1.2 WASTEWATER-SEWERIAPPROVE'Benson-Absorption Field to Lane and Structure—1-22-2024 RESOLUTION APPROVING SUN-AE BENSON'S APPLICATION FOR SANITARY SEWAGE DISPOSAL VARIANCES RESOLUTION NO.: 12024 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, Sun-ae Benson(Applicant) filed an application for variances from Chapter 136 to install a replacement wastewater treatment system with its absorption field fill to be located within: 1. 8' of the east property line in lieu of the required 10' setback; and 2. 6' of the structure in lieu of the required 20' setback; on property located at 371 Glen Lake Road in the Town of Queensbury, and WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's official newspaper and the Local Board of Health duly conducted a public hearing concerning the variance request on Monday, January 22nd, 2024, and WHEREAS, the Town Clerk's Office has advised that it duly notified all property owners within 500 feet of the subject property, NOW, THEREFORE, BE IT RESOLVED,that 1. due to the nature of the variances, the Local Board of Health determines that the variances would not be materially detrimental to the purposes and objectives of this Ordinance or other adjoining properties nor otherwise conflict with the purpose and objectives of any Town plan or policy; and 2. the Local Board of Health finds that the granting of the variances is necessary for the reasonable use of the land and are the minimum variances which would alleviate the specific unnecessary hardship found by the Local Board of Health to affect the Applicant; and BE IT FURTHER, RESOLVED, that the Local Board of Health hereby approves Sun-ae Benson's application for variances from the Sewage Disposal Ordinance to install a replacement wastewater treatment system with its absorption field fill to be located within: 1. 8' of the east property line in lieu of the required 10' setback; and 2. 6' of the structure in lieu of the required 20' setback; on property located at 371 Glen Lake Road in the Town of Queensbury and bearing Tax Map No: 289.-10-1-1. Presently the 1 -bedroom cottage is served by a 1 ,000-gallon concrete septic tank and a 4 ft x 4 ft drywell. During the property transfer inspection , it was discovered that the existing drywell is within the 150 ft setback of a neighboring well. Given the terrain and site constraints, it is not passible to install a compliant wastewater system. We are proposing to install a new 10 ft wide by 25 ft long stone absorption bed in the southeast corner of the property. Relief is requested for the installation absorption field fill within 8 ft of the east property line where 10 ft is required and within 6 ft of the structure where 20 ft is required . The existing cottage is built on piers with a shallow crawl space. Enclosed please find ten submission packages for this project.
