WHEREAS, the Queensbury Town Board is considering establishing a North
Queensbury/Rockhurst Community Sewer District (District) in accordance with New York State
Town Law Article 12-A, and
WHEREAS, by Resolution No.: 270.2019, the Town Board accepted up to $25,000 in Grant
funding from The Fund for Lake George toward establishment of the District to be used toward the
cost of engineering studies and/or preparation of a Map,Plan and Report, and
WHEREAS, by Resolution No.: 62.2020, the Town Board authorized engagement of The
Chazen Companies, now known as LaBella Associates (LaBella) for technical services associated with
the development of an Engineering Report and Map, Plan and Report for the proposed District, by
Resolution No.: 244,2021, authorized LaBella's technical services associated with the preparation of a
Water Quality Improvement Program (WQIP) Grant in support of the District and by Resolution No.:
423,2022, authorized LaBella's preparation of a work plan and comprehensive scope of services to
support the WQIP Program, and
WHEREAS, the Town Board wishes to advance the design and development of the Rockhurst
Sewer District and has requested a comprehensive scope of services from the design team of LaBella
and KSPE, and
WHEREAS, LaBella has accordingly provided a Proposal dated April 12, 2023 and the Town
Board wishes to advance the time (or seasonally) sensitive work (Group A Tasks) in such
Proposal and those services focused on the potential acquisition of lands for the subsurface
dispersal system, for a sum not to exceed$186,842,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs engagement of
LaBella Associates for professional engineering and technical services to advance the design and
development of the Rockhurst Community Sewer District as delineated as the Group A Tasks set forth
in LaBella's April 12, 2023 Proposal substantially in the form submitted at this meeting for the amount
of$186,842, and
BE IT FURTHER,
RESOLVED, that payment for The Chazen Companies' services shall be paid from
Engineering Account No.: 001-1440-4720-0038 and shall be reimbursed as a cost of the
improvement to the extent designated by the Town Board if the District is established, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to
amend the Town Budget by transferring $186,842 from General Fund Undesignated Fund Balance
Account No.: 001-0000-0909 to Engineering Account No.: 001-1440-4720-0038 and take any
other actions needed to provide for payment, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to sign
any needed documentation and/or Agreements and the Town Supervisor, Wastewater Director, Town
Counsel and/or Town Budget Officer to take any other actions necessary to effectuate the terms of this
Resolution.

Dear Supervisor Strough:
We Look forward to continuing our efforts in assisting the Town with the design and
establishment of the Rockhurst Sewer District. Over the last several months we have worked
with the Town interacting with Landowners where the planned subsurface disposal system is
proposed. These interactions have been fruitful, and we advanced additional assessment of
the subject property, including a comprehensive subsurface exploration program.
Based on our recent discussions with the Town, we understand that the Town would Like to
continue development of the project so as to better inform the overall cost estimate, and
therefore potential rates for district users. This information will be central to presenting the
proposed project to the public. As such, we have developed this proposal with that intent,
and it contains survey and field 'investigative work, as well as preliminary design and cost
estimation services.
We propose this work as additional services under our current agreement with the Town.
Project Approach
The planned establishment of the Rockhurst Sewer System/Sewer District will require
careful planning, robust/frequent public communications, and careful design, We propose
to complete work in phases and will provide a detailed schedule. Our goal is to provide the
town and the affected Landowners with the necessary information to understand treatment
alternatives. project capital costs as well as Long term operation and maintenance
requirements/expenses. Because of the unique nature of the district, the physical and
environmental constraints, as well as the relatively unique approach of the current preferred
treatment alternative- we wiLL work in judiciously to bring information forward to aid in sound
decision making by the Town.
We have prepared a comprehensive scope of work that will advance the project through
district formation and preliminary design. The NYSDEC WQIP grant wilt fund only a portion
of the construction costs (as they are currently estimated). The Town will initially fund the
engineering of the district, this cost will ultimately be the responsibility of the district once

established. We will work with you to identify other funding sources to further the fananciaL
viability of the project.
Our initial. efforts will include:
• Meeting(s) with NYSDFC to establish design parameters, confirm permit
requirements and identify groundwater monitoring Locations for the
Subsurface Disposal System (SDS).
