TOM HUTCHINS-Good evening Board, I am Tom Hutchins, Hutchins Engineering
Queensbury. This is a parcel on Fielding Lane.... the Young Family and the Young's parents
Family or actually it is Marybeth Young's ...Amanda Modale is their daughter who they had last
fall transferred their property to. Which brought property transfer inspection, which is part of the

reason we are here. The other reason we are here is they did not replace the wastewater system
and now they essentially have to as a result of the property transfer. We have developed a
nice replacement wastewater system for them and providing enhanced treatment pump station
adequately sized fields. Also, trying to meet one of their strong desires to be able to get some
access to the main building periodically once, twice, three times a year that they do that. Their
camps are operated four months a year, four and a half months a year depending on a good year.
What we have shown here is a Fuji Enhanced Treatment Unit, pump station and absorption bed.
It is a little bit of a unique shape as we got a little creative and tried to fit it in and maintain their
desire to accessibility on a forty-nine foot wide lot. There's no setback issues to the shoreline.
There is no water supply issues. All the enjoinments are Lake water supply. We saw it today. I
will turn it over to the Board for questions.
SUPERVISOR STROUGH-Okay, now we did a site visit this afternoon and got familiar with the
project. Are there any additional questions or thoughts from any of the Town Board Members
on this application?
COUNCILMAN FREER-Yeah, I would like to see the Engineer try to shrink the side L shape of
the absorption field in order to save that tree that is there on the property line. I also, think that
we should constrain this to have some kind of barrier so that they don't drive over or park cars
on this since it is not certified for to, to be in that case. I think Tom you are okay with the second
request and you can try convince them to if it makes sense to stretch out the longer part of the
absorption field.
MR. HUTCHINS-I am fine with a fence or other barrier over that suddenly and the bed
maintaining just enough space for them to get their vehicle past. In regards to the tree, they told
me from the beginning that the tree was going to go. I will discuss it with them and I do not
want..
COUNCILMAN FREER-Do your best that's all I request.
MR. HUTCHINS-I do not want to come in to this that we are absolutely going to save that tree
but I will discuss it with them and relay your concerns. Thank you.
COUNCILMAN FERONE-I understand your position Harrison but it has got to be difficult.
You do not know where those roots are going and they do not ever ... footage I mean twenty-
nine feet wide I mean.
COUNCILMAN FREER-I get it. That is why I said..
COUNCILMAN FERONE-One thing is to try and I do not know if that is going to be really
possible.
COUNCILMAN FREER-I am not going to stipulate my vote on that or put that. I do think we
do need to set,the other part of it is the fact that we're almost inviting people to park there. In
my experience with that lot it is not uncommon, two buildings to have seven cars, five cars there.
We really should block off the new absorption field with enough room for them to park couple
three cars on the side. There is parking on the southern part of the lot.
SUPERVISOR STROUGH-So, we are trying to, it is going to be a raised mound so there is an
indicator that perhaps people should not be driving on it.
MR. HUTCHINS-Well, it is a shallow system. It will be up a foot or so but it will be evident but
part of the variance we are requesting for is to allow a nice long taper so it does not look like a
raised mound.
COUNCILMAN FREER-Which will invite people who are not familiar to park their vehicle.
MR. HUTCHINS-We'll have a little rail fence there to preclude that.
COUNCILMAN MCNULTY-You also said that they do not rent, so it would just be family
members and who knew where the field is and such.

MR. HUTCHINS-I said I do not believe that they rent. I know them quite well and do not
believe so.
COUNCILMAN MCNULTY-That is a stipulation of that it cannot be rented until the work is
done. As we put into the other requests for extensions. I would like to see that but we already
talked about that. Counsel, in a normal property it has to be rented until ...
TOWN COUNSEL SCHACHNER-Already wrote it.
COUNCILMAN MCNULTY-The fence is even if it was something that can be put into the
ground and taken off when they drive in once or twice a year and put it in the ground. I do not
know if that would suffice for your guys.
COUNCILMAN FREER-I think you can leave the east lane that they want open but just do not
tempt people to park on the absorption field. The way these guys set up there will be enough
room for somebody to pull a vehicle and even park there if they want. Having that the part is
actually the absorption field .. I would say rock or a fence is I do not care what.
MR. HUTCHINS-We will say a fence or other barrier at the limit of the absorption field on the
property line.
COUNCILMAN FREER-Part of this is my mind saying the standard as well. If we just kind of
say we do not know who can park here. Next thing we know we are going to have people say
the last time you gave a variance.
COUNCILMAN FERONE-I think it is a benefit as well that they do not want to have a
premature failure if they keep running cars over it that field you would think over time ...
MR. HUTCHINS-It would tend to compact the soil, yes so it would shorten the life.
SUPERVISOR STROUGH-All right so, a placement of a rail fence or other barrier to prevent
traffic.
COUNCILMAN MCNULTY-I am sorry John, I thought that was a suggestion not put it into the
COUNCILMAN FREER-No, I think that he has already agreed to do.
COUNCILMAN MCNULTY-....it is in the Resolution. I do not know if the owners agreed to it
or not.
SUPERVISOR STROUGH-A split rail fence are easy to put up.

