The applicant has submitted an application to the Planning Board: (Revised 1118,120.12) Applicant proposes
construction of a new home with 3.210 sq. ft. floor area and 2.160 sq. ft. footprint. The home is two story
with an attached garage. The project includes a covered walkway from the home to the proposed adjoining
home and installation of permeable paver for patio and driveway areas. Site work includes stornwater
management with a rain garden, new site plantings. new septic, and new line for drinking water. Project
includes a lot line adjustment but no change to lot. size. Pursuant to chapter I79___ 0-1.0, 179-6-065, 147, site
plan for new floor area in a CEA and hard surfacing within 50 ft of the shoreline shall be subject to Planning
Board review and approval.
Pursuant to relevant sections of the Town of Queensbury Zoning Code -Chapter 179-9-080, the Planning
Board has detennined that this proposal satisfies the requirements as stated in the Zoning Code,
As required by General Municipal Law Section 239-rn the site plan application was referred to the Warren
County Planning Department for its recommendation:
The Planning Board inade a recommendation to the Zoning Board of Appeals on 2/15/2022, the ZBA
approved the variance requests on 2! 16 2022;
The Planning Board opened a public hearing on the Site plan application on 1122/2022 and continued the
public hearing to 2122`2022, when it was closed,
The Planning Board has reviewed the application materials submitted by the applicant and all comments
made at the public hearing and submitted in writing through and including 2:22i2022:
The Planning Board determines that the application complies with the review considerations and standards
set forth in Article 9 of the Zoning Ordinance for Site Plan approval,

a) The limits of clearing will constitute a no -cut buffer zone, orange construction fencing shall
be installed around these areas and field verified by Community Development staff-,
b) If applicable. the Sanitary Sewer connection plan must be submitted to the Wastewater
Department for its review, approval, permitting and inspection,
c) If curb cuts are being added or changed a driveway pen -nit is required. A building permit will not be
issued until the approved driveway permit has been provided to the Planning Office:

g) Final approved plans, in compliance with the Site Plan, must be submitted to the Community
Development Department before any further review by the Zoning Administrator or Building and
Codes personnel:
h) The applicant must meet with Staff' after approval and prior to issuance of Building Permit
and/or the be6inning of any site work:
i) Subsequent issuance, of further permits, including building permits is dependent oil compliance with

The Zoning Board of Appeals of the Town of Queensbury has received an application from Brett & Pamela
West. (Revised 1118120??) Applicant proposes construction of a new home with 3,210 sq. ft. floor area and
2,160 sq. ft. footprint. The home is two story with an attached garage. The project includes a covered walkway
from the home to the proposed adjoining home and installation of permeable paver areas for driveway and

Relief Required:
The applicant requests relief for constriction of a new home and associated site work needing relief for setbacks
and access from adjoining lot for the constriction of a new single-family home in the Waterfront Residential
Zone -WR. The parcel is 0.34 acres. The additional variance noted for the shoreline setback for the infiltration
device.
Section 179-34M dimensional
Revised February 2022. The covered walkway is to be 0 ft. from the cast side setback where a 20 ft. setback is
required. The home is to be 10 ft. from the cast property line where a 20 ft. setback is required. Note - the Last
property line has been adjusted to accommodate a setback with no changes to the tot size. Relief is also
requested to access the parcel from the adjoining lot and not the lot the project is on. Relief for the infiltration
device to the shoreline -- three proposed at 45 ft, 49 ft, and 72 ft where a 100 ft setback is required. Note
permeability is proposed at 78.5% and 75% is required -no perineabilitr retie}'is requested; for area is
proposed at 3,210 sq. ft. and the maximum allomed is 3,212 sq. ft. - no.tivor area reliefrequested.

Upon review of the application materials, information supplied during the public hearing, and upon
consideration of the criteria specified in Section 179-14-08((A) of the Queensbury Town. Code and Chapter 267
of NYS Town Law and after discussion and deliberation, we find as follows:
1. There is not an undesirable change in the character of the neighborhood nor a detriment to nearby
properties. We feel that the: architecture provided here is going to snake a very substantial beautiful looking
property.
2. Feasible alternatives have been considered by the Board but are generally not reasonable because of the
shape and size of the property.
3. The requested variance is not substantial. It's actually tin improvement from what previously existed.
4. There is not an adverse impact on the physical or environmental conditions in the neighborhood or district.
Because we feel that a water management plan is going to be superior to no plan at all.
5. The alleged difficulty, of course, is self-created.
6. In addition, the Board finds that the benefit to the applicant from granting the requested variance would
outweigh (approval) the resulting detriment to the health, safety and welfare of the neighborhood or
community,-
7. The Board also finds that the variance request under consideration is the minimum necessary:

EROSION CONTROL AND GRADING NOTES:
1) MINIMAL EROSION CONTROL DEVICES ARE ILLUSTRATED ON SITE PLAN IN A SCHEMATIC MANNER BASED ON NY
STATE GUIDELINES FOR EROSION AND SEDIMENT CONTROL. IT WILL BE NECESSARY TO ADJUST THE ACTUAL
LOCATION AND QUANTITY OF EROSION CONTROL DEVICES DEPENDING UPON FIELD CONDITIONS. THE
CONTRACTOR SHALL BE RESPONSIBLE FOR IMPLEMENTING THESE MEASURES AS REQUIRED TO PROTECT THE
SITE.
2) SLOPES SHALL TYPICALLY BE GRADED AT A MAXIMUM OF 3:1 (3 HORIZ. 1 VERT.) WITHIN ALL CUT OR FILL
AREAS, UNLESS OTHERWISE DESIGNATED ON PLANS.
3) SEED SHALL BE A COMMERCIALLY AVAILABLE MIXTURE OF PERENNIAL RYE AND UTILITY GRADE FESCUE.
PERCENTAGE OF PERENNIAL RYE SHALL NOT EXCEED 50%.
4) SEEDED AREAS SHALL BE FULLY COVERED WITH A LEAN STRAW OR MULCH MATERIAL. IF ORDERED BY THE

