RESOLUTION AUTHORIZING ENGAGEMENT OF LABELLA
ASSOCIATES FOR TECHNICAL SERVICES ASSOCIATED WITH WORK
PLAN AND COMPREHENSIVE SCOPE OF SERVICES RELATED TO
WATER QUALITY IMPROVEMENT PROGRAM GRANT IN SUPPORT OF
ROCKHURST COMMUNITY SEWER PROJECT

WHEREAS, the Queensbury Town Board is considering establishing a North
Queensbury/Rockhurst Community Sewer District (District) in accordance with New York State
Town Law Article 12-A, and
WHEREAS, by Resolution No.: 270.2019, the Town Board accepted up to $25,000 in Grant
funding from The Fund for Lake George toward establishment of the District to be used toward the
cost of engineering studies and/or preparation of a Map,Plan and Report, and
WHEREAS, by Resolution No.: 62.2020, the Town Board authorized engagement of The
Chazen Companies, now known as LaBella Associates (LaBella) for technical services associated with
the development of an Engineering Report and Map, Plan and Report for the proposed District and by
Resolution No.: 244,2021, authorized their technical services associated with the preparation of a
Water Quality Improvement Program(WQIP) Grant in support of the District, and
WHEREAS, the Town Board wishes to again engage LaBella for technical services associated
with the preparation of a work plan and a comprehensive scope of services to support the WQIP
Program in support of the District for a sum not to exceed 29,400 in accordance with LaBella's
November 7, 2022 letter proposal submitted at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs engagement of
LaBella Associates for technical services associated with the preparation of a work plan and a
comprehensive scope of services to support the Water Quality Improvement Program WQIP Program
in support of the possible establishment of the North Queensbury/Rockhurst Community Sewer
District for a sum not to exceed 29,400 in accordance with LaBella's November 7, 2022 letter
proposal substantially in the form submitted at this meeting, and
BE IT FURTHER,
RESOLVED, that payment for The Chazen Companies' services shall be paid from
Engineering Account No.: 001-1440-4720-0038 and shall be reimbursed as a cost of the
improvement to the extent designated by the Town Board if the District is established, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to
amend the Town Budget by transferring $29,4000 from General Fund Undesignated Fund Balance
Account No.: 001-0000-0909 to Engineering Account No.: 001-1440-4720-0038 and take any
other actions needed to provide for payment, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor,
Wastewater Director, Town Counsel and/or Town Budget Officer to take any other actions necessary
to effectuate the terms of this Resolution.

We took forward to supporting the TovVn's advancement Vf the RockhurstSewer
System/Sewer District. As you are aware, 8 critical component ofthe planned
improvements includes soft-based wastewater treatment and disposal system.This
system includes a subsurface disposal area at a suitable Location.We have worked with the
Town interacting with Landowners where the planned subsurface disposal system is
proposed. These interactions have been fruitful and the Town desires to proceed with
critical path items to further evaluate the subject property supporting the planned
subsurface disposal system.
LaBe[La Associates also recently assisted the Town in preparing 8funding request from the
NYSDEC Water QuaLity Improvement Program (WQIP).This spring the NYSDEC awarded
$6.067.O78 toward the proposed project.ThaVVQ|PproQramrequirespreparationofavxork
plan and budget.We note that WQIP funds cannot be used for engineering services.
We are working tO prepare the required work plan and acomprehensive scope of services
tO support the project. |O support Of these efforts,vve recommend the Town complete an
advanced assessment of the subject property, including a comprehensive subsurface
exploration program.The program will include a series of excavations(e.g, test pits), soil
evaluations,and percolation tests across the planned subsurface disposal site.Additionally,
we recommend some preliminary survey work tD support the Site evaluation. Should this
work validate the suitability Of the project Site.VY8vviUproVide the comprehensive scope to
support the remainder Vf the project.
We propose this work as additional services under our current agreement with the Town,

vviK plot and analyze the deeds prior k} performing a reconnaissance and Location nf
boundary evidence, This work will support a potential future acquisition ofland by the
Town (e.g.a format boundary survey,subject to an abstract or title report).
LaBeLLa will complete a topographic survey of approximately 3 acres of Land encompassing
the planned disposal area.This work will include Location of aLL test pit explorations and field
tests.The Horizontal datum will be based on the New York State Plan Coordinates(NAO83)
and the vertical datum will be based on the NAVD88as observed from the GPS
observations.
This work will be performed ona Lump sum fee basis not to exceed $5.4OQ.

LaBeLLa will prepare an existing conditions base survey demonstrating the
topography of the 3+/- acre disposal field along with approximate property Lines within the
area outlined. Mapping will be completed in AutoCAD Civil 3D format.The existing
conditions base map will have a Border with Title Block, Name of Surveyor, Map Notes and
References, Legend and Site Location Map, DeLiverabLes will be PDF copy of signed and

Task oos Preliminary Site Investigations of Planned Subsurface DisposaL System:
We wiLl pLan and perform a series of test pits across the subject area/property supporting
the pLanned disposaL system.Test pits wiLt be observed by a Senior Engineer and/or SoR
Scientist. Representatives of KSPE(KathLeen Suozzo)may periodicaLLy observe the
eXp[oBtionSasweU. Test pit togs VViiibeprepared documenting soi[conditions.
AdditionaL/«. a series ofpe[Co(atiOn tests wi[[be cornp[et8d across the site documenting the
suitablLity of the site soits for the siting of the disposaL system.We have pLanned for
approximateLy 2-3 days of fieLd investigations.These investigations wlLL be coordinated with
the Town and property owner.The Town Highway Department wiLL provide
baCkhOe/eXC8vato[and operator tO conduct this work.
This work wiLL be performed on a time and material.basis.We recommend an initiaL budget
of$20,000 OncLusive of KSPE fees). This work wiLL be biLLed according to our standard
charge rates.