JOHN LAROCCA-I am a hundred percent for it. They have been great neighbors. I have been
there twenty years and I have never seen a car parked there. I mean they have parked cars on the
grass on the side of the house from what I know from being there for twenty years.
SUPERVISOR STROUGH-We did get an email from Chris Navisky, which I did not see until a
half an hour ago, it came into my office at 3:07 pm. We were out doing site visits. The water
keeper supports the use of an Enhanced Treatment Unit. All right, seeing no interest from the
public I will close the public hearing.

WHEREAS,Richard and Marybeth Young and Amanda Modale(Applicants)filed an application for
variances from provisions of the Town of Queensbury On-Site Sewage Disposal Ordinance Chapter 136 to
install a replacement wastewater system with the:
1. Absorption field fill to be located 1' from the east property line in lieu of the required 10'
setback;
2. Absorption field fill to be located 1' from the west property line in lieu of the required 10'
setback; and
3. Fuji Clean Enhanced Treatment Unit(ETU) and Pump Station to be located 5' from the east
property line in lieu of the required 10' setback;
on property located at 9 Fielding Lane in the Town of Queensbury, and
WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's official
newspaper and the Local Board of Health duly conducted a public hearing concerning the variance request on
Monday, April 3rd 2023, and

WHEREAS,the Town Clerk's Office has advised that it duly notified all property owners within 500
feet of the subject property, and

(OWTS)prior to the sale of certain real property and provides that a$2,000 escrow deposit will be forfeited
to the Town in the event that completion of a wastewater treatment system meeting all standards is not
completed within the time provided as established by Chapter 137, and
WHEREAS, a change of deed for the Applicants' property occurred on or about March 151h 2022
and when the required property transfer septic inspection took place, it was found that the existing
wastewater system was deficient; however, the proposed new system was not able to be completed within
the required six (6) month time period due to inclement weather, the challenges of scheduling contractors
and the need for septic variances, and
WHEREAS, the Applicant has therefore applied for a timeline extension or until October 13th,2023
to complete installation of the replacement wastewater system and extend the date on which the$2,000 escrow
deposit they previously deposited with the Town shall be automatically forfeited to the Town and the
Director of Building and Codes Enforcement has recommended Town Board approval of this requested
extension,
NOW, THEREFORE, BE IT
RESOLVED,that
1. due to the nature of the variances, the Local Board of Health determines that the variances
would not be materially detrimental to the purposes and objectives of this Ordinance or other
adjoining properties nor otherwise conflict with the purpose and objectives of any Town plan
or policy; and
2. the Local Board of Health finds that the granting of the variances is necessary for the
reasonable use of the land and are the minimum variances which would alleviate the specific
unnecessary hardship found by the Local Board of Health to affect the Applicants; and

Enforcement to take any and all actions necessary to effectuate the terms of this Resolution, and

