75.1, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Clerk to forward by
certified mail a certified copy of this Resolution to the Adirondack Park Agency for its review, and

RESOLVED, that this approval Resolution shall not be effective until 30 days after such
notice to the Adirondack Park Agency and shall be subject to any lawful action by the Adirondack

2.0 PUBLIC HEARINGS
2.1 Public Hearing—Proposed Local Law of 2022 Prohibiting Parking on a Portion
of Braydon Avenue
PUBLICATION DATE: July 15, 2022
SUPERVISOR STROUGH-Alright, there's a 90 degree bend on Braydon Avenue and it also
serves as an entry to the Glens Falls Watershed. So some of the neighbors who live on Braydon
Avenue brought this to our attention that motorcyclists and others are accessing the Watershed
from there. So I brought that to the attention of the City of Glens Falls, Mayor Collins and asked
him if it was okay for, because we might be encroaching on the Watershed a little bit to replace a
couple of rocks to deter motorized vehicles from entering at that location and also to put some
No Parking signs up and also some additional signage saying unauthorized motor vehicles are
not allowed to use the Watershed. So that signage is currently being prepared and it will be
installed if approved by this Town Board. It got approved by the City for doing what we want to
do. As a matter of fact,they're very supportive of doing things like this and protecting their
Watershed. So,there is a public hearing on this but before I open the public hearing, any
comments or thoughts from the Town Board?
COUNCILMAN FERONE-No, I think you covered it John. I know that I made that visit to the
site with you. You know, it's just a part of the Watershed that borders that street and apparently
people would park there and go in. But more importantly the motorized vehicles, the
motorcycles, dirt bikes and things like that,that are not licensed and travel up Braydon and hit
the property there. I know that you put yourself in bodily harm trying to stop one of those folks
from getting in there the day we were doing the visit. So I think it's a good thing for that area for
the folks that are living along that street.
SUPERVISOR STROUGH-And I'm hearing that one individual that stopped that day, seems to
be intent on clearing some of that so he can bypass the rocks that are currently there and be able
to access the Watershed after he's been told he can't use the Watershed. And there will be
signage there telling him he can't use, okay and then under penalty of law, might be the next
thing he's facing. Alright, anything else?

MR. KILBRUN-Braydon Avenue is over near Peggy Ann over towards West Mountain. A
small street, has a 90 degree bend that you identified and over time, for a very long time,
neighborhood residents have used a path that's tangential to that 90 degree arc in the road as
access to the Watershed. They take walks in there. They walk their dogs. They take their
morning constitutions, the usual kinds of things. Over time, the area that's been accessed, that
path has come to be used by areas way outside just the neighborhood. The volume of traffic has
increased greatly and on a good day, there could be 20 different cars that come and visit. It's not
uncommon to see three or four parked along Braydon Avenue. With that of course comes some
problems. There are littering problems, some noise problems. There's a public safety issue
when there are children playing there. The increased traffic is not good for that. This 90 degree
weather has also exposed another problem and that is the volume of dog waste that accumulates
in that sight. When it gets to be 95 it's quite something. But a bigger concern for the
neighborhood residents, is there's a safety and security issue there as well. In a six month, recent
six month period we had two break-ins on the street, a street that almost never experiences any
problems. There was a car break-in and there was a home burglary. As far as the home burglary
goes, we think that the traffic contributed to the targeting of the house that was burglarized.
People are concerned about that. So, in short,the neighbors think that it is inappropriate and
unnecessary to have a public access to the Watershed off Braydon Avenue. The Town has
recently developed two new access points. They're quite convenient to people in the area who
are going to drive to use the Watershed and we hope that putting up the No Parking signs will
deter people, push them towards those designated sights and begin to undermine the public
perception that Braydon is a Town designated access point for the Watershed. And we
appreciate your assistance.

