At a meeting of the Warren County Planning Board, held on the 14th
day of April , the above application for a Use Variance to construct a
16' x 24' addition on the rear of an existing structure
was reviewed, and the following action was taken. Recommendation to:

Comment:
The Warren County Board recommended approval with the condition
that screening be provided to the sides of the property and a letter
accompany the approval to Mr. Lynn regarding the condition and some
other general recommendations.
Thw County_Planning_Board decision is not in concurrence with the Town.
It is the policy of the Warren County Planning Board to follow the proceddures
of the New York State General Municipal Law, Section 239-M, with regard to Municipal
Zoning actions that are referred to and reported thereon. The following are
procedural requirements that must be adhered to:
1.) The Warren County Planning Board shall report its recommendations to
the referring municipal agency, accompanied by a full statement for
such actions. If no action is taken within thirty (30) days or agreed
upon time, the municipal agency may act without such report.
2.) If the recommendation is for disapproval of the proposal, or modification
thereof, the municipal agency shall not act contrary to such action
except by a vote of a majority plus one of all the members thereof and
after the adoption of a resolution fully setting forth the reasons for
such contrary actions.
3.) Within seven (7) days after the final action by the municipal agency
having jurisdiction on the recommendations, modifications or disapproval
of a referred matter, such municipality agency shall file a report with.
the Warren County Planning Board orr�the necessary tSorm.

This letter is being sent to you in conjunction with Variance #749, for
Stanislaw Kostek (Stan's Seafood) 284 Bay Road for a use variance to
construct a 16' x 24' addition on the rear of the existing structure.
The Warren County Planning Board on April 14th, 1982 recommended approval
with the condition that screening be provided to the sides of the property
and that a letter be prepared explaining the screening and other general
recommendations.
The main concerns of the Warren County Planning Board are: (1) the overall
traffic generating characteristics of this use in relation to the effect
such traffic has on other adjacent land uses, (2) the adequacy of existing
parking facilities, and (3) the lack of an orderly and safe parking scheme
for the area. This not only is a problem for the patrons of this business,
but this situation could present a problem for emergency and fire protection
vehicles. Presently, adequate emergency access to the rear and sides of
the structure is hampered by the overcrowded nature of the lot and the
parking of business trucks, stored equipment, and debris around the building.
Mr. Kostek has appeared before our Board three times since 1978, originally
to construct a 36' x 46' structure for a retail business with 64' and 70'
setbacks to the rear and north side, respectively. In 1980, an addition
was requested to enlarge the existing structure with a 15' setback in lieu
of 50'. In 1981, he applied for an addition to a structure for a wholesale,
retail, and dining facility. Since that time there appears to have been
little done by the applicant concerning the traffic safety around the
structure or positive coordination with the Queensbury Beautification
Committee to address any of the problems mentioned above.

The Warren County Planning Board feels that the proposed addition
for storage would not have any overriding County impact. Mr. Kostek's .
representative assured the Board that the purpose of the addition will be
to enclose an existing and presently unsightly storage are-:; thus
eliminating outside storage of debris. The Board recommen_ed adequate
screening be required to protect and enhance the parcel, as well as to
protect the adjoining land uses.
It was felt that this letter was necessary, in that a number of these
concerns needed to be reviewed by your office and the Zoning Board of
Appeals prior to taking any formal action.

Zoning Board of Appeals: Variance - Stanls Sea Food - Bay Road
For the completion of your records, re wish to report that Bob Dick, contractor, met
with our Committee July 6. He said he could speak for Stanislaw Kostek 7rho operates
Stanls Sea Food on Bay Road. Mr. Dick stated that he is certain the applicant would
comply with any agreement , within reason, that he made with the Committee.
1. Mr. Dick agreed the new addition would be painted the same color as the facade
of the existing building.
2. iEr. Dick pointed out where the dumpster would be located in the northwest corner
between the existing building and the new addition. He agreed on a stockade fence/
gate which would hide the dumpster, but make it acceptable to the trash remover.
3. A hemlock hedge of small hemlocks z feet apart along the southside of the property*
(and access drive to the present Community -orkshop Testing Center).
4. Due to the number of trees required along the southside, which .could result in
considerable expense, Mr. Dick did not believe the applicant should be required
to continue the hedge along the west side of his property and also due to plans to
use the 15 foot area as alldrive-around° for service vehicles and possibly customers.
The Committee felt strongly thatfsince ys. Kostek had removed all the natural
growth on the perimeter of the property, when he had been requested to retain it,
but relented as to the west side when the cost was figured and the use of the
area was mentioned, so left this stipulation as optional.
5. Mr. Dick did suggest planters in the front northeast and southeast corners of the
property. Planters would be made of railroad ties r,,ith a small deciduous or ever-
green variet4placed in each planter along with a few flowers. Mr. Dick believed
6r. Kostek would agree to this in the north front corner, but questioned the possib-
ility in the south front corner due to traffic recuirements. The Committee strongly
recommended the planter in the north corner, but left the use of the planters as
optional.
6. The Committee agreed rrith I'dr. Dick that a hedge or screen along the north property
line, while desirable, ryas not necessary in comparison c;ith the west side and espec-
ially when lix. Kostek would like to purchase that plot of ground,
