WHEREAS, Morse Engineering incurred a cost for a land survey, and
WHEREAS, the cost was not included in the scope of services for the Gurney
Lane Capital Construction project,

RESOLUTION TO AUTHORIZE CONTRACT WITH GLENS FALLS SENIOR
CITIZENS CENTER, INC.
RESOLUTION NO. 280, Introduced by Mr. Daniel Morrell who moved for
its adoption, seconded by Mrs. Betty Monahan:
WHEREAS, the Town of Queensbury has heretofore contracted with the Glens
Falls Senior Citizens Center, Inc. to provide for services for the elderly,
and
WHEREAS; New York State Aid is available for the establishment, maintenance
and expansion of Senior Citizens Programs, which aid was expanded by the

provision of Chapter 1001 of the laws of New York, 1974, providing among
other things that State Aid will be available for approved expenditures for
a municipal program, and
WHEREAS, the Town of Queensbury desires to continue its support of the
Glens Falls Senior Citizens Center, Inc. under provisions of law so as to be
eligible for State Aid as a Co-sponsoring municipality, NOW, THEREFORE
BE IT
RESOLVED, that the Supervisor of the Town of Queensbury be and hereby
is empowered to contract with the Glens Falls Senior Citizen Center, Inc.
for the furnishing of services to the elderly residents of the Town of Queensbury
for the year 1985 and the payment of $5,000.00 therefore be approved, and
the Supervisor is hereby directed to execute the contract on behalf of the
Town and a copy of such contract, duly executed shall be filed with the Town
Clerk.

DISCUSSION
Proposal of setting inspection fees for solid fuel burning devices...
MR. BILL BODENWEISER, FIRE MARSHAL-Spoke to the Town Board about
the increase in the number of woodstove inspections. Noting that as of January
1st. 1985 all woodstoves must be inspected...Suggested that the Town Board
might wish to consider a fee to cover the expenses incurred in inspecting
such solid fuel burning devices... Noted that there are thirtytwo other permits
issued from the Fire Marshal's Office that do not have a fee involved. Noted
that it takes three trips to make the inspection for a woodstove...
(Discussion held in regard to fees charged by the Town)
TOWN COUNSEL-Local Law #1 of 1982 should be amended, we should set
a public hearing for the amendment...
RESOLUTION TO SET PUBLIC HEARING ON AMENDMENT TO LOCAL
LAW No. 1 of 1982
RESOLUTION NO. 281, Introduced by Mrs. Betty Monahan who moved for
its adoption, seconded by Dr. Charles Eisenhart:
WHEREAS, the Town Board of the Town of Queensbury finds that the improper
installation of wood stoves, chimneys and flues poses a threat to life and
property within the Town of Queensbury, and
WHEREAS, a proposed amendment to Local Law No. 1 of 1982 providing
for the inspection of wood burning stoves, a copy of which is hereto annexed,
has been prepared, and
WHEREAS, the proposed amendment to Local Law No. 1 of 1982 is worthy
of consideration for legislative action, NOW, THEREFORE BE IT
RESOLVED, that public hearing be held concerning the proposed adoption
of the amendment to said Local Law and that said public hearing be held
at 7:30 P.M. in the Meeting Room of the Town of Queensbury Office Building,
Bay & Haviland Rds. in the Town of Queensbury, Warren County, New York
on the 27th day of December, 1984 at which all persons interested in the
subject thereof will be heard, and it is further

AMENDMENT TO LOCAL NO. 1 1982 ENTITLED "A LOCAL LAW FOR ADMINISTRATION
AND ENFORCEMENT OF THE STATE FIRE PREVENTION CODE"
SECTION 13. Solid Fuel Burning Heating Appliance
13.1 Prior to the installation of any solid fuel burning heating
appliance, chimney or flue in any dwelling used as a residence, the owner
thereof, or his agent, shall first secure a building permit from the Town of
Queensbury Fire Code Enforcement Officer or his duly authorized designee.
132 Application for a building permit shall be made to the Fire
Code Enforcement Officer on forms provided by him and shall contain the
following information:
1. Name of owner and agent if applicable;
2. Location of the property;
3. Description of the solid fuel burning heating appliance
proposed;
4. A drawing showing the location of the solid fuel
burning heating appliance and any chimney or flue
utilized thereby;
5. Such other information as may reasonably be required
by the Fire Code Enforcement Officer to establish
compliance of the proposed solid fuel burning heating
appliance with the requirements of the uniform
code.
13.3 The Town of Queensbury Fire Code Enforcement Officer
or his designee shall cause an inspection to be made of the solid fuel burning
heating appliance, chimney or flue at a time when such inspection will best
determine conformity of such installation with the uniform code; provided,
however, that such inspection may be waived for good cause shown.
13.4 Upon approval of such installation, the Town of Queensbury
Fire Code Enforcement Officer or his designee shall issue a certificate evidencing
compliance with the appropriate provisions of the uniform code.
13.5 Fifteen Dollars is set as the fee for such inspection and
shall be paid at the time an application for a building permit for solid fuel
burning heating appliances is filed with the Town of Queensbury.
13.6 No owner of any dwelling used as a residence shall operate,
or cause to be operated, any solid fuel burning heating appliance until such
installation, including chimney and flue, has been approved and a certificate
indicating such approval has been obtained from the Town of Queensbury
Fire Code Enforcement Officer or his designee.

