4.07 4.7 RESOLUTIONSVONINGRefer Petition for Change of zone—Sicard to Planning Board—11-6-2023 RESOLUTION AUTHORIZING TOWN CLERK TO SUBMIT THE ESTATE OF GEORGE SICARD'S PETITION FOR CHANGE OF ZONE TO QUEENSBURY PLANNING BOARD RESOLUTION NO.: ,2023 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, The Estate of George Sicard (Sicard) submitted a Petition for Change of Zone application to the Queensbury Town Clerk's Office on or about October 25, 2023 to amend Chapter 179 (Zoning) of the Code of the Town of Queensbury to add a definition of "Storage Yard" and allow storage yards by Special Use Permit approval, and WHEREAS, Sicard has also submitted applications to the Planning Board for Site Plan Review and Special Use Permit approvals to allow continuation of the storage yard at the property known as 340 & 366 Queensbury Avenue, Tax Map ID: 297-.20-1-2.1, and WHEREAS, the application has been reviewed by the Town's Senior Planner and deemed complete for purposes of review, and WHEREAS, applications for zoning changes are subject to Warren County Planning Department review in accordance with New York State General Municipal Law §239-m, and WHEREAS, applications for zoning changes may be forwarded to the Town Planning Board for recommendations in accordance with §179-15-040 of the Town Zoning Ordinance, and WHEREAS, following such recommendations, the Town Board may review the application and take such other actions as it shall deem necessary and proper, and WHEREAS, prior to making a decision about whether to approve the zoning change, it is necessary to conduct a review under the New York State Environmental Quality Review Act (SEQRA) for potential environmental effects, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby requests that the Planning Board seek Lead Agency status for SEQRA review of the proposed zoning changes, Site Plan Review and Special Use Permit applications submitted by Sicard as delineated in the preambles of this Resolution, and BE IT FURTHER, RESOLVED, that the Town Board hereby authorizes and directs the Town Clerk to forward Sicard's application received by the Town Clerk's Office on or about October 25, 2023 to the Queensbury Planning Board for review, report and recommendation on the proposed zoning change, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Clerk to submit the application to the Warren County Planning Department for NYS GML §239-m review, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute any necessary documentation and the Town Supervisor, Town Clerk and/or Department of Community Development to take any other necessary actions to effectuate the terms of this Resolution. Fences may be permitted around the perimeter of areas used for storage, but any fencing shall be placed behind landscaped screening. (3) Storage yard facilities with cars, vehicles and boats to be stored over 30 days Note: Language in bold italics is new language to be added. The Sicard parcel is an old farm with significant open areas that are suitable for storage, and more importantly, this site, as with many other CLI zoned parcels, are surrounded by compatible uses that will limit the impact to neighbors and/or passersby. 5. How will the proposed zone affect public faculties? Storage yards should not affect public facilities or utilities 6. Why is.the-diluent zone classification not appropriate for the property in question? Current zoning does not allow general commercial storage yards, and this significantly hampers commercial and industrial operations for many owners. The change to allow more flexibility for business owners. 7. What are the..environmental impacts of the proposed change? Potential environmental consequences include visual impacts on neighbors and passersby, which are being addressed by proposed screening requirements. Additionally, storage of vehicles/equipment that could leak fluids could be a negative impact; this can be addressed through proposed standards that require draining liquids from vehicles to be stored, and by requiring periodic visual assessments of the storage area by the site/ 1 business owner. An excerpt from the comprehensive plan is provided below; with proper landscaping, storage yard meets the intent of the plan. 9. The site is being upgraded with screening along Queensbury Ave. to make it as inconspicuous as practical. No significant impact to the site is anticipated, as no excavation is required, there are no steep slopes to be impacted, no tree clearing is proposed, and an existing driveway entrance is to remain in use (albeit reduced in size). F. Traffic access and circulation, road intersections, road and driveway widths, and traffic controls will be adequate. Off-street parking and loading facilities will be appropriately located and arranged and sufficient to meet traffic anticipated to be generated by the new use. The establishment of vehicle links between parking areas of adjacent properties are provided where feasible. This furthers the Town's goal of reducing curb cuts and reducing congestion. If adjacent properties area either undeveloped or previously developed without having made provision for future linking, then a future connection must be identified and provided for in the site plan under review for such future linking when the time arises. Rules and regulations regarding the general use of sUAV's are outlined in the Federal Aviation Administration, 14 CFR Part 91 [Docket No.FAA-2014- 0396],titled Interpretation of the Special Rule for Model Aircraft; and the Federal Aviation Administration Notice N JO 7210.891,with an effective date of November 25, 2015,titled Air Traffic Organization Policy, subj: Unmanned Aircraft Operations in the National Airspace System(NAS). The existing residential structure currently penetrates the imaginary surfaces described above and is classified as an obstacle. However,the structure may remain as-is and will be lighted by the Grantee with a dual-red obstruction light installed on a separate support structure within 150' of the structure. In the case of a catastrophic event which destroys the structure, the height of the replacement structure shall comply with the avigation easement described in this document. This easement shall be appurtenant to and shall run with the real property now owned by the Grantor for the exclusive benefit of the Grantee or its successors in interest.
