AND INSTALLATION OF FENCE AT TOWN WATER DEPARTMENT TO
SPITALE CONSTRUCTION RESOURCES, INC.

WHEREAS, by Resolution No.: 282,2020, the Queensbury Town Board authorized
establishment of Water Treatment Plant Campus Improvements Capital Project No. 232 to
establish funding for expenses related to the repairs and improvements at the Water Treatment
Plant Facility/Campus including the furnishing and installation of a fence, and
WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and award
the bids to the lowest responsible bidder(s) meeting New York State statutory requirements and the
requirements set forth in the Town's bidding documents, and
WHEREAS, by Resolution No.: 61,2023, the Town Board authorized the Town Purchasing
Agent to advertise for bids for the furnishing and installation of an approximately 900' long 6' high
chain link barbed wire fence at the Water Filtration Plant (Fence Project) in the official newspaper
for the Town and following such advertisement of bids, all six (6) received bids were opened and
reviewed on March 8t', 2023, and
WHEREAS, the Purchasing Agent and Water Superintendent have recommended that the
Town Board award the bid to the lowest, responsible bidder, Spitale Construction Resources, Inc.
for an amount not to exceed $51,760, and
WHEREAS, the Water Superintendent has advised the Town Board that there are times
when Change Orders may become necessary for such Contract and has requested that the Town
Board also authorize him to approve and sign certain Change Orders up to a five-percent (5%)
contingency for Change Orders that he deems necessary or appropriate,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby accepts and awards the bid for the
Fence Project from the lowest, responsible bidder, Spitale Construction Resources, Inc., for an
amount not to exceed $51,760, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes the Town Water Superintendent to
approve and sign Change Orders pertaining to the Contract up to a five-percent(5%) contingency
or in the total amount not exceeding $2,588 that he deems necessary or appropriate, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs that payment for this
Fence Project shall be made from Capital Construction Account No.: 232-8310-2899, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor,
Purchasing Agent, Water Superintendent, and/or Budget Officer to take such other and further actions
as may be necessary to effectuate the terms of this Resolution.

WHEREAS, the 'Water Superintendent has requested Town Board authorization to
advertise for bids for the furnishing and installation of an approximately 900' long 6' high chain
link barbed wire fence at the Water Filtration Plant (Fence Project), and
WHEREAS, General Municipal Law § 103 requires that the Town advertise for bids and
award the bid to the lowest responsible bidder meeting New York State statutory requirements and
the requirements set forth in the Town's bid documents and specifications to be prepared by the
Water Superintendent and/or Town Purchasing Agent,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs the Town
Purchasing Agent to post and publish an advertisement for bids regarding the Fence Project
delineated in the preambles of this Resolution and receive all bids, and
BE 1T FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town's Purchasing
Agent to open all received bids, read them aloud and record the bids as is customarily dome and
present the bids to the next regular or special meeting of the Town Board, and
BE 1T FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor,
Water Superintendent, Purchasing Agent and/or the Town Budget Officer to take any and all
actions necessary to effectuate all terms of this Resolution.

CERTIFICATION OF COMPLIANCE WITH THE IRAN DIVESTMENT ACT
As a result of the Iran Divestment Act of 2012 (the "Act"), Chapter 1 of the 2012 Laws of New York, a
new provision has been added to State Finance Law (SFL) § 165-a and New York General Municipal
Law § 103-g, both effective April 12, 2012. Linder the Act, the Commissioner of the Office of General
Services (OGS) will be developing a list of "persons" who are engaged in "investment activities in Iran"
(both are defined terms in the law) (the "Prohibited Entities List'). Pursuant to SFL § 165-a(3)(b), the
initial list is expected to be issued no later than 120 days after the Act's effective date at which time it will
be posted on the OGS website.
By submitting a bid in response to this solicitation or by assuming the responsibility of a Contract
awarded hereunder, each Bidder/Contractor, any person signing on behalf of any Bidder/Contractor and
any assignee or subcontractor and, in the case of a joint bid, each party thereto, certifies, under penalty of
perjury, that once the Prohibited Entities List is posted on the OGS website, that to the best of its
knowledge and belief, that each Bidder/Contractor and any subcontractor or assignee is not identified on
the Prohibited Entities List created pursuant to SFL § 165-a(3)(b)
Additionally, Bidder/Contractor is advised that once the Prohibited Entities List is posted on the OGS
Website, any Bidder/Contractor seeking to renew or extend a Contract or assume the responsibility of a
Contract awarded in response to this solicitation must certify at the time the Contract is renewed,
extended or assigned that it is not included on the Prohibited Entities List.
During the term of the Contract, should the Town receive information that a Bidder/Contractor is in
violation of the above-referenced certification, the Town will offer the person or entity an opportunity to
respond. If the person or entity fails to demonstrate that he/she/it has ceased engagement in the
investment which is in violation of the Act within 90 days after the determination of such violation, then
the 'Town shall take such action as may be appropriate including, but not limited to, imposing sanctions,
seeking compliance, recovering damages or declaring the Bidder/Contractor in default.
The Town reserves the right to reject any bid or request for assignment for a Bidder/Contractor that
appears on the Prohibited Entities List prior to the award of a contract and to pursue a responsibility
review with respect to any Bidder/Contractor that is awarded a contract and subsequently appears on the
Prohibited Entities List_
