WHEREAS,Applicants have submitted their Septic Variance Application and Plans to install
such combination replacement wastewater treatment system and applied to the Local Board of Health

2. 30.5'from Glen Lake instead of the required 100'setback;

WHEREAS, by Resolution No.: 335, 2023, the Queensbury Town Board authorized and
ratified emergency water main repairs relating to a catastrophic water main failure at the Intersection
of State Routes 9 and 254 (Project), and
WHEREAS,the Town Water Superintendent has recommended that the Town Board engage
the professional engineering services of Delaware Engineering, DPC for the design, bidding and
construction administration and observation services related to a permanent solution and final water
main repairs related to the Project for the amount of$97,200 as set forth in Delaware's Professional
Services Agreement dated 11/12/23 presented at this meeting, and
WHEREAS,the Water Superintendent has advised that Delaware Engineering,DPC will also
be subcontracting for the following professional services related to this Project:
1. Labella Associates for soil borings as Labella Associates submitted the lowest bid for
such work in the amount of$14,450 as set forth in Delaware's Test Borings RFP bid
result dated December 4, 2023; and
2. VanDusen & Steves for surveying work as VanDusen & Steves submitted the lowest
proposal for such work in the amount of$12,600 as set forth in VanDusen & Steve's
letter proposal dated November 17; 2023, and
WHEREAS,the Town Board also wishes to authorize additional ancillary expenses that may
occur related to this Project in the amount of$25,750, and
WHEREAS, the Town Board wishes to establish a Capital Project and authorize a
withdrawal and expenditure in the amount of$150,000 from the Water Department's Undesignated,
Unassigned Fund Balance Account No.: 040-0000-0909, and
NOW, THEREFORE, BE IT
RESOLVED,that the Queensbury Town Board hereby authorizes and directs establishment
of the State Routes 9 and 254 Water Main Repairs Capital Project No.: 252(Capital Project) in the
amount of$150,000 and further authorizes and directs the Town Budget Officer to take all actions
to establish the following accounts for such appropriations and revenues as necessary:
• Revenue Acct No. —252-0000-55031 (Interfund Revenue) $150,000;

domicile and job site in order to ensure rapid response in emergency situations, and

responds to emergency situations pertaining to the Town's Department of Parks and Recreation during

WHEREAS, by Resolution No.: 187, 2023, the Queensbury Town Board previously
expressed its support of proposed legislation allowing Towns the option to assess all newly
constructed condominiums in a manner that reflects the most current market value, and
WHEREAS,that initiative was passed by the State Legislature but vetoed by the Governor
due to concerns over housing shortages predominantly in more urban areas of the State, and
WHEREAS, for that reason, the Town of Queensbury does not currently have the express
statutory authority to enact such legislation by local law, and
WHEREAS, pursuant to Municipal Home Rule Law §40, the Town Supervisor with the
concurrence of the Town Board (or the Town Board by a vote of 2/3 of its total voting power
without the approval of the Supervisor) may request the State Legislature to pass a bill relating to
the property, affairs or government of the Town, and
WHEREAS, there is currently pending before the State Legislature, Senate Bill No.: 7696
and Assembly Bill No.: 8183 entitled, "AN ACT to amend the real property tax law and the real
property law, in relation to the taxation of property owned by a cooperative corporation," which
legislation will grant the Town the ability to change, by Local Law, how the Town assesses the
value of condominiums, and
WHEREAS, the Town Board wishes to express its support for this proposed Legislation,
NOW, THEREFORE, BE IT

RESOLVED, by the Queensbury Town Board, Warren County,New York as follows:
Section 1. The Town Supervisor,Town Clerk and/or the Town Board are hereby authorized
and directed to execute and submit Home Rule Requests to the State Legislature substantially in
the forms attached hereto requesting the State Legislature to adopt special legislation identified as
Senate Bill S.7696 and Assembly Bill A.8183 entitled, "AN ACT to amend the real property tax
law and the real property law, in relation to the taxation of property owned by a cooperative
corporation," which legislation will grant the Town the ability to change, by Local Law, how the
Town assesses the value of condominiums.
Section 2. Necessity exists for the enactment of the requested legislation because the New
York State Real Property Tax Law does not currently allow the Town Assessor to alter the
methodology for assessing condominiums and the Town does not have any express statutory
authority allowing it to do so by Local Law.
Section 3. The Town Supervisor, Town Board, Town Assessor, Town Clerk and Town
Counsel are hereby authorized and directed to prepare and execute all needed Home Rule forms
substantially in the form presented and forward such completed Home Rule Forms with eight (8)
engrossed copies of the Resolution to New York State Senator Daniel G. Stec,5 Warren Street, Glens
Falls, New York 12801, along with any other needed documents and take such other and further
actions as may be necessary or advisable in connection with submission of such Home Rule
Request to the State Legislature.
Section 4. This Resolution shall take effect immediately.

