WHEREAS, by Resolution No.: 305,2011, the Queensbury Town Board adopted its Final
Order authorizing, approving and establishing the Glen Lake Aquatic Plant Growth Control District,
and
WHEREAS, by Resolution No.: 323,2023, the Town Board adopted the 2024 Glen Lake
Aquatic Plant Growth Control District Benefit Tax Roll, and
WHEREAS, the Town Board wishes to authorize engagement of Ready Scout, LLC Lake
Consulting & Services (Ready Scout) for the preparation and filing of New York State Department of
Environmental Conservation Applications for: 1) an Aquatic Herbicide Permit for the management of
invasive and nuisance plants in Glen Lake in 2024 for the amount of$1,900; and 2) Wetlands Permit
for the treatment of invasive plants in designated DEC wetlands, wetland check zones and wetland
buffers at Glen Lake for the amount of $2,500; for a total cost of $4,400 as delineated in Ready
Scout's December 21, 2023 letter proposal presented at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes engagement of Ready
Scout, LLC Lake Consulting & Services for the preparation and filing of New York State Department
of Environmental Conservation Applications for: 1) an Aquatic Herbicide Permit for the management
of invasive and nuisance plants in Glen Lake in 2024 for the amount of$1,900; and 2)Wetlands Permit
for the treatment of invasive plants in designated DEC wetlands, wetland check zones and wetland
buffers at Glen Lake for the amount of $2,500; for a total cost of $4,400 as delineated in Ready
Scout's December 21, 2023 letter proposal substantially in the form presented at this meeting
contingent upon Ready Scout providing a certificate of insurance in form acceptable to the Town, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Budget Officer to pay
expenses incurred from appropriations in the Glen Lake Misc. Contractual Account No.: 051-8790-
4400 not to exceed $4,400 and/or take any actions necessary to provide for such payment, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to sign
Ready Scout's December 21, 2023 letter proposal substantially in the form presented at this meeting,
the New York State Department of Environmental Conservation Aquatic Herbicide Permit and
Wetlands Permit Applications and/or any other submission required of the Town and further authorizes
the Town Supervisor, Town Budget Officer and/or Town Purchasing Agent to take any and all action
necessary to effectuate the terms of this Resolution.

Service Proposal: NYSDEC Article 3.$ permitting for Glen Lake
Introduction
This proposal outlines services needed to complete and submit aquatic herbicide and wetland permits €orthe
management of invasive and nuisance plants in Glen Lake in zoz4.
Scope of Services
The following application forms will be completed and submitted by steady Scout with the assistance o€the Town of
Queensbury and the Glen Lake Protective Association.
a. Two (z) zo24 NYSDEC Acetic Herbicide Permit a lic iQfrr, — ProcellaCOR EC. Ao athol K -To be prepared
and submitted between January — March 2024. Includes the following:
a. NYSDEC permit fee -sxoo.00 each
b. DEC AQV forms and detailed proposed treatment map
C. Dilution model for downstream movement of each herbicide
d. Mailed notification letters to riparian owners
z. ao24 NYSDEC Wetlands Permit Application — Ready Scout will prepare and submit NYSDEC Wetland Permit
application (Article z4) to treat invasive plants in designated DEC wetlands, wetland checkzones and wetland
buffers at Glen Lake. Wetlands permits can be valid for multiple years. Permitting includes the following:
a. DEC permit fee - saoolperrnit
b. Joint Application for Permit Form
c. Full Environmental assessment Form
d. Project Plan with Site photographs
e. Newspaper publication of Completed application
f. Communication with DEC Staff to ensure application completeness.
g. 2024 Post-treatment report required by permit

Town ofGueensburyfGLPA Requirements
1. Assistance with information necessary to complete permits, including 2o23 plant monitoring information.
d. Signing of the necessary permit forms for submission.
3. Removal of poster after restrictions are removed.
4. Payment of the annual NOI silo fee billed by the state to the Town directly.

The fee for the Service is as described below. Prices are valid forgo days from the contract date. Ready Scout will
invoice the Town following submission of the Permit application. NY State Sales Tax will be added, unless aTax-Exempt
certification is provided.

Insurance
Ready Scout will maintain general liability insurance as necessary given the scope and nature of the Services. The
Company will be responsible for those damages, claims, causes of action, injuries or legal costs to the extent of its own
direct negligence or misconduct, and then only to an amount not to exceed the annual value of this Agreement. In no
event wiii any party to this Agreement be liable to the other for incidental, consequential or purely economic damages.
Disclaimer
Ready Scout will make every effort and conduct reasonable due diligence to prepare and submit successful permit
applications, but is not responsible for the denial of any permit submission made on behalf of the Town of Queensbury.
While Ready Scout, LLC makes every effort to thoroughly inspect the site before providing this contract proposal or
beginning any work, it is possible, without fault or negligence, that unforeseen circumstances may arise, or that
hidden conditions on the site might be found in the course of the performance of the contract work, which would
result in additional time or material costs that exceed this contract pricing. Should this occur, the customer will be
notified of these unforeseen circumstances or conditions and be responsible for the costs associated with remedying.
By signing this agreement, the customer acknowledges that they have informed Ready Scout of all known and
relevant current site conditions that would be reasonable to expect could affect our ability to successfully complete the
contract work.

WHEREAS, the Queensbury Town. Board previously scheduled a public Bearing
concerning adoption of the proposed 2024 Glen rake Aquatic Plant Growth Control District
Benefit Tax Roll and filed the completed Tax Roll in the Queensbury Town Clerk's Office, and
WHEREAS, the Town Clerk posted and published the required Notice of Public Hearing
and also mailed copies of the Notice to all property owners within the Benefit Assessment District,
and.
WHEREAS, the Town Board duly conducted a public hearing on Monday, September 259',
2023 and heard all interested persons,
NOW, THEREFORE, BE IT
RESOLVER, that the Queensbury Town Board hereby approves, confirms and adopts the
2024 Glen Lake Aquatic Plant Growth Control District Benefit Tax Roll at the following rate:

Units: 333.85
Tax Ratc/Un.it: $ 140.

BE 1717 FURTHER.,
RESOLVED, that the Town Board hereby authorizes and directs the Town Clerk to issue a
warrant to be signed by the Town Supervisor and Town Clerk commanding the Town Tax Receiver
to collect the sum(s) from persons named in the assessment roll and to pay the sum(s) to the Town.
