3.07 3.7 WASTEWATER\Greater Qby Consolidated Sanitary Sewer Ext#7—575 Bay Road-Schermerhom Apartments—ORDER Set Public Hearing-2-26-2024 ORDER SETTING PUBLIC HEARING REGARDING PROPOSED EXTENSION #7 TO GREATER QUEENSBURY CONSOLIDATED SANITARY SEWER DISTRICT TO SERVE 575 BAY ROAD PROPERTY RESOLUTION NO.: 12024 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Town of Queensbury wishes to consider an extension of its Greater Queensbury Consolidated Sanitary Sewer District to be known as Sanitary Sewer District Extension 47 (Extension 47) to serve 575 Bay Road in the Town of Queensbury, New York, such property consisting of two recently merged parcels (Tax Map Nos: 296.7-1-2 and 3) referred to as the "Property" on which Property a 76 unit apartment style multi-family building and associated work project including the sewer construction project/Extension 47 (Project) is proposed to be constructed by Schermerhorn Properties, LLC (Developer) in accordance with New York Town Law Article 12-A, and WHEREAS, a Map, Plan and Report issued April 24, 2023 and revised February 15, 2024 has been prepared by Environmental Design Partnership, LLP (Map, Plan and Report) concerning proposed Extension 47 to connect the proposed Property to the existing Greater Queensbury Consolidated Sanitary Sewer District as more specifically set forth and described in the Map, Plan and Report, and WHEREAS, the Map, Plan and Report has been filed in the Queensbury Town Clerk's Office and is available for public inspection, and WHEREAS, the Map, Plan and Report delineates the boundaries of the proposed Extension 47, a general plan of the proposed system, a report of the proposed method of operation, all outlets and the terminus and course of each proposed main sewer or drain together with the location and a general description of all sewage disposal plants, pumping stations and other public works, if any, and is consistent with, so far as possible, any comprehensive plan for sewers developed and maintained pursuant to General Municipal Law §99-f, and WHEREAS, on October 24th, 2023, the Town Planning Board, as Lead Agency, reviewed and conducted a State Environmental Quality Review Act (SEQRA) Review of the Project referred to as Planning Board Site Plan 61-2023 and Freshwater Wetlands 11-2023 Schermerhorn Construction, LLC, such Project being an Unlisted Action and granted a Negative Declaration, and WHEREAS, subsequently it was discovered that a variance will be required from the Town's Zoning Board of Appeals and on February 20th, 2024, the Town Planning Board considered the new information and the details requesting the variance and, after due consideration, readopted its Negative Declaration, and NOW, THEREFORE, IT IS HEREBY ORDERED: I. The boundaries of the proposed Extension 47 are as set forth in the Map, Plan and Report and as follows: SEWER SERVICE DISTRICT OVER ALL THOSE CERTAIN TRACTS, PIECES OR PARCELS OF LAND SITUATE in the Town of Queensbury, County of Warren, State of New York, lying along the westerly line of Bay Road (County Road No. 7) and being further bounded and described as follows: Beginning at the point of intersection of the westerly line of said Bay Road with the common division line of SBL4296.11-1-45 generally to the south and SBL#296.7-1-2 generally to the north; 2 Thence along said common division line, in a general westerly direction to the easterly line of SBL4296.7-1-18; Thence along the common division line of said SBL4296.7-1-18 generally to the west and said SBL#296.7-1-2 generally to the east, in a general northerly direction to the point of intersection of said common division line with the southerly line of SBL4296.7-1-4; Thence along the common division line of said SBL4296.7-1-4 generally to the north and said SBL#296.7-1-2 and SBL#296.7-1-3 generally to the south, in a general easterly direction to the point of intersection of said common division line with the aforesaid westerly line of Bay Road; Thence along said westerly line of Bay Road, in a general southerly direction to the point or place of beginning. The above described Sewer Service District Extension is intended to include all of those parcels as contained within the above described area as shown on the Warren County Real Property Tax Map in the Town of Queensbury, NY and is not intended for the conveyance of Real Property. 2. The proposed Project along Bay Road will include two (2) duplex grinder pump stations that will serve the proposed building. These grinder pumps will discharge to approximately 750 linear feet (LF) of 1.5" PE low pressure force main that will convey the flows to the existing gravity main along the western side of Bay Road. The proposed tie-in to the existing gravity main along Bay Road will be made using a pre-cast cut in manhole located adjacent to the site entrance. 3. The estimated construction cost associated with the proposed Sanitary Sewer District Extension 47 is estimated to be approximately $187,612 to be paid for by Developer; therefore, the Town will incur no construction and/or capital costs associated with this Extension 47. The total one-time cost of hook-up and permit fees is estimated to be $42,862.24. Developer will be required to maintain all of its sewer infrastructure to the point of connection to the existing sewer main. No dedication of infrastructure will be necessary for this Extension 47. 