WHEREAS, Edward Ostberg(Ostberg) submitted a Petition for Change of Zone application
to the Queensbury Town Clerk's Office on or about October 5, 2023 requesting an amendment to the
Zoning Code to allow microbreweries as a use permitted by Site Plan Review in the Commercial
Light Industrial(CLI)zoning district, and
WHEREAS, by Resolution No.: 368, 2023,the Town Board referred the application to the
Queensbury Planning Board for SEQRA review and recommendation of the proposed zoning
changes in accordance with §179-15-040 of the Town Zoning Ordinance, and
WHEREAS, at their meeting of December 19, 2023, the Planning Board issued a SEQRA
Negative Declaration on both the proposed zoning change and the Site Plan application, and
WHEREAS, at the same meeting the Planning Board also issued a favorable
recommendation to the Town Board on the proposed Zoning Code change, and
WHEREAS, by Resolution No.: 368, 2023, the Town Board also referred the application
to the Warren County Planning Department for New York State General Municipal Law §239-m
review, and
WHEREAS, on October 24, 2023, the Town received a recommendation from the Warren
County Planning Department dated 10/24/23 of"No County Impact," and
WHEREAS, the Town Board wishes to consider adoption of Local Law No.: of 2024
to amend Chapter 179 "Zoning" of Queensbury Town Code to amend Table 4: Summary of
Allowed Uses in Industrial Districts as presented at this Town Board meeting, and
WHEREAS,New York State Municipal Home Rule Law §20 requires the Town Board

BE IT FURTHER,
RESOLVED,that the Town Board hereby authorizes and directs the Town Clerk to provide
the public with at least 10 days prior notice of the Public Hearing by causing a Notice of Public
Hearing to be timely published in the Town's official newspaper and posting the Notice of Public
Hearing on the Town's website and bulletin board at least 10 days before the date of the Public
Hearing, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Clerk to send
copies of the Notice of Public Hearing, together with copies of the proposed zoning revisions, if
required, to any public officials, agencies or municipalities, in accordance with any applicable
State Laws or Town Code provisions, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Clerk to make
a copy of the proposed zoning revisions (including a proposed revision to the Town's Zoning Map
associated with the Zoning Code) available for public inspection during regular business hours of
the Clerk's office, and
BE IT FURTHER,
RESOLVED,that the Town Board authorizes and directs the Town Supervisor,Town Clerk,
Director of Planning, Zoning and Code Enforcement, Senior Planner and/or Town Counsel to take
such other actions and give such other notice as may be necessary in preparation for the Town

Warren County Conservative Chairwoman regarding Planning Board vacancy.
5.0 PRIVILEGE OF THE FLOOR (LIMIT- 4 MINUTES)
STUART ALAN- recent comment from Mr. Harrison Freer regarding building trust in
Government. I appreciate and applaud the Town Board for holding their meetings through Zoom
and would like the Planning and Zoning Boards to do so as well.
6.0 TOWN BOARD DISCUSSIONS
COUNCILMAN METIVIER (WARD 1) -Nothing to report.
COUNCILMAN FREER (WARD 11)
• Wished everyone a Happy New Year.
• Welcomed Mr. Dixon to the Board and thanked him for serving on the Board.
• Stated he would work hard at updating the Comprehensive Land Use Plan.

• Encouraged that we will continue work on the Climate Smart Community Committee and
other issues that the constituents want us to work on.
COUNCILMAN DIXON (WARD III)
• Noted that on January 271h at the Adirondack Thunder Game, there may be a job fair but
it's in the preliminary state. Hopefully will be able to give update at the next meeting.
• Thanked the Highway Department for doing a fantastic job with the snow removal.
• Thanked our EMS and Glens Falls Hospital for their actions in the recent bus accident.
These organizations are a tremendous asset to our community.
COUNCILMAN MCNULTY (WARD IV)
• Thanked the Highway Department for taking care of the snow removal.
• Stated exceptional effort of the County on the recent accident.
• Announced more bad weather coming tomorrow with snow and rain, be careful on the
roads.
SUPERVISOR STROUGH
• Attended the Eagle Scout Code of Honor on Saturday, and recognized and congratulated
Ryan Healy who is the newest Eagle Scout in the area. It takes a lot of effort and
dedication to become an Eagle Scout, it does not come easily.
• Thanked Joel Barlow, Look TV, Town Counsel Mark Schachner, Deputy Town Clerk
Colleen Rathbun, Town Board, and the members of the public.