RESOLUTION NO.: 279, 2022

would prohibit the parking of any vehicle on the northern side of a portion of Braydon Avenue in the
Town of Queensbury beginning at 12 Braydon Avenue and heading in a generally westerly
direction a distance of 150'± and accordingly authorize the installation of certain no parking signage
in this specific area as well as the placement of a boulder to block unauthorized motor vehicles in
order to prevent unauthorized motor vehicles from entering the City of Glens Falls' Lower Watershed
at this point of entry, and
WHEREAS, such legislation is authorized in accordance with New York State Town Law,
Vehicle and Traffic Law§1660(18) and the Municipal Home Rule Law, and

to file the Local Law with the New York State Secretary of State in accordance with the provisions

LOCAL LAW NO.: 9 OF 2022
A LOCAL LAW PROHIBITING PARKING ON A PORTION OF
BRAYDON AVENUE IN THE TOWN OF QUEENSBURY
BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF
QUEENSBURYAS FOLLOWS:
1. Purpose:
The purpose of this Local Law is to prohibit,under penalty of fine for violation,the parking
of any vehicle on the northern side of a portion of Braydon Avenue in the Town of Queensbury

beginning at 12 Braydon Avenue and heading in a generally westerly direction a distance of 150'±
as depicted in the Map appended to this Local Law and accordingly authorize the installation of
certain no parking signage in this specific area as well as the placement of a boulder to block
unauthorized motor vehicles in order to prevent unauthorized motor vehicles from entering the City
of Glens Falls' Lower Watershed at this point of entry
2. Definitions:
For the purpose of this Local Law, the words "Motor Vehicle," "Vehicle," "Person," and
"Park" shall have the same meanings as set forth for the definitions of such words in the Vehicle and
Traffic Law of the State of New York.
3. No Parking on Northern Side of Braydon Avenue in the Town of Queensbury:
No motor vehicle or other vehicle of any kind shall be allowed or permitted to park and no
person(s) shall park a motor vehicle or other vehicle for any period of time on the northern side of a
portion of Braydon Avenue beginning at 12 Braydon Avenue and heading in a generally westerly
direction, a distance of 150'±.
4. Responsibility of Motor Vehicle Owner:
Should any vehicle be found parked in violation of this Local Law, it shall be presumed that
the owner of the motor vehicle is the person responsible for parking the motor vehicle in violation
and this presumption shall only be rebutted upon a showing by the vehicle owner that another person
clearly identified had custody and control of the motor vehicle at the time of such violation.
5. Penalty:
Any person violating any provision or paragraph of Section 3 of this Local Law shall, upon
conviction, be punishable for a first offense by a fine not to exceed $25, and for a second offense by
a fine not to exceed $50. In addition to the aforesaid penalties, the Queensbury Town Board may
institute any proper action, suit, or proceeding to prevent, restrain, correct, or abate any violation of
this Local Law.
6. Effective Date:
This Local Law shall take effect immediately upon its filing in the Office of the Secretary of
State.

WHEREAS, by the same submittal, Dan Hunt has also applied for Planning Board site
plan approval of proposed changes to the existing mobile home park at this property known

Land Use Planner and deemed complete for purposes of review, and

Energy Research and Development Authority (NYSERDA) Solar and Electric Vehicle Clean
Energy Community Campaigns for the Town of Queensbury, and
WHEREAS, NYSERDA is sponsoring and providing local governments opportunities to
earn credits for NYSERDA'S Clean Energy Communities, Community Campaign for Clean
Heating and Cooling and Energy Efficiency, and
WHEREAS, the Town Board believes that well-organized, community-scale campaigns
can: 1) effectively encourage adoption of new, innovative technologies to generate value and
savings for consumers while advancing New York's clean energy goals; 2) promote program
opportunities including community solar, clean heating and cooling and energy efficiency; 3)

provide consumers with increased access to clean energy; and 4)bring together groups of potential
customers through widespread outreach and education; and
WHEREAS, the Town Board therefore wishes to initiate NYSERDA'S Clean Energy

encourage the adoption of clean heating and cooling technologies as well as energy efficiency
retrofits to homes, businesses and community institutions as delineated in NYSERDA'S Clean
Energy Communities Leadership Round Guidance Document as Revised December 2021
presented at this meeting and as will be more specifically set forth in the Town's Community
Campaign Scoping Document,

RESOLVED, that the Queensbury Town Board hereby authorizes and directs completion
and submission of the Town of Queensbury's Community Campaign Scoping Document to the
New York State Energy Research and Development Authority (NYSERDA) relating to
NYSERDA'S Clean Energy Communities, Community Campaign for Clean Heating and Cooling
and Energy Efficiency and, provided that NYSERDA approves the Scoping Document, further
authorizes and directs initiation of the Town's Community Campaign as will be detailed and
described in the Scoping Document and as delineated in the preambles of this Resolution, and