4. The estimated annual cost of the Extension 47 to the developed Property would be calculated as detailed in the Map, Plan and Report filed in the Town Clerk's Office and also available on the Town of Queensbury Website: www.queensbury.net. There is no "typical property" which is a one or two family home in such proposed District as the one commercial lot/subject Property is the only Property in this Extension 47 and the "typical property." The cost 3 of operation and maintenance would include the costs to operate, maintain, and supply the sewer system and is reflected in sewer rent charges. Based on an estimated annual water usage of 6.29 million gallons per year and an existing operation and maintenance rate of $5.50 per 1,000 gallons, the use fee would be approximately $34,633 per year. Once accepted into the Greater Queensbury Consolidated Sanitary Sewer District, users are changed a Benefit Tax which is currently $21.9115 per unit. Each residential parcel with apartments has a property class of B 1 with a Benefit Tax Unit of 1.0 per apartment unit. The property proposed to be added to the GQCSD will contain 76 apartment units and has a property class of B l. Therefore, the total benefits tax units are 76. With an annual Benefit Tax of $29.21 per unit, the total annual recurring costs for the property would be $36,298.66 for the merged lot. 5. Developer will pay all costs of the improvements including the one-time buy-in cost and Town connection fee, so there will be no financing required by the Town on behalf of the District or otherwise. Developer will provide to the Planning Board the Deed of merger and real property forms in the form they shall require and shall provide proof of recording prior to hooking up to the Town's system. 6. A detailed explanation of how the estimated costs of the Extension 47 were computed is included in the Map, Plan and Report which has been filed with the Queensbury Town Clerk and is available for public inspection. 7. The proposed improvements shall be constructed and installed as specifically delineated in the Map, Plan and Report and in full accordance with the Town of Queensbury's specifications, ordinances or local laws, and any State laws or regulations, and in accordance with approved plans and specifications and under competent engineering supervision. 8. The Town Planning Board, as Lead Agency, conducted SEQRA review of this Unlisted Action and granted a Negative Declaration on October 24, 2023. Since then, it was discovered that a variance by the Town Zoning Board of Appeals is required. The Town Planning Board considered the impact of this and again conducted SEQRA review of this Project including sewer construction at its February 20th, 2024 meeting and after due consideration, readopted its 4 Negative Declaration. 9. The Town Board shall meet and hold a public hearing at the Queensbury Activities Center, 742 Bay Road, Queensbury at 7:00 p.m., on Monday, March 18th, 2024 to consider the Map, Plan and Report and to hear all persons interested in the proposal and to take such other and further action as may be required or authorized by law. 10. The Town Board hereby authorizes and directs the Queensbury Town Clerk to duly publish and post this Order not less than ten (10) days nor more than twenty (20) days before the public hearing date, as required by Town Law §209-d, and complete or arrange for the securing of two (2) Affidavits of Publication of Notice and two (2) Affidavits of Posting of Notice of the Public Hearing required hereby and to file a certified copy of this Order with the State Comptroller on or about the date of publication. BACKGROUND The Town of Queensbury is located in southeastern Warren County, New York, encompassing three sides of the City of Glens Falls. Schermerhorn Real Estate Holdings, LP proposes to develop the existing property located at 575 Bay Road with a multi-family residential project. As the existing project parcel does not currently lie within the Greater Queensbury Consolidated Sewer District (GQCSD), an extension is required to connect to the municipal sewer. The GQCSD encompasses several properties adjacent to proposed project. A Site Location Map is attached as Appendix A. 1 .2. PURPOSE & SCORE The purpose of this report is to provide a sewer district extension for the project parcel which is located within the Town of Queensbury and is adjacent to the existing GQCSD Boundary. The address of this property is 575 Bay Road and consists of two recently merged parcels (Tax Map ID. 296.7-1 -2 & 3). This extension will be known as extension #7 of the Greater Queensbury Consolidated Sewer District. The property at 575 Bay Road is comprised of two recently merged parcels. The existing parcel is mostly vacant with barns and accessory agriculture building. The project site is located in the Queensbury Water District and there is adequate water supply via the existing water mains located along Bay Road . Schermerhorn Real Estate