* Assist in initial activities for the Town's acquisition of lands for the subsurface
disposal system (SDS)
Additional soil testing of the planned location of the SDS and utility routing as
well as wetlands, ecological, historic/cultural due diligence.
• Advance Preliminary Design work including an update to the alternatives
analysis, resolve the treatment method /technology. This work will be further
the understanding of projects costs and property acquisition needs.
Prepare a framework of the Rules & ReguLation which will govern the
operating parameters of the district. This work will serve to clarify and expand
upon individual property owners' responsibilities and potential costs.
Conduct are informational 'Workshop with the property owners/district.
This proposal includes a comprehensive scope of services rased on our understanding of
the project and focused on advancing the project through establishment of the "Rockhurst
Sewer District". It does not include detailed design or services associated with advancing
the project through construction phase. Nor does it include Legal services that may be
required.
Upon presenting this scope and reviewing with Town representatives during the week of
April 3. 2023, the Town asked that we phase services. The Town would Like to advance time
(or seasonally) sensitive work (Group A Tasks) and those services that are focused on the
potential acquisition of Lands for the subsurface disposal system.
Our work program is organized as follows.
io0 Series - Field Investigations
This work includes further investigations of the Lands targeted for the subsurface disposal
system and the planned route of the collection and conveyance system including cultural
resource investigations, aquatic and ecological reviews and delineations, geotechnicaL
support. Much of this work will occur early in the schedule to support design and Land
acquisition.
Zoo Series - Survey Services
This work includes aerial flight of the study area/affected properties, boundary survey in
support of Land acquisition for siting the SDS, the subdivision of Lands for the SIDS, and
access/utility easements for routing the forcemain on Lands of Kirkpartick, Work associated

with detailed Location and collection of inverts for existing septic systems work be completed
at later stages of the project, once district formation is imminent. There is an optional task to
support subsurface utility Location.
-3oo Series - Preliminary Design
This phase of work includes evaluation of design alternatives (treatment and sewer routing)
development of preliminary (3o%) design drawings, and update cost estimates. We will
engage with property owners and develop a Map, Plan and Report (MPR).
goo Series -Environmental Permitting
We will conduct early meetings with NYSDEC and USACOE to understand permitting
requirements. `+)f/e wiLL also assist the Town in the completion of SEORA review for the project
This work also includes validations by the N`r'SDEC and USAGE of the aquatic resource
delineations and the permit negotiations and coordination. SPDES permitting of the planned
system will occur at a later date.
Soo Series - Meetings Promect Management & Coordination
This Series includes a task for meeting coordination, communications, correspondence, and
project management. This also includes Grant Administration service associated with the
WOIP grant and prospecting for other sources of funding.
SCOPE OF SERVICES
Please note that the timing and completion of work wilt be phased and as described in the
fee table.
ioo SERIES - FIELD INVESTIGATION'S
Additional site investigations and associated due diligence activities are required to ascertain
site conditions, project feasibility, and advance the design effort. We will advance boundary
and topographic survey, soils and geotechnicat investigations, wetland and ecological due
diligence as well as historical and cultural resource investigations.
Our goal is to conduct this work to understand the project impacts on the built/naturaL
environment, inform selection of the design alternatives, and permitting requirements and to
inform the overaLL costs -of the project.
Phase a.o3 Sail Testing
KSPE will Lead the examination and design of the subsurface disposal system (SSDS).
Their personnel will advance up to 3-days of additional testing in the area of the SSDS.
Efforts under this task include coordination for testing, testing itself and formalizing the
results of deep test pits and percolation tests to be performed. It is assumed that the Town
will provide water to the site for percolation testing and KSPE can be on site with water
available to us for use between 7:30AM-5PM each day.
Our proposal Includes a subcontractor to execute the test pitting ( Ellsworth
Excavating ). We will coordinate with the Town and property owner to schedule soil

testing and the Town's presence on site. Currently it is anticipated that testing will occur
during the month of April 2023, assuming snow meLt has occurred and favorable weather
conditions.
