MALE ASSOCIATES FOR PROFESSIONAL ENGINEERING SERVICES RELATED TO DESIGN, BID AND CONSTRUCTION ADMINISTRATION PHASES OF HIGHWAY STORAGE GARAGE REPAIR PROJECT RESOLUTION NO.: ,2023 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, by Resolution No.: 82,2016, the Queensbury Town Board authorized establishment of the Highway Garage Capital Project and Highway Garage Capital Project Fund 4208 and engagement of C.T. Male Associates (C.T. Male) to evaluate the feasibility of the construction of a new Town Highway Garage (Project) and by Resolution Nos: 336,2018 and 167,2019, the Town Board further authorized engagement of C.T. Male for services relating to the Preliminary Design and Design, Bid and Construction Administration Phases of the Project, and WHEREAS, the Town Board wishes to engage C.T. Male Associates for engineering services relating to the Design, Bid and Construction Administration Phase Services for the repair and replacement work associated with the recent vehicle impact damage to the Highway Garage Storage facility structure and overhead door elements for a sum not to exceed $39,000 as delineated in C.T. Male's letter dated June 23, 2023 and AIA G802 Amendment 02 Agreement, and WHEREAS, in Section IV, Subsection(3)(C)(2)(f) of the Town Purchasing Procedures, upon the Town Board considering the reasonableness of the fee, it may engage a particular professional which was previously used with the Project without soliciting multiple vendors, and WHEREAS, the Town Board wishes to accordingly engage the services of C.T. Male as C.T. Male has previously provided professional services related to the Project, C.T. Male's June 23, 2023 letter and AIA G802 Amendment 02 Agreement are consistent with its existing provision of services, and C.T. Male has the skill, expertise and an established familiarity with the Project which may help the Project proceed in a more expedient and efficient manner, NOW, THEREFORE, BE IT RESOLVED, that for the reasons outlined above and in these circumstances, the Queensbury Town Board hereby waives its requirement under the Town's Purchasing Policy for two (2) written quotes and authorizes and directs engagement of C.T. Male for professional engineering services related to the Design, Bid and Construction Administration Phase Services for the repair and replacement work associated with the recent damage to the Highway Garage Storage facility structure and overhead door elements for a sum not to exceed $39,000 as delineated in C.T. Male Associates' June 23, 2023 letter and AIA G802 Amendment 02 Agreement, and BE IT FURTHER, RESOLVED, that expenses for this project shall be paid for from Highway Garage Capital Project Fund 4208, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute the AIA G802 Amendment 02 Agreement substantially in the form presented at this meeting and/or any necessary documentation, and the Town Supervisor and/or Town Budget Officer to take all action necessary to effectuate the terms of this Resolution. T. Mule Associates Project No. 19.9249 Dear Mr. Rice, As requested, C.T. Male Associates Engineering, Surveying, Architecture, Landscape Architecture & Geology, D.P.C. (C.T Male Associates) conducted site visits on May 17 and May 23, 2023 to observe damage to the highway garage building near the south overhead door. It is our understanding that the building was recently struck above this door by a highway vehicle attempting to enter the building while the bed of the truck was in the upright position, it is also our understanding that the wall was pushed inward to a point where the door would not close, so the header was pulled outward so that the door would close, but the door does not operate properly at this time. The intent of our site visits was to observe and document the damage and to provide the Town recommendations for repairs or next steps. Our May 171h site visit was conducted prior to any selective removals, and during our visit guidance was given on what to remove/ reveal for our return evaluation. Our May 23M site visit was conducted after the interior liner was removed from the portion of the wall above and adjacent to the overhead door, and additional soffit panels were removed from the west end of the underside of the canopy. Observations made during our site visits are presented below. Most of the components of the canopy above the overhead door are damaged. This includes soffit panels, trim, light gauge framing, roof panels, etc. However, the structural steel beams that support the canopy, and which were visible, appear to be undamaged. • The metal siding on the wall above the overhead door is pushed inward and damaged. The end wall beam above the overhead door is pushed inward (does not appear to be bent). The horizontal wall girt above the overhead door is bent inward. The vertical door jambs and building columns closest to the overhead door do not appear to be damaged. + The rod that supports the tension springs above the overhead door is bent inward. + The hangers that support the motorized opener & center rail for the overhead door appear to be pushed inward. The top of the overhead door appears to be pushed inward. Adjacent utilities including sprinkler piping, electrical/ data wiring and water lines appear to be unaffected by the wall and door damage. + Adjacent insulation and vapor barrier materials while not damaged due to the I were removed as part of our evaluation, and likely additional will be removed during the repair/ replacement process. Regarding the process for contracting the repair/ replacement efforts, it is our opinion that, at a minimum, the damaged items listed above all need to be repaired or replaced with new elements. Based on what items were damaged, as well as the original construction type for the structure, it is our opinion that the original overhead door vendor and the original pre- engineered metal building (PEMB) manufacturer would likely be the most efficient resource for repair and replacement. The PEMB and to a lesser extent, the overhead door company, are recommended as the best option based on a number of factors and considerations: 1. Each element carries a warranty that if altered or modified by another entity, even a comparable or equal entity, you are likely to void the warranty of the entire element. C .T. With the overhead door, a similar inspection would need to occur in order to certify the original installation, the post repair condition, and final operating function of the door, track, opener and other accessory elements. 4. While not necessarily proprietary elements, both the PEMB and overhead door systems include profiles, components, colors and systems that would be difficult to match with a comparable or equal product. If the Town determines that, due to the extent of damage and potential repair cost, they are required to bid the work, there are likely significant cost increases that will be incurred. In addition to the fee for architectural/engineering design documents, bidding & CA services, the bid documents will have to be prepared in such a manner that it. a. Does not exclude other manufacturers and installers from bidding the work, b. Could require the potential for more elements to be removed and replaced that would not otherwise be required if the original manufacturers were involved, c.