SUPERVISOR STROUGH-Reviewed the application...
ERIC SANDBLOM-Eric Sandblom, from SRA Engineers, I am here with Ronnie Chase of J&D
Marina. Basically, they are doing some renovations to the building within the inside of the
building. In the process of attaining those building permits, the Town Building and Codes asked
for Engineer assessment of the existing septic system. We assessed the system and we identified
all of these deficiencies with the separation distances. In doing that with the existing system, it
was actually for the most part built in accordance with the approved design plan approved by the
Town of Queensbury back in 1998 with the exception of the location of the pump station. The
design was not compliant with those setbacks with the current install so it was determined that
we really needed to clean up the record here and get a septic variance in the books. One that can
be approved to document these existing deficiencies and allow a system to operate. One other
item that we had identified as you alluded to is that the design for the existing system is for 500
gallons per day. We confirmed that the 1998 design does in fact apply with this design
requirements in today's standards for a 500 gallon per day system for the size of the septic tank,
the size of the disposal field. And looking into the existing uses of the property in accordance
with the DEC Wastewater Guidelines for commercial operations. We calculated the flow rate
based on the number of slips and the wastewater pump out in where the employees if you follow
in the charts in the Code that system going by the tables would have a design flow of 2800
gallons per day. So that distance, there is a significant discrepancy between current operations
and now keep in mind the system has been in operation since for twenty-five years or so and has
shown no evidence of failure such as backup, surfacing, odors, stress vegetation any of that. We
have inspected it recently to confirm that is still the case. The Town Building and Codes has
inspected this system also and has determined that it is functioning properly. We did not think
that it was really appropriate to use the tables and the DEC rules allow for three different
methods of calculating flow rate. One of these is the tables, one of them measured wastewater
flows at existing or similar sites or washrooms and we do not have the data right now. So, what
we did is wrote a letter to Buildings and Codes and to Planning and Zoning recommending that
the owner install flow meters or determine a way to calculate the flow or measure the flow of
wastewater from the pump station to establish what the actual flow is and determine a design
flow based on that rather than the tables. Given that the system is functioning properly that who
it collects data over an entire season, a busy season and then address it at that point. If it turns
out that demonstrates that there actually is a wastewater flow of greater than 500 gallons per day
then the plan is to determine how to appropriately address that whether it's upsize the existing
septic tank and disposal field, Enhanced Treatment. There is a number of different options
including holding tanks, and the prospect of a future Municipal Wastewater Disposal System that
could be installed in this area.
SUPERVISOR STROUGH-For the purposes of establishing an average daily flow we are
looking at the season if you will where your activity which would be mid-June, June 151'to
September 15'h or something like that.
RONNIE CHASE-Correct me if I am wrong but I believe we are actually trying to figure out the
maximum daily flow.
COUNCILMAN FREER-Yes, it is not average it is maximum.
SUPERVISOR STROUGH-Oh, it is maximum.
MR. CHASE-If we do the averages it would not be very high because there is nobody around in
the middle of winter.
SUPERVISOR STROUGH-All right, so thank you for the correction.
MR. CHASE-I am trying to figure out the maximum daily and design around that which for us
that is July is probably the busiest time of the year maybe early August. So we are going to, if
we can capture the end June, July and beginning of August we are going to have our answer right
off.

the, we are doing the same thing at other sites around the Lake for establishing flow rate.

apply for an improved system to properly treat the actual flow amounts.
MR. HUTCHINS-If I could, if it matters what will probably happen is a timer will be installed
on the existing pumps to record the run time for the pump. We will determine the flow rate that
way we won't actually install a flow meter.

SUPERVISOR STROUGH-Reviewed the application the proposed application and two
variances requested.
COUNCILMAN MCNULTY-I have got some issues, something that needs to be discussed on
the walk through that the siting of this appears to be on the road. There is no mention of the
material to make sure that it is safe on the road. Also, it appears to be part of a joint use road and
I really would like to hear something from the neighbor agrees that he is okay with having to
drive over his neighbor's system. So, I would be glad to ask that we hold this until we get at
some more information from the owner or the agent.
COUNCILMAN FREER-My question would be are they migrating or are they going to display
their pipe over those rocks or are they somehow try to get them under the ground?
SUPERVISOR STROUGH-Well we do not have anybody to answer those questions. We had
nobody on site. So, it seems to be the will of the Town Board to not act on this tonight. I do not
think we need, do we need to do the public hearing again and put it on the April 171h meeting.
TOWN COUNSEL SCHACHNER-You opened it, right? You should open it. If you do not
open it then you would need to re-notice. If you open it and then you do not need then you do
not need to re-notice.

3:00pm and to this meeting. Sorry, I was not able to be there. To answer the question the
dispersal location is to be installed traffic rated actually the neighbor you are referring to has
exactly the same system. As he pulls in, as the neighbor pulls in to his house he is going to drive
across exactly the same system as he drives across his own. As you know, those sites are limited
in space so we took advantage of a traffic rated dispersal field.

