DECLARATION:
1. I acknowledge that no construction shall be commenced prior to the issuance of a valid permit and will be
completed within a 12 month period.Any changes to the approved plans prior to/during construction will require
the submittal of amended plans,additional reviews and re-approval.
2. If,for any reason,the building permit application is withdrawn,30%of the fee is retained by the Town of
Queensbury.After 1 year from the initial application date, 100%of the fee is retained.
3. If the work is not completed by the 1 year expiration date the permit may be renewed, subject to fees
and department approval.
4. I certify that the application, plans and supporting materials are a true and a complete statement and/or description
of the work proposed,that all work will be performed in accordance with the NYS Building Codes, local building laws
and ordinances, and in conformance with local zoning regulations.

Aspland Residence COMMUNITY DEVELOPMENT
Dear Craig:
We have been retained to review the status of the existing septic system on the referenced
property with regard to section 179-3-040 A(5)(e) of the Queensbury Code. We have completed
the following:
• Review of design drawing entitled "Proposed Septic System for Mike Aspland Residence
at Glen Lake, Town of Queensbury, NY" prepared by William E. Montgomery Jr., P.E.
dated May 4, 2020.
• Review of Queensbury Board of Health Resolution 19-2000 approving variances for the
installation of a replacement septic system. (attached)
• Review of Queensbury Permit Number 2000-282 including final inspection report dated
6/6/2000 signed by building inspector John O'Brien. (inspection report attached)
• A field visit and visual surface inspection of tankage and absorption field areas.
The system consists of a 1,000 gallon concrete septic tank, and a 15' x 30' absorption bed.
Notation on the attached inspection report indicates "Installed per Variance" Our visual
inspection revealed septic tank levels normal and no evidence of present or previous failure
within the absorption field.
It is my opinion that the system, as installed and considering approved variances, is in
compliance with Chapter 136 of the Queensbury Code for the three-bedroom residence.

WHEREAS,Michael Aspland filed an application for two (2)variances from provisions of
the Town of Queensbury On-Site Sewage Disposal Ordinance, such application requesting that the
Local Board of Health grant variances to allow Mr.Aspland's septic system to be reinstalled eighty
feet(80') from his well and eighty feet(80') from his neighbor's well instead of the required one-
hundred feet(100')setback(s)on property located at 15 Reardon Road Extension,Queensbury, and
WHEREAS,the Town Clerk's Office published the Notice of Public Hearing in the Town's
official newspaper and the Local Board of Health conducted a public hearing concerning the
variance requests on June 5th,2000, and
WHEREAS, the Town Clerk advises that property owners within 500 feet of the subject
property have been duly notified,
NOW,THEREFORE,BE IT
RESOLVED,
a) that due to the nature'of the variances, it is felt that the variances would not be
materially detrimental to the purposes and objectives of this Ordinance or to other
adjoining properties or otherwise conflict with the purpose and objectives of any plan or
policy of the Town of Queensbury; and
• b) that the Local Board of Health finds that the granting of the variances is necessary for
the reasonable use of the land and that the variances granted are the minimum.variances.

Health to affect the applicant;and