was held on December 11, 1984, and
WHEREAS, the Town Board wishes to have additional information brought
before the Town Board in regards to a deed or letter of intent on the ownership
of the property and in addition a proper description of the property in question,

did recommend that we advertise for bids for a road crossing at Route 9 and

time and place by the Director of Purchasing/Town Clerk Donald A. Chase,
and such bids were then turned over to Mr. Flaherty for his recommendation,

SUPERVISOR WALTER- I would like to make a short statement before open
forum, relative to the newspaper article regarding Paradise Lake.
The Town Board has made no decision regarding Paradise Lake. We have gone
out and walked it, we have asked several individuals to do some investigative
work out there. It is an open project, the Board has never met on any occasion
to disuss it as a Board. I feel that in some of the negotiations that we have
as far as property is concerned, that they are not necessarily something we
are going to put up front. Had we come to a conclusion as to what we were
going to do or how we agreed to go on a project such as that, it would have
been discussed well before we brought it to a vote. My last conversation
with the Attorney for Paradise Lake was as of yesterday. It is still possibly
a very viable project for the Town, 1 would also say that the reason why we
have not acted on it was the fact that we had committed ourselves to a Gurney
Lade Project. It is an area of the Town which has great potential for development.
The Gurney lane Park will have ice skating in the winter, it has cross country
ski trails, it has a magnificent vista, for those of you that have never been
there. We hopefully after the bids come in tomorrow we will find our way
clear, if they come in within the range that we are anticipating we will go
on with the development. I will further state, for the benefit of the Board,
because I have not talked to them about it, as the fiscal officer of this Town...The
Town of Queensbi.ry is in very sound financial shape. As a planner which
is what I call n r; profession, in looking at what we are doing as a Board is
not necessarily what needs to be done today but what we ought to be doing
for the future. I would imagine that when we get our reports back, that we
can sit down and have a thorough conversation with a lot of knowledge, not
heresay, and we will be able to discuss it. As far as taking a position tonight,
I would be very happy during open forum to hear what our residents feel,
whether they support the idea that the Board go ahead or whether they don't.
Please do not think that the Board has made any decision one way or the
other, I can assure you that we have not.
OPEN FORUM
JOSEPH DAIRE-So. Queensbury-I would be all for the project being brought
to the public in a referendum...Like the idea of a stop light on Highland Avenue...
Requested that more people use the wording Town of Queensbury not Glens
Falls...would like to see Montgomery Wards back in Queensbury...
Mr. Bill Morton-9 Meadow Drive-In 1973, I recommended to the Town Board
that the Town purchase the Paradise Lake facility and develop a waterfront
park. The water quality is excellent, it supports an excellent fishery, it lends
itself to row boating, canoeing, car top saleboats and picnicing, it is accessable
to most residents by car or bike, also close to the Route 9 Bus Route...I have
reservations about a swimming pool facility at Gurney Lane at this time....the
popularity of Round Pond...will leave Gurney Lane Pool underutilized....Suggested
that neighborhood pools can be constructed on a smaller scale...I suggest
that it would be fiscally irresponsible to spend one more cent on Gurney Lane
without sorting through the various options and opportunities before us...questioned
how long Mr. Russo will wait for the Town's answer on the property...I urge
the Town Board to reassess it's priorities for providing recreational facilties
to the community...I am of the opinion that the Town should have a centrally
located, first class Town Park. Round Pond lends itself to the development
of a supurb Town Park. I recommend that the purchase of the Round Pond
facility be viewed as top priority...(text of the speech not given to the Town