6) SILT FENCE BARRIERS SHALL BE PLACED WITHIN ALL AREAS OF EXPOSED SLOPES TO CONTROL SOIL EROSION
DURING AND AFTER CONSTRUCTION.
7) ALL STORM OUTFALLS SHALL RECEIVE RIP RAP IMMEDIATELY UPON INSTALLATION (AS PER PLAN).
8) EROSION CONTROL (ERO-MAT) OR APPROVED EQUAL, SHALL BE INSTALLED ON ALL 2:1 SLOPES: AN ORGANIC
FIBER PROTECTIVE MAT, HALF INCH LAYER OF CHOPPED STRAW, KNITTED INTO A RUGGED MAT WITH A THIN
NETTING OF PHOTODEGRADABLE POLYPROPYLENE. SECURE MAT TO SLOPE WITH 6" STEEL U-SHAPED

(7) THE HOLDING TANK SHALL BE ACCESSIBLE FOR A PUMPING VEHICLE. EVIDENCE OF AGREEMENT WITH A LICENSED
PROFESSIONAL HAULER FOR PUMP OUT AND DISPOSAL IS NECESSARY PRIOR TO APPROVAL OF INSTALLATION.
(8) THE HOLDING TANK SHALL BE REMOVED OR FILLED WITH AN INERT MATERIAL IF ABANDONED OR WHEN PUBLIC SEWERS ARE
INSTALLED.
(9) THE ALARM SYSTEM SEQUENCE OF OPERATIONS IS AS FOLLOWS: WHEN THE LEVEL OF THE HOLDING TANK REACHES 50% OF
THE USABLE LEVEL IN THE TANK, THE YELLOW LIGHT WILL INDICATE "TANK HIGH LEVEL." WHEN THE LEVEL OF THE HOLDING
TANK REACHES 100% OF THE USABLE LEVEL IN THE TANK, THE BUZZER WILL SOUND, THE RED LIGHT WILL FLASH TO
INDICATE "TANK SHUTOFF LEVEL," AND THE SOLENOID VALVE IN THE MAIN WATER LINE WILL ENERGIZE AND CLOSE TO
PREVENT ANY MORE WATER FROM ENTERING THE RESIDENCE. THE PUSHBUTTON WILL BE USED TO SILENCE THE BUZZER. THE
SYSTEM WILL RESET AFTER THE HOLDING TANK IS PUMPED DOWN TO BELOW THE ACTUATION LEVEL OF THE LEVEL SWITCHES.
(10) FLOAT SWITCHES SHALL BE DIRECT ACTING, NORMALLY OPEN, SUSPENDED, WITH BUILT-IN WEIGHT WHICH ACTUATES WHEN
THE LONGITUDINAL AXIS OF THE FLOAT IS HORIZONTAL AND DEACTUATES WHEN THE LIQUID LEVEL FALLS ONE INCH BELOW
THE ACTUATION LEVEL. THE FLOAT SWITCH SHALL OPERATE AT 120 VOLTS ALTERNATING CURRENT WITH A PILOT DUTY OF
4.5 AMPERES MINIMUM. THE CONTACT SHALL BE NORMALLY OPEN, I.E., IT SHALL CLOSE WHEN THE FLOAT RISES ABOVE THE
ACTUATION LEVEL. THE FLOAT SHALL BE CHEMICAL -RESISTANT POLYPROPYLENE CASING WITH A FIRMLY BONDED ELECTRICAL

SHALL BE 3#12AWG, TYPE THIN OR THWN, CONDUCTORS IN A ONE HALF -INCH PVC CONDUIT. ONE LEVEL SWITCH SHALL BE
ACTUATED WHEN THE TANK IS AT 50% OF THE USABLE CAPACITY TO INDICATE A HIGH LEVEL. THE SECOND LEVEL SWITCH
A SHUT OFF LEVEL.

ENCLOSURE SHALL BE PROVIDED WITH A NAMEPLATE WITH THE FOLLOWING DESCRIPTION "HOLDING TANK LEVEL ALARM
SYSTEM." PLASTIC LAMINATED NAMEPLATES, WHITE THROUGH TO BLACK CORE, SHALL BE PROVIDED OVER EACH DEVICE. THE
NAMEPLATE DESCRIPTION SHALL BE AS INDICATED ON THE SCHEMATIC. ALL WIRING IN THE HOLDING TANK LEVEL ALARM
SYSTEM CONTROL PANEL SHALL BE INSTALLED IN A NEAT AND WORKMANLIKE MANNER. A COPY OF THE SCHEMATIC AND
SEQUENCE OF OPERATION SHALL REMAIN WITH CONTROL PANEL. THE ENCLOSURE SHALL BE MOUNTED IN A SUITABLE
LOCATION IN THE RESIDENCE.
(17) THE SOLENOID VALVE SHALL BE A NORMALLY OPEN (ENERGIZE -TO -CLOSE) VALVE, 120 VOLTS ALTERNATING CURRENT AND
SHALL BE INSTALLED IN THE RESIDENCE INCOMING MAIN WATER LINE. THE SIZE OF THE VALVE ORIFICE SHALL CORRESPOND
