WHEREAS, the Town of Queensbury and the Queensbury Central Volunteer Fire Company,
Inc. (Fire Company) have entered into an Agreement for Fire Protection Services for 2021-2023
(Agreement), which Agreement sets forth a number of terms and conditions including a condition that
the Fire Company will not purchase or enter into any binding contract to purchase any piece of
apparatus, equipment, vehicles, real property, or make any improvements that would require the Fire
Company to acquire a loan or mortgage or use money placed in a "vehicles fund" without prior
approval of the Queensbury Town Board, and
WHEREAS, by Resolution No.: 417, 2021, the Town Board approved of the Fire Company's
purchase of a 2022 KME Engine 1000 gallon capacity Truck with a Cummins L9 engine (Truck) for
an amount not to exceed$739,950,with payments to be from the Fire Company's vehicles fund, and
WHEREAS, the Fire Company has advised that due a recent increase in demand for Cummins
L9 engines, Cummins oversold its build slots and has placed all fire truck manufacturers on an
allocation for L9 engines resulting in a backlog, and
WHEREAS, the Fire Company has therefore requested Town Board approval of the Fire
Company's conversion of the Truck's Cummons L9 engine to an X12 motor for an additional amount
of$56,000 to mitigate the impacts caused by production delays and keep the Truck on schedule for
completion,resulting in an amended total Truck purchase amount not to exceed$795,950, and
WHEREAS, the Fire Company still plans on making payments for the Truck by using funds
from its vehicles fund account, such monies included in the Fire Company's approved budget and
Agreement, and
WHEREAS, the Town Board feels that this Truck with the upgraded X12 motor will provide
additional safety protection for the Town and therefore the Town Board wishes to authorize the
amended Truck purchase amount,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves of the Queensbury Central
Volunteer Fire Company, Inc.'s purchase of a 2022 KME Engine 1000 gallon capacity Truck, with an
X12 motor, for an amount not to exceed $795,950, with payments to be from the Fire Company's
vehicles fund, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to
take any and all action necessary to effectuate the terms of this Resolution.