Phase 102 - Cultural Resources Investigation
We will provide cuLturaL resource services through an WBE subconsuLtant (Hudson Cultural
Services (HCS), Ltd,). The Level of effort identified below is an estimate and may be refined as
part of the consultation with the NY State Historic Preservation Office (NY SHPO). The cultural
resource investigations will focus on undisturbed land, with coordination undertaken with
NYSHPO prior to any investigations, including review of areas that will not require testing Ge.,
disturbed roadways),
Phase sA Literature Search and Sensitivity Assessment
The Phase 1A Literature Search and Sensitivity Assessment will assess the overall sensitivity
of the site based on environmental factors and whether portions of the site have been
disturbed, assess the Level of that disturbance and determine whether prehistoric or historic
sites have been identified in the vicinity of the project area. The Phase iA will include a site
visit to photograph the existing conditions which will include any existing structures within the
project area. Research will be undertaken to determine former Land use, and a review of
the archaeological site files housed at New York State's Office of Parks. Recreation and
Historic Preservation will be completed. Cartographic materials available at the Library of
Congress or the New York State Archives will be reviewed to determine if any historic
structures (Map Documented Structures) were Located within the property boundaries.
The final Phase 1A report wilt include the scope of the proposed undertaking (if known), a
discussion of the environmental conditions on the property, a prehistoric sensitivity
assessment and an assessment of any historic properties with photo-documentation of the
existing conditions. The Phase 1A will also evaluate any impacts to any adjacent National
Register Property(ies).
HCS will submit the report to OPRHP through their Cultural Resource Information System
(CRIS), NYS OPRHP is currently recommending that aLL reports for Cultural Resource Surveys
be submitted into their GIS based system (CRIS) by the consultant who compLeted the
survey. ALL involved agencies for the project must be identified in the project submission in
CRIS. The cost of this submission is included in this proposal.
Phase sB Archaeological Field Reconnaissance Survey
A review of the information available on the OPRHP CRIS system indicates that there are
precontact and historic sites Located within a one-mile radius of the project area.
In terms of testing strategy, HCS proposes to hand excavate a series of shovel tests situated
at 50-foot intervals across the level well drained areas of the proposed project corridor that
do not exhibit evidence of prior disturbance. It is expected that this wilt take 12-15 field days.
The determination of the areas to be tested is based on the sensitivity model developed by
the Office of Parks. Recreation and Historic Preservation (OPRHP).

Recovered cultural material (if any) will be taken to the Laboratory, where it wiLL be washed,
re-bagged according to New York State Museum protocol, identified, and recorded in a
standardized catalog. Analysis of the material in the laboratory wiLL provide dates for the
collection based on the typology of precontaet Lithic or ceramic materials and/or a general
assessment of the dates for any historic materials (including ceramics and glass).
The cost estimate for the processing of the artifacts is based on the recovery of no more
than So artifacts. If significantly more artifacts are recovered, there will be an additional
charge for Laboratory processing These expenses, should they arise, will be discussed with
the client before the work begins.
Production and Submission of Finat Phase xB Report
The final report will consist of the results of the field investigation, including a field
reconnaissance reap, the inventory of materials recovered from the site and a written
description of the work completed by the field team and photographic documentation. If
cutturat features are identified, additional drawings, catalogs or other maps may be
included.
It should be noted that if surface conditions exist within the proposed APE that prevent the
field team from accessing the areas needing testing (i.e. dense brush & vegetation), work
may be suspended or postponed until these areas can be cleared by the client prior to the
commencement of work. In addition, to comply with NYS OPRHP standards, the sails cannot
be frozen in excess of three inches below surface at the time of field investigations,
Phase soy Aquatic Resource DeLineation Report and Permitting Assessment and
Ecological Revie�c►
We will review appticabte local, state and federal mapping to identify the potentiaL Limits of
aquatic resources on the Project Site. We will review the New York State Department of
Environmentat Conservation (NYSDEC) on-Line resources to identify whether there are any
records of threatened or endangered species on the Site, submit a Letter to the NY Natural
Heritage Program to determine if there are any record occurrences, and review the United
States Fish and Wildlife Service (USFWS) Information for Planning and Consultation (IPaC)
website for federat species.