Holdings, LP has retained the Environmental Design Partnership, LLP (EDP) to prepare a Map, Plan and Report (MPR) for Extension #7 of the GQCSD. This report documents the sewer district extension for the Proposed Residential Development at 575 Bay Road and includes the following : • Description of Sewer District Extension #7 boundary; Plan/Profile of the required Sewer Infrastructure; Estimated Construction , operational and maintenance costs; and Implementation Plan. 2.0 EXISTING CONDITIONS An existing gravity sewer main is currently located within the Bay Road right-of-way, in front of the project parcel. This project proposes to connect to this existing gravity main with is part of the existing Town of Queensbury collection system. The existing gravity main in the Bay Road right-of-way is an 8-inch PVC sewer main designed to receive sewage flow from the Bay Road corridor_ The 8-inch gravity main increases to a 12- inch main just downstream from the site. This main conveys the sanitary sewer flows south along Bay Road and easterly along Walker Lane, where is reduces to an 8-inch main, before discharging to the Willowbrook Pump Station . Bay Road , which in-turn conveys the flows to the Meadowbrook Pump Station. From this pump station, the sewage is conveyed to the City of Glens Falls gravity sanitary sewer system at Sanford and Bay, where it is then conveyed to the Glens Falls WWTP. This WWTP is an approved treatment facility permitted by the New York State Department of Environmental Conservation (NYSDEC)_ 3.0 PROPOSED SEWER DISTRICT EXTENSION 3.1 . PROPOSED SERVICE AREA The proposed sewer district extension #7 includes the recently merged parcels that will connect to the Town of Queensbury's sewer system . The extension includes tax map parcels 296.7-1 -2 & 3 along Bay Road shown on Appendix B. This project will utilize a grinder pump system to convey sewage through low-pressure force mains that will discharge to the existing gravity sewer main that lies along Bay Road at the entrance to the project. A boundary map of the proposed Bay Road portion of Extension #7 of the GQCSD is included as Appendix B, with Appendix C containing a description of the proposed district extension boundary and Appendix D including a list of the Tax Map Identification numbers for the two recently merged parcels. 3.2. DISTRICT EXTENSION NECESSITY The owner of the existing 16.25-acre parcel located along Bay Road, proposes to develop the property with a 76-unit apartment style multi-family building . As such, public water and sewers are required for the proposed apartment building . The existing water main that lies within the Bay Road right-of-way will be tapped to serve this project. The applicant is proposing to utilize two grinder pump stations to convey sewage from the project through a single low-pressure sewer main to a cut-in manhole connection over the existing gravity main within the Bay Road right-of-way. Proposed design drawings are included as Appendix E_ 3.3. PROPOSED SEWER DISTRICT FLOWS The proposed project includes 76 proposed apartment units. Utilizing a design flow of 100 gallons per day (gpd) per capita and an estimated 2.27 person per dwelling unit (from US Census Data for the Town of Queensbury) the average daily flow per dwelling unit will be on the order of 227 gpd. Using this rate, the proposed estimated flow for the 76 unit apartment building will be on the order of 17,252 gpd. Existing water data from similar style projects located throughout Saratoga County, Schenectady Couty, Albany County and Warren County the average daily water usage is on the order of 50 gpd per bedroom. Using a more conservative design rate of 70 gpd per bedroom each dwelling unit, which are 2- bedroom each, will have a design flow on the order of 140 gpd . Using this rate, the proposed estimated flow for the 76-unit apartment building will be on the order of 10,640 gpd. REQUIRED SEWER SYSTEM FACILITIES The proposed project will include two duplex grinder pump stations that will serve the proposed building. These grinder pumps will discharge to approximately 750 linear feet (LF) of 1 .5 inch PE low pressure force main that will convey the flows to the existing gravity sewer main located along the western side of Bay Road. The proposed tie-in to the existing gravity main along Bay Road will be made using a precast cut-in manhole located adjacent to the site entrance. The proposed grinder pump stations are prepackaged units manufactured by Environment One Corporation (EONE). The EONE grinder pump stations are selected based on the calculated contributing flow rates to the station. The proposed grinder pump stations are sized as summarized below, based on historical water usage for this style apartments; Grinder Pump Station o Contributing Design Flow Rate = 76 units x 140 gpd/unit = 10,640 gpd o Average Flow Rate = 7.4 gallons per minute (gpm) o Peak Hourly Flow Rate — 7.4 gpm x 4 = 30 gpm a Pump Selection: Two (2) EONE WH484 Quadplex Grinder Pump Stations o Pump Station Design Capacity = 7,000 gpd per pump station x 2 pump stations = 14,000 gpd 3.5. DOWNSTREAM SEWER CAPACITY The existing downstream sewer for the proposed project