SANITARY SEWAGE DISPOSAL VARIANCE

WHEREAS, Sean Chant (Applicant) filed an application for a variance from Town of
Queensbury On-Site Sewage Disposal Ordinance, Chapter 136, §136-11 which requires applicants to
obtain a variance for a holding tank system as the Applicant wishes to replace a failed onsite septic
system with a holding tank system consisting of two (2) holding tanks, one (1) with a 1,500 gallon
capacity and one (1) with a 2,000 gallon capacity, for the total required capacity of 3,500 gallons on
property located at 22 North Lane in the Town of Queensbury, and
WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's
official newspaper and the Local Board of Health duly conducted a public hearing concerning the
variance request on Monday, October 16t', 2023, and
WHEREAS, the Town Clerk's Office has advised that it duly notified all property owners
within 500 feet of the subject property,
NOW, THEREFORE, BE IT
RESOLVED,that
1. due to the nature of the variance, the Local Board of Health determines that the
variance would not be materially detrimental to the purposes and objectives of this
Ordinance or other adjoining properties nor otherwise conflict with the purpose and
objectives of any Town plan or policy; and
2. the Local Board of Health finds that the granting of the variance is necessary for the
reasonable use of the land and is the minimum variance which would alleviate the
specific unnecessary hardship found by the Local Board of Health to affect the
Applicant; and
BE IT FURTHER,
RESOLVED, that the Local Board of Health hereby approves the application of the Sean
Chant for a variance from the Sewage Disposal Ordinance to allow installation of a holding tank
system consisting of two (2) holding tanks, one (1) with a 1,500 gallon capacity and one (1) with a
2,000 gallon capacity, for the total required capacity of 3,500 gallons on property located at 22 North
Lane in the Town of Queensbury and bearing Tax Map No: 226.19-1-60, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Clerk to forward by
certified mail a certified copy of this Resolution to the Adirondack Park Agency for its review, and
BE IT FURTHER,
RESOLVED, that this approval Resolution shall not be effective until 30 days after such notice
to the Adirondack Park Agency and shall be subject to review by the Adirondack Park Agency during
such period.