WHEREAS, the Town of Queensbury pledged to take part in the New York State
Department of Conservation (NYS DEC) Climate Smart Communities Certification Program that
includes the preparation of a Community Greenhouse Gas Emissions Inventory Report and
Government Operations / Community Climate Action Plan, and
WHEREAS, a Community Greenhouse Gas Inventory is an inventory of greenhouse gas
emissions created by the entire community, and
WHEREAS, free technical assistance is available to support the development of the
inventory and plan from the Capital District Regional Planning Commission (CDRPC) through a
NYS DEC Climate Smart Communities Coordinator Services contract, and
WHEREAS, a completed inventory and plan count toward Climate Smart Communities
certification, specifically:
1. PE2 Action: Government Operations Climate Action Plan; and
2. PE2 Action: Community Greenhouse Gas (GHG) Emissions Inventory; and
3. PE2 Action: Community Climate Action Plan; and
WHEREAS, the Climate Smart Task Force, comprised of municipal officials and
environmental volunteer community leaders, will collaborate with CDRPC in the development of
these publications, reviewed drafts, and provide valuable feedback on iterations that result in the
final draft, and
WHEREAS, the task force will provide an opportunity for public input and comment on
the draft report, and
WHEREAS, the task force will present a summary of the inventory results and the draft
government operations climate action plan to the Town Board for consideration of adoption,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes the undertaking of a
Community Greenhouse Emission Inventory Report and the Government Operations /
Community Climate Action Plan, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes submission of these documents to
the NYS DEC Office for Climate Change for consideration of points toward Climate Smart
Communities certification for the Town of Queensbury, and

BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute any needed documentation and the Town Supervisor and/or Town Staff to take such other
and further actions as may be necessary to effectuate the terms of this Resolution.

FOR SALE OR DISPOSAL OF OBSOLETE EQUIPMENT

WHEREAS, in accordance with New York State Town Law §64(2), the Queensbury Town
Board may authorize the sale of items which are no longer needed by the Town or obsolete, and
WHEREAS, the Town's Budget Officer requested that Town Departments advise of any
surplus items in their respective Departments and the Town Budget Officer did receive lists of items
from various Departments which are considered to be surplus, and
WHEREAS, the Budget Officer advised the various Town Departments of the surplus items
and did not receive any requests from the Departments for such surplus items and therefore has
requested Town Board authorization to sell the surplus items by using the auction company GovDeals
to dispose of such surplus property, or, if deemed unsafe and/or inoperable by the Department
Manager(s),to be sold or disposed of as scrap, and
WHEREAS, the following is the list of surplus items provided by the various Town
Departments:

NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves of the sale of the surplus

Queensbury Town Code and New York State Laws, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer
and/or Purchasing Agent to accept or reject any bids received online for any online auction bids, and
BE IT FURTHER,
RESOLVED,that the Town Board further authorizes and directs the Town Supervisor, Town
Budget Officer, Purchasing Agent and/or Town Counsel to take such further actions as may be
necessary to effectuate the terms of this Resolution.

RESOLVED, that the Queensbury Town Board hereby approves the audit of bills presented
as Warrant: 07262022 with a run date of 07/21/2022 and a payment date of 07/26/2022 totaling
$1,117,203.36, and
BE IT FURTHER,
RESOLVED,that the Town Board further authorizes and directs the Town Supervisor and/or

COUNCILMAN MCNULTY(WARD IV)
• Announced the Comprehensive Master Plan Review is moving forward, there should be an
August meeting with committee members and contractor. I will keep the Board apprised as
we move forward.
• Noted that he met with the engineers from LaBella today regarding controlling the water flow
on Northwest Mountain Road. The study showed that the water flow follows what the road
design was originally engineered to do. As we move forward with road construction, we're
going to replace the hard top on that and will work on cleaning some of the drains. There's
nothing else we can do to change the flow of water without causing more harm.
COUNCILMAN FERONE(WARD II1)—Nothing to report
SUPERVISOR STROUGH
• Announced Warren County Household Hazardous Waste Disposal Day. Residents need to
register online at Warrencountyny.gov/resident/waste or by mail or in person at 4028 Main
Street, Warrensburg. The program is free of charge and will be held on Saturday August 13,
9a-lp at Queensbury Highway Department.

Albany County in Business Formation Activity in 2021.
