Dear Mike McCabe:
This is to inform you that the Agency received the above referenced variance
determination and record from the Town on February 27, 2024. The Agency’s 30-day
review period expired on March 28, 2024. This response letter is to provide
documentation that the Town completed its referral to the Agency as required.
Please note that the installation of the leach field within 100-feet of wetlands
requires an Adirondack Park Agency Permit as noted in the response letter for
LV2022-0049 issued on June 22, 2022 (attached).

Adirondack Park Agency staff review of the above referenced variance determination
has been completed. The applicant proposes to replace an on-site wastewater
treatment system. Relief is required from the Town for the leaching system to be placed
53.6 feet from wetlands where 100 feet is required and for the force main to cross a
Town right-of-way.
Based on the information presented in the record, no further Agency review is required
regarding the Town issued variance; however, there are jurisdictional wetlands on
the property and the landowner must obtain an Adirondack Park Agency permit
for installation of a leaching system within 100 feet of wetlands.
