SPECIAL MANDATE COMPLIANCE OFFICER

WHEREAS, by Resolution No.: 84,2022, the Queensbury Town Board authorized the
appointment of John O'Brien as Acting Director of Building and Codes Enforcement and Acting
Special Mandate Compliance Officer, and
WHEREAS, the Warren County Department of Personnel and Civil Service has advised that
Mr. O'Brien has been approved for provisional appointment to the position of Director of Building and
Codes Enforcement as set forth in the job description for such position adopted by the Warren County
Department of Personnel and Civil Service, subject to Civil Service Law and Rules including an exam
to be held at a later date, and
WHEREAS, the Town Board wishes to authorize the provisional appointment of Mr. O'Brien
as the Town's Director of Building and Codes Enforcement, and
WHEREAS, the Town Board also wishes to authorize the appointment of Mr. O'Brien as the
Town's Special Mandate Compliance Officer,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes the provisional appointment
of John O'Brien as the Town of Queensbury's Director of Building and Codes Enforcement subject to
Civil Service Law and Rules including an exam to be held at a later date and Mr. O'Brien meeting any
and all other Civil Service requirements for the position, at an annual salary as specified in Resolution
464.2022, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the appointment of Mr.
O'Brien as Special Mandate Compliance Officer in addition to his full-time Director of Building and
Codes Enforcement position with an annual stipend in the amount specified in Resolution 464.2022 for
such additional duties and responsibilities, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor,
Director of Building and Codes Enforcement and/or Town Budget Officer to complete any forms and
take any action necessary to effectuate the terms of this Resolution.

DISTINGUISHING FEATURES OF THE CLASS :
This position is in charge of a building and cede enforcement
department and is responsible for reviewing all plans and
specifications submitted with applications for local building
permits . The work involves the inspection of buildings both
erected and under construction or repair for compliance with
approved plans and specifications , Uniform Fire Prevention and
Building Code and zoning . The Uniform Fire Prevention and
Building Code provides a minimum level of safety coverage for New
York State and includes standards on building construction , fire
prevention. , housing maintenance , manufactured housing and
handicapped access . Incumbents of this title review all plans and
inspect all construction in the municipality for which they work ,
including large scale construction and construction which involves
the use of reinforced concrete or structural steel . The work is
performed under the general direction of the local legislative
body or the top administrative officer . Supervision may be
exercised over lower lever building inspectors , deputies , and
technical and clerical assistants .
TYPICAL WORK ACTIVITIES : ( Illustrative only )
Supervises the operation of the municipal building department ;
Reviews plans and specifications submitted with building permit
applications for compliance with the Uniform Fire Prevention
and Building Code and zoning ;
Inspects buildings and structures in the process of construction
or repair for compliance with approved plans and
specifications and all requirements of applicable ordinances
and laws ;
Reviews plans and performs inspections of large scale
construction and construction which involve the use of
reinforced concrete or structural steel ;
Issues building permits and furnishes the prescribed certificates
of occupancy upon application after completion of
construction or repair ;
May check permit applications for compliance with zoning
ordinances , restrictions for signs and buildings , and the
possible requirement of a zoning variance ;
May inspect piping , traps , fixtures , and drainage to see that the
work is being carried out in accordance with approved plans
and specifications and applicable ordinances and laws ;
Explains the requirements of the Uniform Fire Prevention and
Building Code and zoning to building contractors and the
general public ;
Inspects all buildings which contain a combustible or ignitable
substance whether stored. , available for sale , used for
heating or cooking , or any other reason for compliance with
the Uniform Fire Prevention and Building Code Act ;
Inspects existing buildings and structures to insure their
conformity with safety standards ;
Orders unsafe conditions in existing buildings and structures to
be removed and arranges for condemnation notices to owners
of hazardous buildings and structures ; ( cont . )

Investigates complaints and assists in prosecuting violations of

CHARACTERISTICS :
Thorough knowledge of modern principles , practices , materials and
tools used in building construction ; thorough knowledge of the
requirements of the Uniform Fire Prevention and Building Code and
zoning ordinances ; knowledge of proper building practices ;
thorough knowledge of the New York State Multiple Residence Law ;
thorough knowledge of the principles and practices governing the
storage and distribution of combustibles ; ability to establish and
maintain cooperative relationships with other public officials ,
building contractors , plumbing contractors , and the general
public ; ability to read and interpret plans and specifications ;
ability to be firm but courteous ; honesty ; thoroughness ; tact ;
good judgment ; physical condition commensurate with the demands of
the position .
MINIMUM QUAMIFICATIONS :
Graduation from high school or possession of a high school
equivalency diploma , completion of a New York State Buildings and
Codes course and :
( A ) Bachelor ' s degree in engineering or architecture or a
related field and one year of experience in a Building
and Codes Department ; or
( B ) Five years of experience in building construction work
or building and code enforcement ; or
( C ) Any equivalent combination of training and experience
as described in ( A ) and ( B ) above .

WHEREAS, David Hatin, the Town of Queensbury's Director of Building and Codes
Enforcement for over 33 years, has submitted his resignation effective February 250, 2022, and
WHEREAS, Mr. Hatin has also served as the Town's Special Mandate Compliance Officer
since the position was established in accordance with Resolution No.: 35, 2021 , and
WHEREAS, the Town Board wishes to acknowledge Mr. Hatin's dedicated years of
exemplary service to the Town of Queensbury and accept his retirement, and
WHEREAS, the Town Board wishes to authorize the appointment of current Building and
Codes Enforcement Officer John O'Brien as the Totvn's Acting Director of Building and Codes
Enforcement and Acting Special Mandate Compliance Officer effective as of Mr. Hatin's
retirement at the close of business on February 25` ', 2022, and
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board 'hereby authorizes the appointment of
current Building and Codes Enforcement Officer John O'Brien as Acting Director of Building and
Codes Enforcement at an annual salary of $68,682 effective as of David Hatin's retirement at the
close of business on February 25 h, 2022 on a provisional basis until such time as Mr. O'Brien
meets any and all Civil Service requirements for the position, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the appointment of Mr.
O'Brien as Acting Special Mandate Compliance Officer effective as of Mr. Hatin's retirement with
an annual stipend for the position in the amount of $5, 125 to be paid to Mr. O' Brien in addition to
his annual salary for the full-time Acting Director of Building and Codes Enforcement position, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor,
Director of Building and Codes Enforcement and/or Budget Officer to complete any forms and tape
any action necessary to effectuate the terms of this Resolution.