We will complete a walkover and delineate aquatic resources within the Study Area shown
on the Map in this proposal.
The purpose of this effort will be to determine if state or federal regulated aquatic resources.
including wetlands, are found on or in close proximity to the components of the proposed
Project Plan, and, if so, to delineate those resources. In addition , we will examine on-site
habitats and assess their potentiaL for supporting resident or transient populations of
endangered, threatened, or rare species. This will form the basis for identifying any additional
due diligence efforts.
DeLiverabLe: The end product will be a report describing the resources to support a
Preliminary Jurisdictional Determination (PJD) for submission to the NY District of the United
States Army Corps of Engineers (USACE), and a request for map validation by the Adirondack

Park Agency (APA), as needed. Along with the report, a cover letter will be prepared
summarizing the aquatic and ecological resources recorded or observed (including
endangered/threatened species), and likely permits that could be triggered by the project
given the presence of these aquatic and ecological resources.
FieLd Delineation; LaBeLta biologists will complete a delineation of aquatic resources within
the Study Area
The location of the wetland/upLand boundary will be identified according to the 1987 USACE
Wetland Delineation Manual and the North centraL/Northeast Regional 'Wetland Delineation
Supplement, which documents accepted delineation methods, and/or Regulatory Guidance
Letter 2005-05, which provides guidance for the identification of the Ordinary High Water
Mark (OHWM) for streams and water bodies. The OHWM for Lake George will be established
based on the set elevation for the Lake. Representative photographs of the uplands and
aquatic resources wilt be taken for documentation, and data will be collected to fill out
USACE wetland determination data forms. The centerlines or channel edges of aLL NYSDEC-
regulated streams will also be flagged in a similar way.
Aquatic Resource Delineation Report: LaBeLla will prepare an aquatic resource delineation
report and a PJD package, including a survey map of the wetland boundaries, for submission
to the USACE. If the wetlands are determined to be under state jurisdiction, mapping for
validation by the APA will be prepared. The USACE has two types of approvals available; a
PJD or an Approved Jurisdictional Determination (AJD), A PJD can be used for permitting, and
is quicker to obtain, but it does not provide a formal delineation by the Corps and cannot be
used if there are any isolated wetlands. An AJD can also be used for permitting, is a format,
legally binding delineation, is used to document isolated wetlands, but is more difficult to
obtain. At this time, we do not believe that isolated wetLands will be identified, and therefore
recommend the use of a PJD. The delineation report will foLLow the USACE NY District
Jurisdictional Determination Checklist. The delineation report (which includes the PJD
materials), will be provided to the Client for review and comment. The fee for this task
assumes one round of comments on the report. Once the report is finalized, one paper copy
and one digital copy of the report will be provided to the Client.
Assumptions and Limitations:
• Completing wetland delineations outside of the growing season (generally from May
to October) is at risk of not being accepted by applicable agencies. If a full Wetland
Delineation is performed outside of growing season per Client's request, and
regulatory agencies determine that fieLdwork was completed outside of growing
season, additional costs for a second site visit may be required to collect necessary
data,
This Scope of Services does not include review of any isolated wetlands, or
preparation of an AJD.

Phase 1o4; Geotechnical Services
LaBella will prepare and implement a program of test explorations to identify subsurface
information in support of the project design. Data relative to soil strata and depth to
groundwater and bedrock (where encountered) will be identified. Figure 1 included in this
document show the anticipated testing locations for both the sanitary sewer and water
improvements.
LaBeLLa will schedule and coordinate with our inhouse drilLers to perform a total of 27 test
explorations along the proposed sewer Line alignment. The explorations will, consist of the
following:
(1) Test borings to a depth of 30-feet at the planned pump station. The baring will be
advanced with standard sampling to the planned depth or auger refusal, whichever is
shallower.
U6) Macro-core probes to a depth of 10-foot along the existing roadways.
• (1o) test pit exploration to a depth of io-feet along the proposed utility routing on the
Kirkpatrick property within the wooded area. This work will be coordinated with Task
1.
