Supervisor Walter- Asked Mr. Chase, Town Clerk for the proof of publication and
posting of the Public Hearing. .

Mr. Chase Town Clerk-
presented the proof of publication and posting of the
Public Hearing re: the proposed Broadacres 'Water Dist.
Supervisor Walter- On January 26, 1982 we held a public information meeting
regarding the proposed Broadacres Water Dist.-at that time Mr. Scudder our
consulting engineer on the project made a presentation. Since that time
Mr. Scudder, Mr. Flaherty, Residents of the area and myseZf have sat down and
talked some morei;,. . .it is the strong feeling of the Town Board to present to you
a water district that is not a maintenance district but a full service water district
- for #hat area. This would supply Fire,Protection, adequate water supply and
maintenance. . .spoke of the history of the water pipes in the area. . .
Mr. Scudder-Engineer-using maps of the area depicting the proposed and existing
water mains and Zines spoke to the residents on the proposed water dishict. . .
noted that the residents now receive water from the City of Glens Falls. . .
_we propose to approve this system, estabZish a water district within the Town
of Queensbury and furnish drinking water and fire protection. . .the minimum pipe
size in the system would be six inch, we would propose:: 24 new hydrants in the
area. . .many Zines are unknown as to size. . .the work on this project will be done
by Water Dept. Employees at a cost of $496,210.00 est. this will be paid for
by Bonds over a 15 year period. The Total assessment in the Water Dist. is
Five Million seven hundred eightyone thousand seven hundred dollars assuming an
interest rate of 10% the tax rate for the first year would ba $14.41 per thousand
decreasing over fifteen years to $6.34. If this was passed and the ZegaZ matters
were taken care of,� it probably would not be until next year before construction
would be started. . .noted that in regard to water rents a typical resident in
Queensbury uses $80 to 85. 00 dollars per year worth of water. . .
Mr. FZahertg-Water Supt.- In the past we have been called upon to provide service
in the area when there were problems with •the water mains, with the raising cost
of equipment and material plus the, fact that the State of New York Audit and
Control says that it is illegal to for us to expend money generated from within
the water district outside the water district, we can no Zonger provide the service.
- Councilman Olson-noted that any tax monies generated in regard to this district
can only be used in this district. . .questioned if the streets are tore up who
will pay for their repair?
Mr. Scudder-that is figured into. the estimate. Those residents who are not
hooked into the City System would have to bear a connection charge. . .if they
are hooked up now there will be no-.,, charge at the time of connection to the
Queensbury System. . .
John Janbon-33 Broadacres Rd. - where would the hookup occur for a private residence?

est. cost of the pipe and hydrants and what amount is in the contingsngy fund. . .
Mr. Scuddeb- presented Mr. South with a break down of cost on the pipe. . .
est. 2540 lineal feet of 12" pipe 420 lineal feet of 8" pipe
10200 of 611 pipe 24 new hydrants. . .contingency fund 5% of total
( Mr. C. Powell South- what control will the Town have over the water dept.with
cost accounting. . .
Supervisor WaZter-invited Mr. South to review the cost accounting system
r used by the water dept. noted that much of the work is placed on a computer
noted that the last job that came in was under budget. . . (Sherman Ave. )
Mr. Harrison-Linden Ave.- if the job will not be done until next year do the
figures reflect this?
Mr. Scudder- as well as we can project. . .
Mr. FZaherty-The majority of the material will be bid this year. . .
Mr. Corton-Parkview, Ave.- what indication do you have that :the unknown owner
mains are workable? Questioned if the reason that a m4iA was being placed
down Dixon Road was because it was possibly unraxZiable?
Mr. Scudder- the reason we are placing a line on Dixon Road is to seperate
the two systems—in regard to the condition of the existing system we have
no reason to believe that they are not in good condition. . .
Mr. Flaherty- noted that in reviewing past records from other breaks in the
area have shown in various Locations the existing condition of the pipes. . .
Mrs. Radin-4)rucce Court-noted that they had a private line to the City main. . .
how would this effect them?
Mr. Scudder- you would have a 6" main in front of yozr house and your line
would run from your house to the 6" main.. .
Mrs. Radin- we would have to have Queensbury Water if we hooked up?
Mr. Scudder- .yes reviewed the water rents paid by people hooked up to City
water but who do not .live in the City. . .
Mrs. Radin .- questioned if the water would be restrictive as to the use of her weZZ?
Mr. Scudder- no
Mrs. Radin- why should I go on metered water?
Supervisor Walter- becIduse you pay less than on flat rate. . .if you are an average user. . .
Mr. Thomas Flaherty- please note that any private line Za�d'. in the street is the
Owners responsibility. . .
Mr. Lemery- Chief of Queensbury CentraZ-we feel that we provide adequate fire
protection, I am concerned over the six hydrants in the district in that they
are not maintained. Concerned if a large fire was to hit this area if the
lines could stand the shut down, they are very old and have not been maintained. . .
Supervisor Walter- We are very proud of Queensbury Central and we do know that
there is adequate fire protection. . . pp
Mr. Wertime- 21 Liredo a - who laid the lines? who paid for them?

