The basic project involves the construction of a single-family home on a vacant parcel on the north side of Pulver Road. When this project was first reviewed by the Planning Board last fall, their initial reaction was one of concern that it is too large for the property. We believe that perception was colored by some misunderstood conditions.  The property is and has been an established lot. The reason that it wasn’t previously “developed” is that the prior owners had a residence on Pilot Knob Road and did not need to build a residence on the lake front lot. The lot is also narrow and bordered by the lake on two sides. Together these factors make the available building envelope prohibitively small. This is illustrated on the new plan “EX2” entitled “Building Envelope Plan”; the available building area is highlighted as a small sliver of land near the south end of the property.  The lot is constrained by the encroachment of Pulver Road which adds impermeable surface and limits the development footprint. The original proposal for development included a house that was properly setback from the main lake on the north side, but not compliant with regard to the shoreline along the bay on the east side. The original shoreline setbacks to the east sought were 32’ (lake) and 23’ (wetland) in lieu of the required 50’. An area variance for permeability was also sought to exceed the 25% allowed impermeable surface area by 1.6%, and that was due to the encroachment of Pulver Road (without Pulver Road, the original development was compliant).  Despite the lot size, the house as originally proposed was compliant with “Floor Area Mike McCabe, Chairman, Queensbury Zoning Board of Appeals, & Board Members Re: “Freyer/Welles” Residential Development January 16, 2024   Page 2 of 3    Ratio” (FAR) requirements, which directly correlates to house size. Notwithstanding the above, the family convened over the holidays to re-examine their long term needs for the property. As a result, they have decided to trim the house down by eliminating the garage. This allows the main entrance to move and reduces overall impervious area; all told, the project has been improved by: 1) Eliminating the need for an area variance for site permeability, and, 2) Improving the side setbacks to the lake and wetland shorelines to the east Coupled with the changes noted above, we have also addressed a drainage question along the west side of the property. The Planning Board indirectly relayed this question during their initial meeting, and staff confirmed a comment from the immediate neighbor of their concern that drainage from the development would impact their property. To that question, the original design included collection of site and house runoff along the west side and conveyed to the treatment system on the east side. As a result of the question, the design has been adjusted to reduce the magnitude of the swale along the west side. Lastly, we wish to reiterate that wastewater is not to be managed on the lake front property; being sensitive to the lake, the family has placed an “Enhanced Treatment Unit” (ETU) wastewater treatment system on the Pilot Knob Road property, more than 200’ from the lake. We believe this design meets the criteria for the appropriate granting of the requested area variance, because: 1. The project will not produce an undesirable change in the character or create a detriment to the neighborhood. The area is developed with a number of lakefront and other houses, and this design, both site and house, is consistent with the character and quality of houses/properties in the area. 2. The benefit sought cannot be gained by other alternatives, given the configuration of the lot. 3. The relief requested should not be considered substantial relative to the ordinance requirements. 4. We have taken care such that the relief requested will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood. 5. The relief requested should not be considered the result of a self-created difficulty; any development of this pre-existing lot would require area variances. The proposed project complies with nearly all zoning requirements, apart from the three setback variances sought. The proposed development complies with lot coverage (zoning permeability) and Floor Area Ratio (FAR) as well as shoreline buffering guidelines. C. The site plan encourages pedestrian activity internally and, if practicable, to and from the site with pedestrian paths or sidewalks connected to adjacent areas. There are pathways on the site to be constructed of organic (permeable) materials, and the driveway extending to Pulver Road provides access to adjoining properties. D. The site plan must conform to Chapter 136 Sewer and Sewage Disposal, Chapter 147 Stormwater Management Local Law, and other applicable local laws. A wastewater design for this property was proposed to and approved by the Queensbury Board of Health in June 2022. That design calls for wastewater collection on the waterfront parcel and conveyance to the families’ Pilot Knob parcel for treatment and disposal. Stormwater management is proposed through a large shallow infiltration basin and rain garden along the east side of the parcel. The basin and rain garden will treat all runoff before it reaches Lake George and/or the associated wetland. E. Vegetative buffers are proposed along the north boundary with Lake George, and along wetland boundary on the east side. Additionally, exiting trees along the west boundary and south end of the parcel will be maintained as is practical. M. Fire lanes, emergency zones and fire hydrants will be adequate and meet the needs and requirements of emergency service providers. Fire access can be made via Pulver Road and the new driveway. N. The design of structures, roadways and landscaping in areas susceptible to ponding, flooding and/or erosion will minimize or avoid such impacts to the maximum extent practicable. The design minimizes impacts to Lake George as much as possible. Welles and Lauren W.