For planning and budget estimating purposes we have allocated three (3) 8-hour field days
for the test exploration program. LaBeLLa witL monitor the test explorations and prepare
detailed logs that provide descriptions of the subsurface conditions encountered. Soils will
be visually classified in accordance with ASTM D2488.
After the field investigation, we will perform appropriate analyses outlined in a geatechnicaL
interpretive report. The interpretive report will include the following items;
Exploration Logs indicating soil conditions and water levels encountered during the
geotechnicaL investigation and a summary of subsurface geologic conditions as
interpreted from the explorations.
• A Location plan of subsurface explorations.
Recommendations for foundation support systems including bearing pressures,
bearing elevations, and seismic considerations.
Construction recommendations relative to the design of the tank concrete foundation
Comments on geotechnicat aspects of construction such as excavation, filling and
compaction, dewatering, and special requirements for protecting strength of
undisturbed soil.
Phase 200 SERIES SURVEY SERVICES
Phase 2oi Aerial and Conventional Topographic Survey
La Bella Will contract with BLuesky InternationaL (BLuesky) to perform new aerial flights utiLizing
an ULtracam & airborne GPS. Topographic mapping witL be at 1-foot contour intervals with
spot elevations within the study area as depicted on Figure 2 attached to this proposal.

LaBeLLa will provide the horizontal and vertical aerial control to Bluesky. Approximately
twetve (12) aerial control points will be required, The Horizontal datum will be based on New
York State Plane Coordinates (NAD83) and the vertical datum wiLL be based on NAVD 88 as
observed from GPS observations. A minimum of 2 permanent site benchmarks twill be
established.
Phase 2o2-- Boundary Surveys !Kirkpatrick Propert }
LaBeLLa will complete fuLL boundary surveys for parcel 240.E-1-18. Partial boundary surveys
will be produced for parceLs 227.17-2-25, 227.17-2-27 & 227.17-2-29 & 227.17-1-60 (see Figure
2 ). This work wilt be performed to support the subdivision and acquisition of Lands for the
planned subsurface disposal system.
ALL surveying will be completed in accordance with the "Code of Practice" as adopted by the
New York State Association of Professional Land Surveyors. The survey wilt demonstrate the
Location and description of property boundaries, site improvements, easements, and rights of
way of record.
LaBeLLa will complete research which is normal to the completion of surveys completed
under the above referenced code. We do; however, recommend that an abstract of title be
completed by a Local title company. This will assure that aLL recorded easements and rights
of way of record are discovered.
Phase 2og -- Two Lot Subdivision - parcet 240.S-1-18
LaBeLLa wiLL prepare a two. (2) lot subdivision plat and supporting Legal description for parcel
240.5--1-18 to be filed with Warren County.
Phase god - Access/Utility easements
It is anticipated that the force main will cross Lands of Kirkpatrick, that will not be acquired, it
wiLL be necessary therefore, to identify the utility routing and establish utility easements for
the planned facilities. LaBeLLa will prepare an access/utility easement, description, and
exhibit map for parceLs 227.17-2-25, 227.17-2-294 227A7-2-27 & 227.17-1-6o to be filed with
Warren County. It shall be the responsibility of the Town to negotiate these easements with
the current owner/owners of record.
Survey Detiverabtes - LaBeLLa wilt. prepare an access/utiLity easement, description, and
exhibit map for parcels 227.17-2-25. 227.17-2-29, 227.17-2-27 & 227.17-1-60 to be filed with
Warren County. LaBeLLa will prepare a two (2) Lot subdivision plat and supporting legal
description for parcel 240.E-1-18 to be filed with Warren County. The maps wiLL have a Border
with Title Block. Name of Surveyor, Map Notes and References, Legend and Site Location
Map. DeLiverables wilt be PDF copy of signed and sealed map and an AutoCAD Civil 3D file.

Phrase zoo Assumptions and Limitations:
o The client shall arrange for all necessary permissions to allow L.aBetta and their
employees to enter upon the lands of others as necessary to complete this
proposed project, and to save and hold harmless LaBeLla its agents, servants,
and employees from any claims for damages for trespass on the subject
premises and adjoining Lands.
o Zoning and planning board subdivision fees and 'Warren County Clerk's filing
fees are not incLuded.
o Easements are not included within Rockhurst Road,
Phase 2os- Septic Tank Location(s)
In conjunction with the aerial photography and mapping, LaBeLLa will perform field edits to
Locate the existing septic tank cover for each of the 52 parcels. LabeLLa will obtain an invert,
material and dimension of the pipe entering the septic tank where accessible. We believe this
work can be performed in Later stages of Preliminary Design (Phase 300) or deferred . We
have included the budget for planning purposes.