Supervisor Walter- There were several people. . .Mr. Hay, Mr. ProZler. . .
Mr. Swan- In Northup Dr. the water system was financed by Mr. Delong, his wife and son
a prorated cost was made for every block on the Street, when people hooked up to the
main they paid the prorated amount.
Mr. Wertime- questioned- if the people will not be paying twice for the same system?
Supervisor Walter- I will see where I can .get information regarding that, I have gone
to Albany and I am awaiting an answer. . .

Supervisor Walter- It is my understanding that at one time there was a Broadacres
Association and they were to maintain the water system. . .somewhere along the
j line this concept was lost. . .
ij Mr. Strycker-26 Broadacres Road-questioned that if a resident had a well would
1 they have to be hooked up to the Broadacres Water Dist. ?
Supervisor Walter- you would pay the advaZorem tax but not the user fee. . .you
do not have to hook up. . .
Unknown- what is to prevent the work from starting this year if approved. . .
l Supervisor Walter- because we created another water dist. last fall we will be
j completing the Land o'Pines Water Dist. and there are severa L other projects tAht
are capital improvements that have been promised, for completion this year. . .
Dur engineer has come up at the request of the Board to give what he feels would
be the top dollar so that it can come in under that, not over it. . .we are saying next
1 year but if there is any way possible to start it sooker ,we wouZd do that. . .
Unknown- When the Dist. is formed will the Town then have responsibility for the
existing system until the new one is built?
Mr. Joseph Brennan-Reviewed the steps that must be taken to approve the district. . .
at least four to six weeks
j Supervisor Walter- Then in two months if there was a break in the water main the
water dept. would have to do something about it. . .
Mrs Radin- If this is passed by referendum
�how binding is that on the part of the Town?

Mrs. Radin- questioned the establishment of a lighting and sewer dist. . . .paying taxes
on items that they do not have. . .
Supervisor Walter- It used to be a practice of-many Boards to draw a district that
was 'Zarger then what would be served, I personalty think that is the pits and this
Board is in agreement Oith that—any districts that we create, ' ," the people who
are in those dist. will be serviced. . .
Mrs. Radin- requested that someone Zook°into the lighting and sewer disc. . .
Unknown- Could the State Act on this because it is iZZegaZ?
Supervisor Walter- If there is no district and you have a gain and you want maintenance
of the dist. the town cannot do it without the establishment of a district. . .
Mr. Joseph Brennan- What was being referrdd to, was the statement at the last meeting
that it would be illegal for the Town to use dater Dept. personnel to repair
mains outside its district. . .
Mrs. KingsZey-9 Hughes Court- We are now receiving G.F. Water if this is passed we will
then be receiving Queensbury Water?

I Unknown— Asked if there was inequality, those who already have mains will pay
the $14.00 and those who will be hooking up for the first time will pay $14.00
Supervisor WaZter-As far as adjusting the costs giving a credit to those people
who have a 6" main I do not have the answer to that. . .
Mr. Scudder- spoke on the number of non-standard hydrants that will be replaced,
there are no parts for repairs available. . .
Councilman Robertson- There is no better time then now to resolve the district once
and for all, I urge you to take the proposition that is before you, the.only reasonable
way to do this is with a full service district. . .

Councilman MorreZZ-If the pipe has been paid for by the property--)owner on the street
that is in the Town Right of Wayjdo they still own the pipe, if they do, AvwZ*�t y
be compensated for the pipe that we use. . . ?

Mr. Scudder- I think that should be referred to the Town Attorney.

