Dear Mr. Cornwall, Please consider this letter a request to vary the Sign Ordi- nance on the Town of Queensbury as it pertains to the setback re- quirements as indicated on pp. 12, para. A. We are proposing to install a double faced sign, size eight feet by five feet (forty square feet total) as indicated on our attached drawing No 83418-A. We are proposing to install this sign on the Upper Glen Street side of our property. The State of New York owns twenty two feet into our parking lot from the curb line. If we should install the pole sign with the fifteen foot setback as the ordinance directs, the pole sign would be installed at a measurement of thirty seven feet back from the curb line. Because no leading edge of the sign can overhang the setback line, and because the sign box measures eight feet wide, the pole supporting the sign structure would be set a total measure- ment of•rforty five feet back from the curb line. I am sure you can see what our problem is. Because the sign is set back so far, it becomes somewhat of an obstruction rather than what it is supposed to be; an advertising display to show customers where our place of business is. I have painted a white line on the pavement at the 22 foot location, the 37 foot location, and the 45 foot location so that you or any member of your Board can examine the property and real- ize our difficulty in complying -with the Sign Ordingnce setback provision. We respectfully request, because of the above reason, that of vehicular safety of automobiles as they arrive and leave our busi- ness, that the Queesnbury Zoning Board of Appeals grant our request and allow us to install our pole sign on the property line. At a meeting of the Warren Countv Planning Board, held on the 13th day of July the above application for a sign variance to locate a sign 22' from the curb on Route 9. was reviewed, and the following action was taken. Recommendation to: ( X ) Approve ( ) Disapproval ( ) Modify with Conditions ( ) Return Comment: The Warren County Planning Board concurs with The Queensbury Planning Board approval. It is the policy of the Warren County Planning Board to follow the proceddures of the New York State General Municipal Law, Section 239—M, with regard to Municipal Zoning actions that are referred to and reported thereon. The following are procedural requirements that must be adhered to: 1.) The Warren County Planning Board shall report its recommendations to the referring municipal agency, accompanied by a full statement for such actions. If no action is taken within thirty (30) days or agreed upon time, the municipal agency may act without such report. 2.) If the recommendation is for disapproval of the proposal, or modification thereof, the municipal agency shall not act contrary to such action except by a vote of a najority plus one of all the members thereof and after the adoption of a resolution fully setting forth the reasons for such contrary actions. 3.)