ALL other underground utilities will be shown to the extent possible based on surface evidence
and maps of record. LaBeLla will attempt to contact public utility owners and obtain existing
underground utility Locations within the public streets. This coordination will be facilitated
through the appropriate "One CatL" center requesting IN mark out", However, we are
increasingly finding that some utility companies will not perform mark out for design surveys.
Invert elevations will be determined based on measurements taken from the surface without
entering the structure. Utilities will be shown in accordance with Cl/ASCE 38-02, "Standard
Guidelines for the collection and depiction of existing subsurface utility data Quality Levels
"C" and "D".
We have provided in-house Subsurface Utility Designation (below) in this proposal under a to
identify the location of septic tanks, water Lines, or other utilities that are deemed necessary
and are not discovered in Phase 2oi or Phase 2o2
Prase 206 - Subsurface Utility Designating and Survey (Optionat)
For underground utilities that do not have surface features, mapping is not available, and the
Locations of underground utilities are critical. LaBeLla will perform electromagnetic utility
designation within accessible areas within the Project Study Area defined in introduction to
this proposal in an attempt to determine the existence and approximate position of
detectable subsurface utitities. All utility designation wiLL be in compliance with Quality Level
"B" as defined by Cl/ASCE 38-02, Standard Guidelines for the Collection and Depiction of
Existing Subsurface Utility Data. Any utilities not detected by surface geophysical methods
and discovered through record information or where visually aligned with structures, will be
defined as Quality Level "C" and "D".
Standard Procedures -- Designating: A LaBeLla SUE technician(s) will utilize a suite of utility
Locating instruments having differing frequencies and power settings to detect and follow

locatable utility systems within the project site. The instruments will have the ability to provide
passive signal detection, as well as active signal application by induction, direct connecting
and inductive clamping. The utility designations will be targeted for survey by painting the
approximate centerlines on the ground surfaces at reasonable distances. FLags may also be
installed as needed, Paint and flags will be in accordance with the American PubLic Works
Association (APWA) uniform color code guidelines where allowed,
as SERIES PRELIMINARY DESIGN & DISTRICT FORMATION
Task poi - Preliminary Design (3o%)
Our objective at this phase is to advance the project design, cost estimate and associated
information to support the preparation of a Map Plan and Report and engage the affected
property owners and public in advancing the establishment of the Rockhurst .Sewer District,
Information gathered during Phase a001200 Series work will support the development of
Preliminary Design and Costs Estimate.
We will pursue this work as it becomes apparent that the project will indeed be acceptable
from a cost feasibility standpoint and as the public is informed.
We will prepare a Letter report summarizing the information gathered during the field
investigations, survey, design alternatives, permitting requirements and project costs. This
will include the following efforts:
KSPE will perform a final evaluation of the most appropriate and cost effective
treatment technology for the project, given the significant site constraints and
seasonality of flows.
KSPE wiLL confirm anticipated SPDES permit effluent Limits and monitoring
Locations. We anticipate evaluating/revisiting the appropriateness of 3
treatment alternatives.
LaBeLLa will examine capacity requirements needed to convey
wastewater within both the low-pressure sewer and the forcemain,
• LaBeLLa wilt conduct an alternatives analysis to determine the best
forcemain route from the proposed pump station to the proposed
distribution box energy dissipator.
LaBeLLa wilt examine the required capacity and configuration of the pump
station.
• KSPE will conduct site visits to each parcel to better understand existing
conditions as it relates to the existing septic systems at each home,
existing landscaping and other site improvements at each home and to
aid in siting new facilities. We will develop a photo report for the district
that will depict improvements associated with each parcel.

• LaBeLla will present all findings within a written Letter report which will
discuss the results of the alternatives analysis. This document witi. be
provided to the Town and the design team and will form the basis of
future actions.