MR. MURDOCK-It let me just see here. It is, if you look on figure 6 the upper left hand corner
the H-20 view loading detail. It is hard to believe but this piping system is traffic graded with
eighteen inches of cover. We have put this product under parking lots, shopping plazas, arenas
and all sort of places. In traffic rated installations.
SUPERVISOR STROUGH-All right, well the diagram, it says H-20 wheel loading detail on
figure number 6. You are putting a twelve inch minimum below pavement and then.
MR. MURDOCK-There is six inches of sand above the pipe and then there is a structural fabric
a road fabric that is stretched across the whole footprint of where the dispersal field is. That is
really how the system is made to be to handle the weight of a loaded tractor trailer. There is
twelve inches of sand, twelve inches of gravel over that.

able to be completed within the required six (6) month time period due to inclement weather, the
challenges of scheduling contractors and the need for septic variances, and
WHEREAS, by letter dated March 21, 2023, Ethan Peter Hall, on behalf of Charlie
Hoertkorn and Mike Delsignore of 268 Glen Lake LLC (Applicant), advised that due to delays in
obtaining the topographic property survey, weather conditions, needed engineering design work and
current project volume at the Town Planning and Zoning Department, Applicant is unable to arrange
for installation of a new Code compliant sewage disposal system on Applicant's property located

A LOCAL LAW TO AMEND CHAPTER 147 "STORMWATER
MANAGEMENT" OF QUEENSBURY TOWN CODE
BE IT ENACTED BY THE QUEENSBURY TOWNBOARD AS FOLLOWS.
Section 1. Intent; Authority—The Town Board seeks to amend the Town of Queensbury
stormwater management regulations in response to Lake George Park Commission regulations
changes that became effective on April 1, 2021. This Local Law is adopted in accordance with
the New York State Municipal Home Rule Law.
Section 2. Amendment of Stormwater Management Regulations —Chapter 147 of the
Queensbury Town Code, entitled "Stormwater Management" is hereby amended as follows:
A. Section 147-8, entitled "Stormwater pollution prevention plan requirement" is
amended in subsection (C) as follows:
C. Plan Certification: The SWPPP shall be prepared by a land3cape afehitec, eeftified
pfe f ssio al of pfe f ssio al efigi tee- qualified stormwater professional and must be signed by
the professional preparing the plan,who shall certify that the design of all stormwater management
practices meets the requirements of this chapter.

B. Section 147-11 entitled "Supplementary additional requirements for projects with
Lake George Park" is amended in subsection (B), (C), (D), (H) and (I) as follows:
B. Prohibitions
(1) No person or owner of real property shall create or maintain a condition which,
due to a human disturbance of land, vegetative cover or soil, may results in the erosion of
soil from the site or into any water body. The Stormwater Management Officer shall
notify a property owner of such condition on his property and shall afford a reasonable
time period to correct any such condition before a violation shall be deemed to exist.
(3) No person shall cause or create a condition of flooding, erosion, siltation or
ponding resulting from failure to maintain previously approved stormwater control
measures where such condition is injurious to the health, welfare or safety of individuals
residing in the park or injurious to any land within the park. The Stormwater Management
Officer shall notify a property owner of such condition on his/her property and prescribe
measures necessary to reestablish effective performance of the approved stormwater
control measures. The Town shall afford such property owner a reasonable time period in
which to correct any such condition before a violation is deemed to exist
C. Permit required.
(1) Except for the activities exempted in Subsection D of this section, no person shall
build, construct, erect, expand or enlarge any building or structure, or place, cause, or
construct any impervious surface such as pavement, blacktop, macadam, packed earth and
crushed stone without first receiving a stormwater management permit from the Town,
unless otherwise exempted herein.
(3) Except for the activities exempted in Subsection D of this section, no person shall
vq,etative eevef with soil of othef matefials when stieh aetivities involve an afea of!a
cause or create a land disturbance greater than or equal to 5,000 square feet without first
having received a stormwater management permit under this chapter.
D. Exemptions. The following activities are exempt from the requirements of this section:
(2) Development on a site involving land disturbance and land clearing of less than
5,000 square feet which does not result in the creation of new impervious surfaces of
more than 1,000 square feet.
(7) Maintenance of landscaped areas
(8) Residential firewood harvesting that is compliant with regulations at §179-6-050
Shoreline Regulations, §179-8-040 Shoreline buffers and NYS Forestry Best
Management Practices.