Councilman Morrell If we pass these three resolutions, do the people in the
,proposed district have any option to go to permissive referendum. . . ?
Supervisor Walter- yes. . . If the referendum failed then the Town Board would have
no obligation to the people, that is the point that we are trying to make, in no
way is the Queensbury Water Dist. going to send people in to Broadaeres, we have
done so in the past, Audit and Control says you cannot do it, it is illegal to
do so and we have had other people from Queensbury Water Dist. and other Dist.
in the Town say if you are using my tax money to go to an area that is not
a disc. I will sue you.
Councilman Olson- asked what the filing time was for a referendum was?
Mr. -Joseph Brennan- reviewed the time schedule for adoption of the Water Dist.. '
The time for filing a petition for a referendum is 30 days from the adoption
of a Resolution forming a disc. . .
Mr. Swan- If this proposal goes to a referendum and is defeated�wouZd this
Board feel any obligation to continue to work on this and present another
solution?
Councilman Olson- I beZeive that this is the best way to go, I as one person would
say that if this was defeated-I think the Board wanting to serve the needs of the
people would be obligated to sit down formally and get together a maintenance dirt.
Supervisor Walter- I think that this is something the Board will have to discuss
because I do not agree with A4r. Olson. . . (,
Mr. Swan- I am one of the owners who paid for the pipe and L want to say I
here and now that I think I got' my money out of that system, I think that for
the benefit of everyone we had better get together and put this thing in. . .
Mr. Joseph Brennan- The question has arisen regarding the pipes in the streets
which were built into the cost of the homeowners, in order to answer that question
you really have to know exactly what the circumstances were relative to the
streets. . .I assume that at some point the developer of the streets requested
that the Town, -i^ accept those roadways as Town highways, the lines are in the
streets in my opinion the issue would be whether or not when the owner of the
street itself was laid out requested the Town to accept those streets as public
streets and the Board accepted them-since he was conveying the land and the water
line is under the land which was being conveyed whether at the same time therefore
those lines were actually conveyed by that action of the owner to the Town of
Queensbury. The question would be reaZZy� whether or not by virtue-of that actj
the Town would actually own the water lines that run down.,Ap't w Northup and
Bullard or whether or not there would be basil for the property owners upon
the dedi(ution of those streets to still claim ownership, I do not know the answer
to the question. . .
Unknown- If it was conveyed to the Town, does it also convey maintnanee of that line? '
Mr. Joseph Brennan- no it cannot be done without a district. . .
Mrs. Radin- who will pay for the repairing of the Blacktop when the new lines are

Supervisor Walter- there : monies in the scope of the project to cover that. . .
-Councilman Betty Monahan- what is the age of the pipe that is presently in the
ground, from the oldest to the newest. . .
Mr. Scudder-. we think it is before WWII. . .
Councilman Betty Monahan- What is the life expectancy of the new pipe?
Mr. Flaherty - 100 years. . .
Councilman Betty Monahan- I heard one thing in regard to asbestos cement pipes,
is there a health hazard with these pipes.. . ?
Mr. Scudder- no. . .
Mr. Flaherty- There has been studies done by the American Water Works Assoc. and
to this date everything is pointing to the fact that there is no danger. . .
the have aspestos pipe that was put in by developers that are in the district. . .

Mrs. Monthie- Is there -.)any chance that we can get a grant from the State?
Supervisor Walter- we have looked into that and no. . .noted that this mould
not be considered a depressed area. . .no monies available. . .
Mr: Scudder- this is not a guilt edged plan, it is a standard layout using
standard practices. . .
Supervisor Walter- The Town Board has responded to many requests over the years
over the Broadacres situation, we feel that we have given you the best solution
to a complex problem-it-is now up to you to determine whether you will go along
with the.-thinking of the Town Board. . . Public Hearing Closed

WHEREAS, the establishment of the proposed water district and the construction of

WHEREAS, the Town Board of the Town of Queensbury, Warren County, New York has

WHEREAS, an order was drily adopted by said Town Board on March 4, 1982 reciting

subdivision 3 of Section 209-e of the Town Law, approving the establishment
of said district and the construction of the improvements proposed therefor;

RESOLVED, by the Town Board of the Town of Queensbury, Warren County, New
York, as follows:
Section 1. The establishment of a water district in the Town of Aueensbury,
Warren County, New York to be known as the Broadacres Water District, to
be bounded and described as hereinafter set forth, and the construction of a
-`f mater system to serve said district, including the acquisition of land or
rights in land, and original furnishings, equipment, machinery or apparatus
necessary in connection therewith at a maximum estimated"cost of Four Hundred
Ninety-Six Thousand Two Hundred Ten ($496,210.00) Dollars is hereby approved
and authorized. The method of financing .the cost of said improvement shaZZ
be by the issuance of not more than Four Hundred Ninety-Six Thousand Two Hundred:'
i Ten ($496,210.00) Dollars in serial b@Wlks-of said Town, maturing in annual
installments over a period not exceeding fifteen (15) years, payable in the first
instance form a levy on the taxable real property in said water district which
the Town Board of said Town shaZZ determine and specify to be especially benefited
thereby in the manner prescribed by Subdivision 2 of Section 202 of the Town Law.
Section 2. Said water district shaZZ be bounded and described as is set forth
in Schedule "A" annexed hereto and made a part hereof.
Section 3. Within ten (10) days after the date that the adoption of this resolution
i becomes effective, the Town Clerk of said Town is hereby directed to file a certified
copy of this resolution, in duplicate, in the Office of the State Department of Audit
and Control, in Albany, New York, together with an application, in duplicate, for
permission to establish the aforesaid water district, in the manner required by the
j provisions of Subdivision 3 of Section 209-f of the Town Law.
f Section 4. This resolion is subject to a permissive referendum as provided by
Section 209-e of the Town Law.

i Adirondack Water Works Conference in Troy, N.Y. on Thursday March 25,
1982 and be it further
RESOLVED, that the Town Board authorizes payment of all reasonable €
and necessary expenses.