Under this Task, KS PE will advance the SSDS field and the selected treatment method to 30%
design so that the project cost estimate can be further refined. The following work under this
task is anticipated to include, but not be Limited to the following:
Advancing Preliminary Design of selected treatment alternative.
• Prepare outline of "Rules and Regulations" document for Sewer District. This
is not expected to be a complete draft, rather it is anticipated to include the
overall concepts regarding property owner and Town ownership and
maintenance responsibilities. This will also include discussion of system use
and discussion regarding necessary approvals for potential flow expansion
(i.e. home expansions), etc.
• Refinement of cost estimate at the conclusion of 30% Schematic Design.
Further refinement of necessary permits and approvals
Further refinement of the project schedule.
• LaBeLta will prepare preliminary design drawings of the wastewater
conveyance system. These drawings will include preliminary linework
alignment drawings and the pump station configuration drawings.
+ These preliminary design drawings will be reviewed with the Town prior to
finalization,
This proposal assumes that 3o% design documents will include the
development of plans only and not specifications.
Phase 302 - Draft Map Plan. and Report
Under this task, LaBella will prepare a Map, Plan , and Report for the chosen alternative. The
Map, Plan, and Report will be developed in accordance with State standards and will include
project description, project cost information and user cost information. To support district
establishment, the drawing set will be advanced to a 3o% Level. Public engagement activities
will occur early and informally in the process and be charged under Phase Soo.
aoo SERIES --PERMITTING
Phase Acts - Pre-ARpticatiion Meeting with US Army Corps of Engineers and Adirondack
Park Agency.
At the Client's direction, LaBeLLa will submit the DeLineation Report and JD request tetters to
the USAGE - New York District and Adirondack Park Agency within one (s) week of being
directed to submit. With this submittal LaBetla will also request a Pre-Application meeting
with the APA and USACE. This will require submittal of a pre-appLication package and
Jurisdictional Information Forms and Supplemental Information Forms to the APA. The
meeting can either be a single on-Site JD review meeting to review the delineation and the
project, or a single on-Line meeting to discuss the project. If both agencies request an on-site
JD meeting, LaBeLta wilt coordinate one meeting with both agencies in attendance. LaBeLLa
will review the project with the agencies and discuss permitting requirements for the project.
Phase aoa - Aquatic Resources Permitting
Once a design is developed that is ready to be advanced to permitting, LaBeLLa witL prepare
a joint wetland permit application for aquatic resource impacts associated with installing a
sewer below a wetLand using open trench construction methods. The Joint Permit Application
(JPA) will be for the following wetland permits:
Corps Nationwide Permit (NWP 58 for utility Line activities for water and other
substances)
NYSDEC Section 401 Water Quality Certificate
• NYSDEC Article 15 Permit for encroachments upon Bank of Lake George
• Adirondack Park Agency Article 24 Wetland Permit
The permit application will discuss background information, existing site conditions, the
proposed project, and compliance with federal, state, and local permitting standards. It will.
contain an alternatives analysis demonstrating that the project has avoided, minimized and
mitigated impacts to aquatic resources to the maximum extent practicable. It wilt provide
information on compliance with other associated federal Laws (cultural resources,
endangered species). The draft application will be provided to the Client for review and
comment. The fee for this task assumes one round of comments on the JPA. Once the
application is finalized, one paper copy and one digital copy of the report will be provided to
the Client.
Assumptions/Limitations
Under the Uniform Procedures Act, the NYSDEC cannot find a permit application
complete until the State Historic Preservation Office (SHPO) has issued a Determination
of Effect for cultural resources and until the Lead Agency under SEORA has either issued
a negative declaration for the project or accepted a Draft EIS for public comment and
review. Similarly, the USACE cannot issue a permit until the CulturaL Resource
Determination of No Effect is issued.

No mitigation will be required as all impacts are temporary.
Phase 4oi - Response to Regulatory Comments and Negotiations
LaBella staff wilt respond to reguLatory agency comments on the JPA, LaBella will coordinate,
prepare for, attend, participate, and represent the Client as necessary for required agency
negotiations concerning the project. This may atso include a site validation of the delineation
boundary if this was not accomplished under Task 203.