H. Variances.
(5) No variance shall be granted by the Town of Queensbury until first providing
notice to the Commission a minimum of 10 days in advance. The Commission shall be
deemed a party to the proceeding for all purposes with the right to initiate or intervene in
any action or proceeding in which the grant or denial of a variance is an issue or in any
proceeding involving an interpretation of the municipality's Plan or Program.
L Design requirements and performance standards.
(1) General requirements for major and minor projects. The following requirements
shall apply to major and minor projects:
(e) Development that involves structural components, such as retaining
walls or dams, may require design and certification by a licensed professional
engineer.
(2) Minor projects. The following additional requirements shall apply to minor
projects:
(c) Infiltration devices shall not be installed up gradient within 20 feet of the
subsurface treatment system of a wastewater treatment system. in filtf do &v I*-
installed within inn feet f any, tef well, wetland of tef L,ody.
(g) Stormwater control measures proposed to be installed at locations with a
slope greater than 15% before grading, soil percolation rate slower than 60
minutes per inch or which require placement of fill to meet heel vertical
distance separations specified in this chapter shall be designed by a licensee
rrefessional erig-ifteefafehiteet of exempt ifveyes qualified stormwater
professional.
(h) Infiltration devices shall be located a minimum of 35 feet from Lake
George and any downgradient drinking water supply or water body. Infiltration
devices for high traffic areas shall be located a minimum of 100 feet from Lake
George and any downgradient drinking water supply or water body. The
separation distance for infiltration devices servicing high traffic areas shall be a
minimum of 50 feet from upgradient water supplies. This design requirement
shall not prohibit the creation of up to 400 square feet of pervious hardscape
(i.e.porous pavers)for non-high traffic areas within 35 feet of Lake George
and any downgradient drinking water supply or water body.
(i) On a site where pre-development exists, an applicant shall be required to
undertake a stormwater retrofit project to control existing stormwater runoff
discharges from the site in accordance with the minor project standards of this

Subpart to the maximum extent practicable. Such measures shall include, at a
minimum, the infiltration of runoff from the first one-half inch of precipitation
from all pre-development impervious areas within the site. The phased
implementation of such controls for pre-development areas may be authorized.
A variance will not be required for infiltration devices treating pre-development
areas when conformance with the design standards for infiltration devices
cannot be met. If the minimum one-half inch volume requirement cited herein
cannot be met, the Town may delegate the authority to issue a variance from
this standard to staff.
(3) Major projects. The following additional requirements shall apply to major
projects:
(c) Supplemental design requirements for stormwater control measures.
[2] For storm events exceeding the ten-year design storm, the
stormwater control measures shall function to attenuate peak runoff flow
rates for a twenty-five-year-frequency storm to be equal to or less than pre-
development flow rates. For development greater than five acres
with State guidelines, stormwater control measures shall
function to attenuate peak runoff flow rates for a one-hundred-year storm to
be equal to or less than pre-development flow rates. Attenuation of the one-
hundred-year storm is intended to reduce the rate of runoff from
development to prevent expansion of the one-hundred-year floodplain so as
to alleviate flooding of improved properties and roadways. The minimum
requirement for peak flow attenuation can be waived for the one-hundred-
year storm event where it can be proven that downstream flooding is not a
concern, such as where excess stormwater runoff is discharged to Lake
George or to a regional stormwater facility designed to handle additional
volume and peak discharge. The cumulative effect of all proposed
development projects within the watershed should be considered in making
this determination. Rainfall intensity curves for Lake George, New York,
shall be used in the design of the stormwater control measures. These et1f es

des " Additionally, for development greater than five acres, coverage is
required under a state pollutant discharge elimination system (SPDES)
general stormwater permit administered by the Department of
Environmental Conservation.
[3] Infiltration devices shall be designed such that the bottom of the
system will be a minimum of two feet above the seasonal high groundwater
level and bedrock to be realized following development. Where compliance
with this requirement would prevent compliance with Subsection I(3)(c)[5]

