392.2023 Authorizing Award of Bid - Highway Garage Repair RESOLUTION AUTHORIZING AWARD OF BID FOR HIGHWAY STORAGE GARAGE REPAIR CAPITAL PROJECT RESOLUTION NO.: 392, 2023 INTRODUCED BY: Mr. Harrison Freer WHO MOVED ITS ADOPTION SECONDED BY: Mr. George Ferone WHEREAS, by Resolution No.: 82, 2016, the Queensbury Town Board authorized establishment of the Highway Garage Capital Project and Highway Garage Capital Project Fund 4208 and by Resolution No.: 239, 2023, authorized engagement of C.T. Male Associates (C.T. Male) for engineering services relating to the Design, Bid and Construction Administration Phase Services regarding the repair and replacement work associated with vehicle impact damage to the Highway Garage Storage facility structure and overhead door elements (Project) and C.T. Male accordingly prepared bid documents and specifications for the Project, and WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and award the bid to the lowest responsible bidder meeting New York State statutory requirements and the requirements set forth in the Town's bid documents and specifications, and WHEREAS, the Town's Purchasing Agent advertised for bids for the Project in the Town's official newspaper and following such advertisement and receipt of bids, opened the bids on October 16t', 2023, and WHEREAS, the Purchasing Agent and C.T. Male have reviewed the bids and recommended that the Town Board award the bid for the Project to the lowest, most responsible bidder, Gallo Construction, for the amount of$211,950 as delineated in C. T. Male's October 20, 2023 letter presented at this meeting, and WHEREAS,the Town Board concurs with this bid recommendation, and WHEREAS, there may be times when Change Orders may become necessary for such Project and therefore the Town Board wishes to provide the Town Supervisor with authorization to approve and sign certain Change Orders up to a two-percent (2%) contingency ($4,239) for Change Orders that he deems necessary or appropriate, WHEREAS, the Town Board wishes to authorize a withdrawal and expenditure in the amount of$216,189 from Capital Reserve No. 64 toward this Capital Project, and WHEREAS, in accordance with New York State General Municipal Law §6(c), the Town Board is authorized to withdraw and expend funds from Reserve 464 subject to permissive referendum, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby accepts and awards the bid for the repair and replacement work associated with the vehicle impact damage to the Highway Garage Storage facility structure and overhead door elements (Project) from the lowest, responsible bidder, Gallo Construction, for the amount of $211,950 as delineated in C. T. Male's October 20, 2023 letter presented at this meeting, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes the Town Supervisor to approve and sign Change Orders pertaining to such Project up to a two-percent(2%) contingency or in the total amount not exceeding $4,239 that he deems necessary or appropriate, and BE IT FURTHER, RESOLVED, that the Town Board hereby finds that the withdrawal and expenditure for this 2 Project are expenditures for a specific capital project for which the Capital Reserve Fund 464 was established and therefore authorizes and directs the transfer of $216,189 from Capital Reserve Fund 464 to Capital Construction Account No.: 208-1620-2899, and BE IT FURTHER, RESOLVED that the Town Board further authorizes and directs the Town Budget Officer to take all actions necessary to amend the Town Budget and increase the following appropriations and revenues as necessary: • Revenue Acct No. —208-0000-55031 (Interfund Revenue) $216,189; • Expense Acct. No. —208-1620-2899 (Capital Construction) $216,189; and • Increase Appr 001-9950-9030-0064 Transfer to Cap Project $216,189; and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute the Notice of Award, an Agreement with Gallo Construction in form acceptable to C.T. Male, the Town Supervisor and/or Town Counsel and any other needed documentation, and the Town Supervisor, Highway Superintendent, Facilities Manager, Purchasing Agent and/or Budget Officer to take such other and further actions as may be necessary to effectuate the terms of this Resolution, and BE IT FURTHER, RESOLVED, that this Resolution is subject to a permissive referendum in accordance with the provisions of Town Law Article 7 and the Town Board hereby authorizes and directs the Town Clerk to publish and post such notices and take such other actions as may be required by law.