consists direct connection to an existing gravity system that lies in the Bay Road right-of-way. This existing gravity system utilizes an 8-inch pipe which increases to a 12-inch sewer main downstream of the site. The 12- inch main flows south along Bay Road, then easterly along Willow Lane where is decreased to an 8-inch pipe downstream prior to entering the Willowbrook Pump Station. The Town of Queensbury Sewer Department reports that there is no issue with capacity in these sewer mains or pump station as they were designed based on the overall drainage area. The Willowbrook pump station currently operates at a pumping rate on the order of 285 gpm . Presently, per data from the GQCSD, the average inflow into the pump station is on the order of 52 gpm with a peak inflow rate on the order of 114 gpm, which leaves an existing capacity on the order of 171 gpm . The proposed project peak hourly flow rate will be on the order of 30 gpm which is well within the existing capacity of the pump station. Therefore, no modifications to the existing Willowbrook pump station are required. Under an amended Inter Municipal Agreement (IMA) with Glens Falls, the Town of Queensbury discharges wastewater up to 1 .414 MGD on a 30-day average, to the City of Glens Falls sewer system at five (5) locations. It is reported from the Town of Queensbury Sewer Department that they are currently discharging approximately 850,000 gpd with a peak monthly discharge of approximately 1 . 1 MGD. Therefore, there is adequate capacity downstream for flows from these projects. The City of Glens Fall currently has a combined sewer overflow (CSC ) that is permitted and monitored by NYSDEC. As part of the sewer extension approval from NYSOEC additional removal of stormwater inflow and infiltration within the City of Glen Falls sewer collection system may be required . 4.+0 PROPOSED RATE STRUCTURE 4.1 . CONSTRUCTION COSTS The estimated construction cost associated with the proposed Bay Road extension #7 of the GQCSD is approximately $ 187,612 based on the Design plans attached as Appendix E. This cost includes the one-time systems connection charges and is proposed to be paid by Schermerhorn Real Estate Holdings, LP and therefore will not be apportioned as debt service to the district. A copy of the cost estimate is included in Appendix F. The Greater Queensbury Sewer District will require an escrow account to be setup to guarantee construction of the public facilities for one-year and to ensure that all record documentation is provided to the Wastewater Director, including GIS information , Daily Construction Logs, Testing Records and As-built information. 4.2. BENEFIT TAX Once accepted into the Greater Queensbury Consolidated Sewer District (GQCSD), users are charged a benefit tax as established in the Map, Plan and Report of the initial forming of the GQCSD, dated March 5, 2011 and prepared by the Chazen Companies. Based on Table 2 in the referenced Map, Plan and Report, each residential parcel with apartments is has a property class of B1 with a Benefit Tax Unit of 1 .0 per apartment unit. The property proposed to be added to the GQCSD will contain 76 apartment units and has a property class of 81 . Therefore, the total benefit tax units are 76. Benefit Tax Unit assignments are used to apportion debt of infrastructure across users within the GQCSD. The benefit tax rate for 2024 is $21 .9115 per Benefit Tax Unit. The Benefit Tax calculations for the proposed district extension has been included in Appendix G_ 4.3, SEWER RENTS In addition to the benefit tax, users within the GQCSD are also charged a user rate based on water consumption. The income generated by the sewer rent is used to offset costs of operation and maintenance as well as build reserves for improvements needed in the system . The Town of Queensbury currently charges $5.50 per 1 ,000 gallons for all residential users in the district. The anticipated water use for this project is estimated to be up to 6.29 million gallons per year- Based on the residential rate of $5.50 per thousand gallons, the costs for sewer rents will be approximately $34,633 per year. ANNUAL COSTS AND HOOK-UP FEES (To the Proposed District Taxpayer) This Map, Plan and Report includes only a single parcel with an assessed property value is on the order of $672,700. The Hook-up fees will include a one-time connection fee of $2.37 per gallon as well the costs associated with the physical connection of the property to the sewer system and the legal costs associated with the district extension . Based on the estimated flows from section 3.3 of this report, the sewer connection costs (Hook-up fees) are included in Appendix F. The total estimated hook-up costs for the Property at 575 Bay Road is $187,612. The total annual costs associated with the proposed sewer district extension will include the benefit taxes and sewer rent fees that have been discussed in section 4.2 and 4.3 of this report. The total annuals costs for the property at 575 Bay Road are estimated to be on the order of $367299. 5.0 IMPLEMENTATION PLAN 5. 1 . IMPLEMENTATION SCHEDULE A public hearing for this project has not been scheduled at this time.