below, compliance with this requirement may be waived. This provision
shall not apply to wet ponds and similar stormwater control measures which
are designed to be built in the saturated soil zone.
[4] Infiltration devices for major projects shall be located a minimum of
IN 35 feet from Lake George and any down-gradient drinking water supply
or water body. lake, fiver, preteeted-stfeam, waterwell, r r d wetland; a.
Infiltration devices for high traffic areas shall be located a minimum of
100 feet from Lake George and any downgradient drinking water supply
or water body. A separation of more than 100 feet may be required in cases
where contamination of the water supply is possible due to highly
permeable soils, shallow groundwater and similar situations. The separation
distance for infiltration devices servicing high traffic areas shall be a
minimum of 50 feet from up-gradient water supplies. Designs shall mitigate
adverse effects that groundwater recharge will have on adjacent wells,water
supplies, wastewater treatment systems, buildings, roadways, properties
and stormwater control measures. Stormwater recharge areas shall be
located a minimum of 100 feet from the subsurface treatment system of a
wastewater treatment system unless it is demonstrated that a lesser
separation will not adversely affect the functioning of such leach fields.
This design requirement shall not prohibit the creation of up to 400
square feet ofpervious hardscape(i.e.porous pavers)for non-high traffic
areas within 35 feet of Lake George and any downgradient drinking water
supply or water body.

[12] All stormwater control measures shall be designed to completely

[2-3] Pretreatment devices such as sediment traps, detention/stilling

pollution, including grease and oils, fertilizers, chemicals, road salt,
sediments, organic materials and settleable solids, which shall be sufficient
to remove pollutants from the runoff.
[34] Stormwater control measures shall, at a minimum, incorporate the
best available pollutant removal technology, which shall mean that which
constitutes appropriate and cost-effective means for removing pollutants
from runoff so that the resulting treated stormwater will not degrade the
water quality of any water body.
[45] Stormwater control measures shall be designed to preserve and
maintain the base flow in all streams passing through, adjoining or
receiving runoff from the site.

exists, an applicant shall be required to undertake a stormwater retrofit
project to control existing stormwater runoff discharges from the site in
accordance with the major project standards of this Subpart to the

maximum extent practicable. Such measures shall include, at a
minimum, the infiltration of runoff from the first one-half inch of
precipitation from all pre-development impervious areas within the site.
The phased implementation of such controls for pre-development areas
may be authorized. A variance will not be required for infiltration
devices treating pre-development areas when conformance with the
design standards for infiltration devices cannot be met. If the
minimum one-half inch volume requirement cited herein cannot be met,
the Town may delegate the authority to issue a variance from this
standard to staff.
C. Section 147-12 entitled "Inspections" is amended in subsection (B) as follows:
B. Stormwater management practice inspections. The Town Stormwater Management Officer
is responsible for conducting inspections of stormwater management practices (SMPs). All
applicants are required to submit as-built plans for any stormwater management practices located
on site after final construction is completed. The plan must show the final design specifications for
all stormwater management facilities and must be certified by a pfe f ssio al efigifteef. qualified
stormwater professional.
D. Section 147-14 entitled "Enforcement: penalties for offences" is amended in
subsection (D) as follows:
D. Penalties. In addition to or as an alternative to any other penalty provided herein or by law,
any person who violates the provisions of this chapter shall be guilty of a violation punishable by

regulation of the Commissioner of Agriculture and Markets.
HIGH TRAFFIC AREA -A road,parking area, or driveway used for motorized vehicular
travel, except those servicing four (4) or fewer residential lots or units.
IMPERVIOUS AREA OR COVER - These scir za-1. ments andsti detures-tit eairinet
,afive,: ays et `. An area covered by pavement, rooftops, and/or other structures or materials,
which is either impervious to water or which substantially prevents the infiltration of water into
the soil at that location.
LAND DISTURBANCE or LAND CLEARING-Grading, digging, cutting, scraping, excavating,
removing of soil,placement of fill,paving or otherwise covering, construction, substantial removal
of natural or human-placed vegetation, replacement of natural vegetation with lawn or other
human-placed vegetation, demolition or other removal of human-made features, or any activity
which bares soil or rock. For the purposes of calculating the square footage affected by any
development in order to determine a project's classification, all affected areas of the development
site shall be considered in aggregate, whether or not the affected areas are contiguous, however
the calculation shall not include areas used for (i) approved wastewater treatment systems, (ii)
stormwater retrofit projects, or(iii) infiltration devices for new development.Infiltration devices
located in areas that would otherwise be impacted by development activity shall be considered
in the calculation of land disturbance (e.g. porous pavement, infiltration chambers beneath a
parking lot).
LANDSCAPED AREA -An area of vegetation which has been actively maintained as a lawn,
garden, hedge,planting bed or rain garden.
LAWN-Any non-crop land area that is covered by any grass species. Lawn or non-agricultural
turf does not mean flower or vegetable gardens,pasture, hay land, trees, shrubs, turf grown on
turf farms, or any form of agricultural production.