Phase 4o4 - SEQRA Process Support
Part I of FULL EAF; The Project is a Type I Action under 6NYCRR Part 617.4 and a Coordinated
Review is required. We will hold a meeting with the Client and involved agencies (noted
above) to determine the appropriate Lead Agency. Establishment of the SEQRA Lead Agency
will then be initiated by preparing and circulating a Full EAF and Letter of Intent to serve as
Lead Agency to the involved agencies. We have assumed that the Town Board vwiLL assume
the role of Lead Agency.
We envision preparing a FULL-EAF with an Expanded Project narrative. The Expanded Project
narrative will include supporting information and coordination documents prepared in
conjunction with the loo Series Field Investigations outLined below. A summary of the findings
of these Investigations will be prepared and included in the Expanded Project narrative.
Part 11/111 FuR EAF & SEQR Notices: Part II of the EAF is an evaluation of impacts. We will
prepare suggested responses to Part 11 of the EAF for review and approval by the Lead
Agency, Part ill of the EAF is an "Evaluation of the Magnitude and Importance of Impacts and
Determination of Significance." Part III is completed in the event that the evaluation
completed during Part 11, identifies one or more moderate or large impacts may occur. We
will prepare. Part III of the EAF if required and work to support a SEQRA Negative Declaration;
meaning an EIS is not required.
LaBella wiLL provide suggested Language (supporting the SEAR negative declaration) to the
Lead Agency for incorporation into the required resolutions documenting the Negative
Declaration. We will prepare the necessary notices (advertisement on the Environmental
Notice BuLLetin) and circulate the notices in satisfaction of SEQRA requirements.
Assumptions and Limitations:
■ A SEQRA Negative Declaration is anticipated, and an EIS will not be required.
Application or license fees (xxx) are not included.

Phase r2oi - Project Management Meetings, and Conferences
We wit[ coordinate, prepare for, attend, participate in and represent the Client at necessary
meetings and conferences relevant to the project. When deemed necessary, meeting
minutes/notes will be prepared and distributed to key team members for their records.
Under this task we will also prepare and maintain the project schedule and prepare power
point presentations to facilitate discussions.
These services will be billed on an hourly basis in accordance with our Schedule of Fees,
attached. This Phase will include but may not be Limited to the following:
■ Project management
■ Project Coordination/Team Meetings (internal & external)
■ Communications with Owner, Client and/or Client consultants
Miscellaneous meetings and conferences, including.
o Meeting with NYSDEC to discuss anticipated SPDES permit
effluent Limits and monitoring locations for the new community
system.
o Public engagement meetings with potential district parcels
owners.
Because of the dynamic and complex nature of the project, the exact number of meetings
cannot be quantified at this time. Should we begin to approach the estimated budget we will
notify you that the budget needs to be adjusted.
Phase Soa Grant Administration and Additional Funding Support
■ Assistance in catcutating potential user fees for the district based on recently awarded
grant funding, and updated cost estimate information.
■ Assistance in completing WQIP grant administration items (defining scope of work,
etc.), reimbursement requests, monitoring documents. project ctoseout etc.

LaBeLLa proposes to bill each task as indicated Table 1 Attached. Invoices vwitL be issued
monthly for all services performed during that month and are payable upon receipt.
As noted in the Project Understanding, this proposal includes a comprehensive scope of
services based on our understanding of the project and focused on advancing the project
through establishment of the "Rockhurst Sewer District". It does not include detailed design
or services associated with advancing the project through construction phase. Nor does it
include Legal services that may be required.
Upon presenting this scope and reviewing with Town representatives, the Town asked that
we phase services. The Town would Like to advance time (or seasonally) sensitive work
(Group A Tasks) and those services that are focused on the potential acquisition of Lands for
the subsurface disposal system,
The Fee Tabte (Table 1) that follows, identifies tasks as Group "A" are subject to immediate
authorization under this work order. Tasks Labeled as Group "B" , vwiR be deferred and will
require a separate written authorization. They are presented within this scope of work to
provide a complete project outlook.
