RESOLUTION AUTHORIZING MEMORANDUM OF AGREEMENT
BETWEEN TOWN OF QUEENSBURY AND WARREN COUNTY -
NORTHERN BORDER REGIONAL COMMISSION GRANT FOR
DEVELOPMENT OF IMPROVEMENT PLAN FOR WARREN COUNTY
BIKEWAY AND FEEDER CANAL TRAIL

WHEREAS, Warren County has applied for and been awarded a $160,000 total grant
award from the Northern Border Regional Commission (NBRC) to develop an improvement plan
for the Warren County Bikeway and Feeder Canal Trail multi-use trail network (Project) that will
provide Warren County and its municipal partners with an action plan for investing in the Project,
and
WHEREAS, as a condition of the grant, a local "match"to the Grant award is required in that
NBRC requires Warren County to provide matching funds in the amount of$40,000, with the City of
Glens Falls, Village of Hudson Falls, Town of Lake George and Town of Queensbury, as
municipalities located along either the Warren County Bikeway or Feeder Canal Trail, partnering with
Warren County to contribute funding towards such municipal match, and
WHEREAS,the Town's match would be a cash contribution in the sum of$4,294.31, and
WHEREAS, the Town Board believes that this Grant Program will benefit Town residents
and therefore wishes to authorize the Town's participation in the Grant Project, execution of a
Memorandum of Agreement (MOA) with Warren County substantially in the form presented at this
meeting and the Town's $4,294.31 local match,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes the Town of Queensbury's
participation with Warren County regarding the County's grant from the Northern Border Regional
Commission (NBRC) to develop an improvement plan for the Warren County Bikeway and
Feeder Canal Trail and the Town's cash contribution in the amount of $4,294.31 to be paid from
Miscellaneous Contractual Account No.: 00 1-8020-4400, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to
amend the Town Budget and transfer $4,294.31 from Contingency Miscellaneous Contractual
Account No.: 001-1990-4400 to Miscellaneous Contractual Account No.: 001-8020-4400 and take
any other needed actions to effectuate the Town's contribution, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute the "Memorandum of Agreement Northern Border Regional Commission NBRC Grant for the
Development of an Improvement Plan for the Warren County Bikeway and Feeder Canal Trail"
substantially in the form presented at this meeting and/or any other associated documentation, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, and/or
the Town Budget Officer to take any other actions necessary to effectuate the terms of this Resolution.

THIS Agreement,
BETWEEN: The COUNTY OF WARREN, 1340 State Route 9„ Lake George, New York
12845 (Hereinafter referred to as the "County")
-and-
The TOWN OF QUEENSBURY, Town Office Building, 742 Bay Road,
Queensbury, New York 12804 (Hereinafter referred to as the "Town")
WHEREAS, The County of Warren has applied for and been awarded a grant from the
Northern Border Regional Commission (the "NBRC") to develop an improvement plan (the
"project") for the Warren County Bikeway and Feeder Canal Trail that will provide Warren County
and municipal partners with an actionable plan for snaking investments in the multi-use trail
network; and
WHEREAS, the total grant award from the NBRC is One Hundred Sixty Thousand Dollars
($ 160,000); and
WHEREAS, as a condition of the grant, the NBRC requires the County to provide matching
funds in the amount of Forty Thousand Dollars ($40,000); and
WHEREAS, the City of Glens Falls, the Village of I-ludson Fails, the Town of Lake George,
and the Town of Queensbury are each located along either the Warren County Bikeway or Feeder
Canal Trail and are interested in being municipal partners; and
WHEREAS, each of the municipalities is ready and willing, to contribute funding towards
the Forty Thousand Dollar ($40,000) municipal match; and
WHEREAS, the County has contracted with the Lake Champlain - Lake George Regional
Planning Board (the "LCLGRPB") to be the grant administrator as required by the N* BRC for this
project; and

NOW THEREFORE, to effectuate the purposes of the NBRC grant-
1 _ The County will develop an improvement plan for the Warren County Bikeway and
the Feeder Canal Trail that serve as connections between the Empire State Trail and Lake George
and the downtowns of the Town of Queensbury and the other municipal partners.
2. The Town. of Queensbury shall contribute Four Thousand Two Hundred Ninety- Four
Dollars and Thirty-One Cents ($4,294.31 ) as and for its share of the municipal matching funds
contribution towards the project within thirty (30) days after the Town Board authorizes payment
of the funds or the execution of this Agreement — whichever is later.
3 . The County shall accept said contribution from the Town and apply the funds toward
the purposes of the project as approved by the NBRC and administered by the LCLGRPB.
4. The County shall contribute a total matching share of Forty Thousand Dollars
($40,000) towards the project, of which Eleven Thousand Nine Hundred Eighty-Six Dollars and
Thirty-Cents ($ 1 1 ,986.30) is a pro rata share based upon the proportional mileage of the Warren
County Bikeway and Feeder Canal Trail located within the Town of Queensbury.
IN WITNESS WHEREOF, this Agreement has been executed by the duly authorized officers
of the respective parties.

AUTHORIZING SUBMISSION OF A GRANT APPLICATION TO THE
NORTHERN BORDER REGIONAL COMMISSION FOR REGIONAL TRAIL STUDY AND
CONNECTIONS TO EMPIRE TRAIL SYSTEM AND AUTHORIZING A GRANT
AGREEMENT FOR SAME ON BEHALF OF THE PLANNING DEPARTMENT
RESOLVED, that the Warren County Board of Supervisors hereby authorizes the Chair of the Board
of Supervisors to execute and submit a grant application to the Northern Borders Regional Commission, JC
Cleveland Federal Building, 153 Pleasant Street, Suite 1501 , Concord, New Hampshire 03301 , for regional
trail study and connections to Empire trail system grant funding, in a total amount not to exceed Two
Hundred Thousand Dollars ($200,000), with no matching funds required by the County, for a term to be
determined, and be it further
RESOLVED, that upon notification of the grant award, the Chair ofthe Board of Supervisors be, and
hereby is, authorized to execute the grant agreement(s) and/or any and all other necessary documents relating
to said agreement, in a form approved by the County Attorney, and be it further
RESOLVED, that if any further funding becomes available during the term of this contract, no
further resolution will be necessary to accept these funds and the Chair of the Board of Supervisors is
authorized to execute any documents necessary to receive the funds.
