WHEREAS, by Resolution No.: 335,2023, the Queensbury Town Board authorized and
ratified emergency water main repairs relating to a catastrophic water main failure at the Intersection of
State Routes 9 and 254 (Project), and
WHEREAS, the Town Water Superintendent has recommended that the Town Board engage
the professional engineering services of Delaware for the design, bidding and construction
administration and observation services related to a permanent solution and final water main repairs
related to the Project for the amount of $97,200 as set forth in Delaware's Professional Services
Agreement dated 11/12/23 presented at this meeting, and
WHEREAS, the Water Superintendent has advised that Delaware will also be subcontracting
for the following professional services related to this Project:
1. Labella Associates for soil borings as Labella Associates submitted the lowest bid for
such work in the amount of$14,450 as set forth in Delaware's Test Borings RFP bid
result dated December 4, 2023; and
2. VanDusen & Steves for surveying work as VanDusen & Steves submitted the lowest
proposal for such work in the amount of$12,600 as set forth in VanDusen & Steve's
letter proposal dated November 17;2023, and
WHEREAS, the Town Board also wishes to authorize additional ancillary expenses that may
occur related to this Project in the amount of$25,750, and
WHEREAS, the Town Board wishes to establish a Capital Project and authorize a
withdrawal and expenditure in the amount of$150,000 from the Water Department's Undesignated,
Unassigned Fund Balance Account No.: 040-0000-0909, and
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs
establishment of the State Routes 9 and 254 Water Main Repairs Capital Project No.: 252
(Capital Project) in the amount of$150,000 and further authorizes and directs the Town Budget
Officer to take all actions to establish the following accounts for such appropriations and revenues
as necessary:
• Revenue Acct No. —252-0000-55031 (Interfund Revenue) $150,000;
• Expense Acct No. —252-8810-4400 (Misc. Contractual) $150,000;
• Increase Appr 040-9950-9030 Transfer to Cap Project $150,000; and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget
Officer to amend the Town Budget, make any adjustments, transfers and/or prepare any
documentation necessary to establish such appropriations and estimated revenues, and upon
Project completion take all actions necessary to close Capital Project No.: 252 and return any
remaining Fund balances to the Water Department's Undesignated, Unassigned Fund Balance
Account No.: 040-0000-0909, and

PART I
SCOPE OF SERVICES
This Scope of Services includes the steps necessary to complete the design, bidding, and construction of the
watermain replacement at the intersection of Route 9 and Aviation Road. Due to a recent watermain break., a
temporary solution will be used to provide fire flow on the south side of Glen Street. Due to the age of the
watermain, the Town will replace the existing cast iron watermain within the intersection. The new watermain
replacement will consist of directional drilling 14" HDPE watermain to match the existing watermain's inside
diameter with a casing pipe along with a new pressure reducing valve vault.
The Delaware Engineering scope of services is inclusive of attendance at meetings and phone conversations with
representatives of the Water Department and regulatory agencies without limitation.
PHASE I - DESIGN & BIDDING
I . Delaware will attend a kick-off meeting with the 'Water Department to discuss the proposed schedule and
scope of the project. In advance, Delaware will review plans and equipment specifications for the existing
infrastructure. Delaware will conduct site visits and review as-built drawings and any other available
information pertaining to the Project area.
2. Delaware will prepare an Engineering Report to support the Town Law §202(b) process which involves
acceptance of the Report by the Town Board, scheduling and conduct of a public hearing and adoption of a
final order for the proceeding. Delaware will work with the Town Attorney to support the 202(b) process
which will include but is not limited to preparation of the required engineering report,
attendance/presentation and materials for a public meeting, and information necessary for the Town
Attorney to create resolutions and orders. It is noted that the 202(b) proceeding is subject to SEQR.
3. To support the SEQR process, Delaware will prepare a Short Environmental Assessment Form and conduct
lead agency coordination if the determination is made that a coordinated review is appropriate.
4. Delaware will assist the Town Board through the Coordinated Review with preparation and review of the
Short Environmental Assessment Form. Given the nature of the project, a Neg Dec is anticipated, the
preparation of which Delaware will provide along with any required notifications such as publication in the
ENB and circulation to involved agencies.
5. Due to the work in the NY'SDOT Right of Way (ROW) highway boundaries will be required and a licensed
surveyor will be managed and administered by Delaware.
6. Subsurface investigation will be required and will be managed and administered by Delaware.
7. Delaware will design and engineer proposed improvements, and will prepare, submit and secure all required
permits and approvals, including but not limited to approvals required by the New York State DOH,
NYSDOT and the Town of Queensbury Highway Department,
8. A full set of draft bid specifications and documents will be provided to the Water Department for review
and comment. Once finalized, Delaware will provide up to 2 sets of plans and specifications to the Town
for bidding purposes, and will assist the Town in advertising the bid for construction services. Delaware will
make bid documents available online, free of charge, to bidders.

9. Delaware will schedule and coordinate a pre-bid conference on-site with prospective bidders to answer
questions and to prepare, reproduce and deliver addenda to bidders as necessary. All addenda shall be
submitted to the Water Department staff for review and approval. Delaware will be present for the bid
opening, and will evaluate all bids and bidders, determining if bidders are responsible and responsive to the
bid requests. The review performed by Delaware will include an analysis to ensure that required
documentation has been flied (i.e., bid bonds, certifications, etc.). Delaware will also evaluate the
qualifications of the contractors to ensure that the bidders are qualified to perform the work they have
proposed.
10. Delaware will prepare a bid tabulation for all responsive bidders and will prepare a Recommendation for
Contract Award once all bidder qualifications and submittals have been reviewed.
Phase II — Construction Administration/Observation Services
I . Delaware will prepare a Notice to Proceed to the selected contactor.
2. Review of shop drawings, as appropriate, and approval of such and/or review any Change Orders and provide
recommendations to the Town of Queensbury.
3. During construction, Delaware will provide engineering services including, preparing, and issuing work
directives and Change Orders as necessary; all Change Orders shall be approved by the Town.
4. On-site daily construction inspection (300 hours), including daily record-keeping forms documenting material
& bid quantities.
5. Field inspection staff will maintain records, monitor start-up testing, review scheduling, record all construction
activities, prepare change orders for review and approval, review and certify Contractor's payment requests.
PART II
COMPENSATION, BILLING AND PAYMENT
The ENGINEER shall invoice the CLIENT monthly on a time and materials basis providing a detailed invoice and
payment shall be due 30 days from receipt of invoice. The cost of the soil borings and surveying are not included.
Requests for Proposals will be sent to surveying and soil boring companies and Delaware will review the proposals
with the Town. Once the surveyor and drillers have been selected, Delaware will manage and administer as a sub-
consultant to Delaware.

Re; Surveying Services, Intersection of Route 9, Quaker, and Aviation
All,
Please accept this as a formal proposal for surveying services regarding the property around the
Intersection of N.Y.S. Route 9, Quaker Road, and Aviation Road in the Town of Queensbury, Warren County,
for a portion of the parcel known by tax map number XXXX, Van Dusen and Steves proposes the following:
Perform a topographic survey of the area shown on the attached aerial imagery, with topography
at one foot contour intervals, locating all paint striping, utilities (visible and with inverts showing
underground pipe sizes and directions where available), and highway boundaries
Our cost estimate for this project is $12.600.00 with certified payroll/prevailing wage assumed, and we
expect to be able to begin work on this project within two weeks, pending receipt of this signed proposal,
subject to weather and factors beyond our control. Van Dusen and Steves reserves the right to withhold
mapping until final Invoice is settled_