MR. GETMAN-Twicwood Lane-I have spoken with many people including
Mr. Russo, and have given a great deal of thought to it. I feel that this is
a once in a life time opportunity. Asked that the Gurney Lane decision be
delayed until a decision is made on Round Pond...I am not sure that we need ._./
both...noted that Round Pond has many outstanding features.
MR. CIAMATO-Heinrick Circle-I am for looking into Paradise Lake. 1. You
have done the best you could with Gurney Lane, something new has transpired
and you should look at it.2. Paradise Lake is much more advantageous...3.
The Paradise Lake Property would appreciate in value more than the Gurney
Lane Project...
MR. MONTESI-18 Meadow Drive-I am in favor of looking at Gurney Lane
and Round Pond...questioned the status of the bidding on Gurney Lane...
SUPERVISOR WALTER-Bids will be opened tomorrow...the engineer will
report to the Town Board on December 18th...I do not think that we would 299
necessarily make a committment on the 18th...
MR. MONTESI- Questioned if Round Pond could receive Federal Funding?
SUPERVISOR WALTER-I cannot answer that at this time, except that as
far as funds they are scarce .With the Bureau of Water Resources, in any
kind of applications for funding for bodies of water, we have been told that
because there are so many bodies of water in this area that they would not
give funds for the development of any one, because they were accessable...
the residents know there is a great shore line in Lake George and in other
lakes in Warren County but we do not have public access to them, it is hard
to get that point across to the gentlemen in the various State and Federal
Agencies...They have a rating process that if there are so many bodies of
I water in the area they deduct five points...so we always find ourselves on
the fence or below the funding limit...We do have an application for funds
for Gurney Lane but to this date we have no idea whether we will receive
those monies...I can see as a planner that we would probably have a need
for three major recreation areas in twenty-twentyfive years from now...my
regret is that some of my predecessors years ago did not jump on some land
at Lake George—The Town is in good financial shape, I would hate to see
it be an either or situation because I can see the development of those areas...It
is part of our master recreation plan to acquire sites for recreational purposes...
MR. CIAMATO-Will the Town look at the alternative of Round Pond...
COUNCILMAN MONANHAN-It sounds to me like people are going on the
assumption that Round Pond is big enough for the whole Town, Round Pond
is not big enough to be the only source in the Town.
SUPERVISOR WALTER-That is why I am saying, why are you saying either
or?
MR. MONTESI-I am not of the opinion that you should do either or, I would
not mind the Town doing both...I would like to see that property tied up for
the future...
MS. DEBBIE ROBINSON-Chestnut Ridge-In living over there on that side
of town it is terrific that we have this possibility to buy Round Pond.
I think, because Queensbury is growing, we need both places...I do not like
pools...I think it is tough that Queensbury has no access to Lake George, this
would be an alternative...
COUNCILMAN EISENHART-Are you willing for us to saddle the taxpayers
with a million and a quarter additional money this year?

COUNCILMAN EISENHART- We have a recreation commission that has spent
hours on this, we had them up there, they all agreed informally that we go
ahead with Gurney Lane and not with Round Pond.
COUNCILMAN MONAHAN- They said do not let Gurney lane stop, but they
did not say, do not start with Paradise Property...
SUPERVISOR WALTER-We have just passed a budget that gives the residents
of the Town of Queensbury a twenty percent deduction in their Town Taxes...
COUNCILMAN MORRELL-I received a letter from Mrs. Marcia Shaw-to
tie in with what Mr. Ciamato and Mr. Montesi said and some of the others...
"In case you are getting much feed back in regard to the Town acquisition
of the Paradise Lake Property, I am in favor of it. In the long run I think
it would be shortsighted not to purchase the land, in addition to the renovation
of Gurney Lane. ...The Town's growth potential is phenomenal and one day
we will need the recreation site."
COUNCILMAN MONAHAN- My idea is that everyone should be able to bike
to a recreation site, I do not think you should have to drive to it.
MR. KREBS-38 Twicwood Lane-Everybody that I have talked with in the

COUNCILMAN OLSON- I get the feeling from the public tonight that you
people want to have us look at this as an investment...noted the heavy growth

MR. TARANA-27 Edgewood Drive-Asked if the Town could pick up the right
of first refusal to lock the property up and look at the options...I am for taking
a good look at this land.
MR. HODGKINS-Belle Mountain Road-I am in favor of the project....I live
near the Gurney Lane Area, and I see the high amount of pressure being put i
on that facility by the number of people using the site. The time for elevating
that pressure is now and with the expansion of the Gurney Lane Facility and
in the light of what Mayor Bartholomew has said about charging for use of
Glens Falls facility, this will place a greater pressure on the Town's facilities...
MS. HEINSMAN-Hicks Road-I took my children to Gurney Lane when they
were toddlers anti it was very crowded then...with the West Glens Falls developmer.
more pressure will go to Gurney Lane...I think Paradise Lake would alleviate
that pressure...
UNKNOWN- Questioned if the property could be used next summer...?
COUNCILMAN MORRELL- Noted that the buildings would not meet OSHA
requirements for public assembly at Paradise lake...
COUNCILMAN OLSON-There is major construction to be done there before
it will be ready for the public...
SUPERVISOR WALTER-It is realistic to think that the town could sustain
both projects...
COUNCILMAN MONAHAN-The Town has put aside money for capital projects,
we do not have to borrow every single cent...