QUALIFIED STORMWATER PROFESSIONAL - A person that is knowledgeable in the
principles and practices of stormwater management and treatment, such as a licensed
Professional Engineer, Registered Landscape Architect or other commission endorsed
individual(s). Individuals preparing stormwater design plans must have an understanding of
the principles of hydrology, water quality management practice design, water quantity control
design, and, in many cases, the principles of hydraulics.
RESIDENTIAL FIREWOOD HARVESTING- The removal and processing of trees to be used
as a heating fuel source, with such harvesting activity not to result in the removal of greater
than five(5)full cords of firewood during any calendar year; and further not to include the sale
or export of any firewood or wood products. Residential firewood harvesting shall not include
(a) the creation of a wood road, log landing, or skid trail, (b) stump removal, brush removal, or
grubbing, or (c) road construction, excavation, land clearing or land disturbance for
development.
SILVICULTURAL ACTIVITY — The management of any fefested tfaet of land to
. The practice
of controlling the establishment, composition, constitution, and growth of forests. Silvicultural
activities include: site preparation for forest regeneration; reforestation (including subsequent
cultural treatment); thinning;prescribed burning;pest and fire control; harvesting operations;
surface drainage; harvest related road/trail construction and maintenance; and nursery
operations. Tree removal in preparation for development or other conversion to a non forestry
use is not silviculture.
SOIL CONSERVATION PLAN - A document, which identifies best management practices
regarding erosion and sediment controls to be employed for a proposed agricultural or
silviculture activity. The plan shall include such forms) as may be provided by the Commission.
The plan shall include a scaled map of the project site depicting all waterbodies onsite and
within 35'of all areas to be disturbed, and all proposed land disturbances including proposed
stream crossings, agricultural fields, and areas proposed for silviculture including logging
roads and landings.
STORMWA TER RETROFIT PROJECT-An activity undertaken for the purpose of reducing
stormwater runoff volume, velocity, and/or pollutants generated from pre-development
conditions, and which is undertaken or approved by the Town of Queensbury or the county Soil
and Water Conservation District.
WETLAND—Any land that is regulated as a wetland by the Adirondack Park Agency, the New
York State Department of Environmental Conservation and/or the United States Army Corps of
Engineers.

Queensbury and its surrounding area's hotels and motels, restaurants, stores and other businesses,
thereby benefiting the general economy of the Town and all of Warren County, and
WHEREAS, by prior Resolution the Town Board provided for the Town's receipt of
occupancy tax revenues from Warren County in accordance with the Local Tourism Promotion and
Convention Development Agreement (Agreement) entered into between the Town and Warren
County, and
WHEREAS, the Agreement provides that specific expenditure of the funds provided under
the Agreement are subject to further Resolution of the Queensbury Town Board, and
WHEREAS, the Town Board wishes to provide $5,000 in funding to Sister Cities with
occupancy tax revenues received from Warren County as set forth in the proposed Agreement

WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and
award the bid to the lowest responsible bidder meeting New York State statutory requirements and
the requirements set forth in the Town's bid documents and specifications to be prepared by
Delaware,the Water Superintendent and/or Town Purchasing Agent, and so by Resolution No.: 459,
2022 the Town Board authorized an advertisement for bids and Delaware,the Water Superintendent
and/or Purchasing Agent prepared such bid documents and specifications, and