GENERAL NOTES
1. HOLDING TANKS TO BE FULLY WATERPROOF AND WATER TIGHT.
2. ALARM PANEL POWER SUPPLY TO BE RUN FROM CIRCUIT BREAKER
PANEL IN BUILDING. EXTERIOR RUNS TO BE IN CONDUIT. PROVIDE CIRCUIT
BREAKER SIZE AS RECOMMENDED BY MANUFACTURER.
3. CONTRACTOR IS TO INSPECT THE EXISTING PANELBOARD. IF THE PANEL
IS NOT GROUNDED PROVIDE 2-5/8"x8' GROUND RODS. CONNECT TO
EXISTING WATER SERVICE IF ANY OTHER ISSUES ARISE CONTACT ENGINEER
PRIOR TO PERFORMING ANY FURTHER WORK.
4. ALL OPENINGS THROUGH THE CONCRETE TANKS ARE TO BE PROVIDED
WITH LINK SEALS OR AN EQUAL PRODUCT TO PREVENT LEAKAGE INTO THE
STORAGE TANKS.
5. ALL WORK TO CONFORM TO THE NATIONAL ELECTRIC CODE AND THE
BUILDING CODE OF NYS.
6. ELECTRICAL WORK TO BE INSPECTED BY THE NYS BOARD OF FIRE
UNDERWRITERS OR AN EQUIVALENT ORGANIZATION.
7. ALARM PANEL AND SCREENED VENT MAY BE INSTALLED ON THE
BUILDING EXTERIOR IF DESIRED BY THE OWNER.
8. THE ATMOSPHERE IN THE HOLDING TANKS IS CONSIDERED TO BE A
CLASS 1, GROUP D. DIVISION 1 RATED SPACE UNDER THE NATIONAL
ELECTRIC CODE. THE CONTRACTOR SHALL PROVIDE THAT ALL WORK
CONFORMS TO THE APPROPRIATE DETAILS FOR THIS CONSTRUCTION. THIS
INCLUDES INSTALLING SEAL OFF FITTINGS ON ANY ELECTRICAL LINE THAT
RUNS BETWEEN THE ALARM PANEL AND/OR OTHER ELECTRICAL PANELS.
FILLING WITH THE APPROPRIATE SEALANT TO PREVENT GASSES FROM
ENTERING THE ELECTRICAL PANELS. THEY ARE TO BE INSTALLED NO
CLOSER THAN 1W FROM THE ELECTRICAL PANELS.
9. DO NOT INSTALL JUNCTION BOXES OR SPLICE WIRE INSIDE THE HOLDING
TANKS.
10. A SOLENOID VALVE IS TO BE INSTALLED IN THE WATER SERVICE LINE
TO THE HOME WHICH WILL BE NORMALLY OPEN. THE VALVE IS TO BE
ENERGIZED BY THE TANK SHUTOFF LEVEL ALARM SWITCH. WHEN THE
SWITCH IS REACHED THE SOLENOID VALVE SHALL BE CLOSED THEREBY
CUTTING OFF THE WATER SUPPLY TO THE HOME. SOLENOID VALVE TO BE
ASCO RED HAT MODEL 8221 OR EQUAL SIZE PER PIPE SIZE OF INCOMING
WATER SERVICE.
11. THE CONTRACTOR TO TEST THE ALARM PANEL TO DETERMINE PROPER
FLOAT SETTING LEVELS. IN ADDITION ALARM SYSTEMS ARE TO BE TESTED.
ENGINEER TO WITNESS ALL TESTING.
VARIANCE REQUEST:
WE ARE REQUESTING A VARIANCE TO REPLACE THE
EXISTING ONSITE SEPTIC SYSTEM WITH A HOLDING TANK
SYSTEM. NO VARIANCES ARE REQUESTED AFFECTING
NEIGHBOR'S PROPERTY OR WELLS.
THE PROPOSED SYSTEM MEETS ALL OF THE TOWN'S
REQUIREMENTS FOR A HOLDING TANK SYSTEM
INCLUDING THE ALARM LEVEL CONTROL SYSTEM AS
WELL AS THE WATER SERVICE SHUTDOWN CIRCUITRY.

IT IS IMPERATIVE THAT THE OWNER PROVIDE QUALITY MAINTENANCE FOR
THIS SYSTEM. SEND AS LITTLE GREASE AS POSSIBLE TO HOUSE DRAINS.
MONITOR HOLDING TANK LEVELS AND PUMP TANK SHORTLY AFTER THE
TANK HIGH LEVEL ALARM IS ENERGIZED. ENSURE THAT ALL FIXTURES IN
THE HOME ARE LOW FLOW AND THAT EVERYONE THAT RESIDES THERE IS
AWARE OF THE LIMITED CAPACITY OF THE HOLDING TANK SYSYTEM. AFTER
A FEW MONTHS OF OPERRATION OF THE SYSTEM YOU SHOULD BECOME
AWARE OF HOW WATER USE IMPACTS THE CAPACITY OF THE SYSTEM AND
HOW LONG IT TAKES TO FILL THE SYSTEM AT A POINT THAT IT TRIPS THE
ALARM.
HAVE A SEPTIC PUMPING CONTRACTOR ON CALL AT ALL TIMES SO THAT HE
CAN COME AND PROVIDE A PUMP OUT IN SHORT ORDER. HAVE THE PHONE
NUMBER POSTED IN PLAIN SITE ALSO HAVE THE NUMBERS OF A FEW
ALTERNATE COMPANIES THAT WOULD BE AVAILABLE IF THE MAIN
CONTRACTOR IS UNAVAILABLE WHEN NEEDED.