JASON MILLER-Jason Miller, Farr Lane, I am here tonight as a representative of the West
Glens Falls Emergency Squad. I wanted to give you an update on our call log through March
31" of this year. We had 988 calls. In the last three days, we had 29 calls. We are already over
1,000 calls already this year; anticipate 3,600 calls for the year. We do appreciate the funding
provided to us for our paid staffing. We have two crews from 7am-5pm, one crew from 5pm-
7am. We will negotiate our contract at the end of this year. We will be looking to expand our
coverage in the evening hours.
COUNCILMAN FERONE-How are we doing with recruitment? I know I have seen your signs
around.
MR. MILLER-Consistently, we are getting about three to four applications a month for
volunteers. We are always trying to grow our professional base staff as well as our volunteer
base.
SUPERVISOR STROUGH-Thank you for the update because it is an election year and there are
people out there that would like this information but are not appreciative of what it cost to have
EMS Services that do the job. I wanted to thank you Jason, you and your team over there at
West Glens Falls. You do a great job and if you look at the volume already 1,000 plus already
this year.
COUNCILMAN MCNULTY-John, I do have a question. Jason, I thought with the additional
funding that you would have two crews 24/7 at West.
MR. MILLER-No, there are two crews currently 24/7 in the Queensbury EMS which gets
consolidated the Bay Ridge and North Queensbury Districts together. We appreciate that and I
am not sure if we are going to ask for two crews 24/7. I anticipate asking to help cover through
those evening hours from 5pm to be a determined time at this point.
COUNCILMAN MCNULTY-Can you tell us a guesstimate in the evening hours how many
mutual aid calls, how many times you had a call for assistance? Is this a regular occurrence?
MR. MILLER-Yes, and at that point we rely on our counterparts in Queensbury EMS to assist
us. It still stays within the Town of Queensbury service. I do not have the number for you.
COUNCILMAN MCNULTY-It is staying within; we are not having to go outside of the Town?
MR. MILLER-No.
COUNCILMAN MCNULTY-That is what our intent was.
MR. MILLER-Daytime it is not uncommon for us to have to rely on, it is not common for us to
have to rely on Fort Edward, Moreau, Lake George to come down and assist us. If that is what
you are talking that if there is a fifth call in the Town of Queensbury or six calls in some cases
where we do not have the staffing we do not have the resources. I do not think that is anything.
COUNICLMAN MCNULTY-Nobody here has the numbers that worked a year ago at this time.
MR. MILLER-Were, I could refer the first quarter 988 almost a 1,000.
COUNCILMAN MCNULTY-But in terms of mutual aid.

MR. MILLER-Absolutely not, as a matter of fact we went to the City of Glens Falls today to
cover a call for them. That happens.
COUNCILMAN MCNULTY-I have one resident who came and said that your group and the
rest of your group saved his life. If that call had gone to Moreau or Fort Edward he would not
have. If it took him an extra twenty minutes for the ambulance to arrive he would be dead. This
is exactly what we expected and what we voted for to provide that response to Queensbury
residents.
MR. MILLER-For a Town this size, it is appropriate to have the staffing that we have at this
time.

7.0 TOWN BOARD DISCUSSIONS
COUNCILMAN MCNULTY- (WARD IIII)
• Spoke regarding the weeds being overgrown and the streets were not cleaned on Main
Street from Exit 18 to the Town Line. With the help of Supervisor Strough we have a
contract now to maintain it on a monthly basis.
• Spoke regarding our Comptroller has already sent some information to the Town staff
about increases in mandatory expenses for next year. He is hoping that the Town staff
cut unnecessary spending.
COUNCILMAN FERONE- (WARD III)
• Wanted to do a shout out to the Highway Department. That last snowstorm they came
around and helped pick up the trees that had fallen down.
• Happy Passover, Happy Easter and hope everybody stays safe.
COUNCILMAN FREER (WARD II)
• Applauded the Art Guide. This is to help people from downstate to bring up to enjoy our
art and artists. Spoke about Betty O'Brien's, who passed away art collection.
• Happy Easter, Happy Passover and everybody come back safe from spring break.
• Spoke about the community solar projects in the Town.
• Spoke regarding the LED street light replacements.
COUNCILMAN METIVIER (WARD I)
• Announced that there will be an update on the Jenkinsville Water Project on April 171h. I
apologize I will not be there. If you have any questions or concerns feel free to reach out
to me. This is not a public hearing.
• Mentioned the passing of Bobby Dick, he was an extraordinary person.
SUPERVISOR STROUGH
• Announced the Warren County Household Hazardous Waste Collection will be held on
Saturday, April 22nd from 8-12pm at the Warren County DPW, 4028 Main Street,
Warrensburg. Also, on Saturday, August 26 h from 8-12pm, at the Town Highway
Department. They will not accept gas, munitions, automotive oil, batteries, asbestos,
pharmaceuticals, infectious waste or tires.
