SUPERVISOR STROUGH reviewed the proposed sewage variance application and two
variances being requested. There will be a public hearing on this tonight. Is there anything in
addition, agent for the applicant, Tom Center would like to elaborate?
TOM CENTER-Tom Center, Hutchins Engineering. No that's, this came about due to a
property transfer was identified, well, neighboring well was identified as being an issue with the
seepage pit being too close to the neighbors well to the south. So we, looking at it we came up
with the shallow 10 by 20-foot, 25-foot absorption bed and we're just looking for the two
variances.

WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's
official newspaper and the Local Board of Health duly conducted a public hearing concerning the
variance request on Monday, January 22nd 2024, and
WHEREAS, the Town Clerk's Office has advised that it duly notified all property owners
within 500 feet of the subject property,

variances would not be materially detrimental to the purposes and objectives of this

2. the Local Board of Health finds that the granting of the variances is necessary for the
reasonable use of the land and are the minimum variances which would alleviate the
specific unnecessary hardship found by the Local Board of Health to affect the
Applicant; and
BE IT FURTHER,
RESOLVED, that the Local Board of Health hereby approves Sun-ae Benson's application

SUPERVISOR STROUGH reviewed the proposed Local Law and Zoning Code changes. There
will be a Public Hearing on this but before I open the Public Hearing, I see the agent and the
owner for the particular application. Would you like to expand on anything that I just said?
ERIK SANDBLOM-I, I'm thinking you did a great job.
SUPERVISOR STROUGH-Please introduce yourself.
MR. SANDBLOM-I don't know that we need to add to that at all.
SUPERVISOR STROUGH-Okay.
MR. SANDBLOM-I guess I would just, you know, wanted to make a point that this isn't, we are
not asking for spot zoning, we're not asking for any changes to the map. This would benefit the
entire District and yes Ed would like to take on an adaptive reuse project of a building he owns
and make it a microbrewery, and this is necessary for him to be able to do that.
SUPERVISOR STROUGH-Alright, before I open the Public Hearing any questions from the
Town Board?

SUPERVISOR STROUGH-We, we've been through this. Alright, you can sit where you are and
let's see if any member of the public wishes to speak to this. If there are members of the public

say and then ask for your responses in return, if that's the case. Is there anybody here who wishes
to speak for this particular change of zone application or amending of the zone application? I don't

WHEREAS, Edward Ostberg(Ostberg) submitted a Petition for Change of Zone application
to the Queensbury Town Clerk's Office on or about October 5, 2023 requesting an amendment to the
Zoning Code to allow microbreweries as a use permitted by Site Plan Review in the Commercial
Light Industrial(CLI) Zoning District, and
WHEREAS,the Queensbury Town Board wishes to consider adoption of proposed Local
Law No.: 1 of 2024 entitled, "A Local Law to Amend Chapter 179 "Zoning" of Queensbury

Town Code to Amend Table 4: Summary Of Allowed Uses in Industrial Districts", and
WHEREAS, by Resolution No.: 368, 2023,the Town Board referred the application to the
Queensbury Planning Board for SEQRA review and recommendation of the proposed zoning
changes in accordance with §179-15-040 of the Town Zoning Ordinance, and
WHEREAS, at their meeting of December 19, 2023, the Planning Board issued a SEQRA
Negative Declaration on both the proposed zoning change and the Site Plan application, and
WHEREAS, at the same meeting the Planning Board also issued a favorable
recommendation to the Town Board on the proposed Zoning Code change, and
WHEREAS, by Resolution No.: 368, 2023, the Town Board also referred the application
to the Warren County Planning Department for New York State General Municipal Law §239-m
review, and
WHEREAS, on October 24, 2023,the Town received a recommendation from the Warren
County Planning Department dated 10/24/23 of"No County Impact," and
WHEREAS, before the Town Board may amend the Town Code, it must hold a public
hearing in accordance with the provisions of Town Law §265, and the Municipal Home Rule Law,
and
WHEREAS, the Town Board duly held a public hearing on Monday, January 22, 2024
and heard all interested persons, and
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board hereby enacts Local Law No.: 1 of 2024 entitled, "A
Local Law to Amend Chapter 179 "Zoning" Of Queensbury Town Code to Amend Table 4:

RESOLVED, that the Town Board authorizes and directs the Town Clerk to send a copy
of this Resolution and a copy of the approved Local Law No.: 1 of 2024 to the Town Planning
Board, Town Zoning Board of Appeals, Town Zoning Administrator and the Warren County
Planning Department, and
BE IT FURTHER,

SECTION 4. This Local Law shall take effect immediately upon filing in the Office of the

(County) and for the benefit of local municipalities including the Town of Queensbury (Town),
the County has arranged for Disposal and Hauling Services for Municipal Solid Waste and
Recyclables (WC 55-23) to be available to the Town through Waste Management of New York,
LLC, and
WHEREAS, the Town Board wishes to utilize the County's contractual arrangements for
each of the Town's two transfer stations with the services to be provided and the prices for such
services identified upon the terms and conditions as set forth in the County's Agreement for such
services, and
WHEREAS, the County has presented the Town Board with a proposed Intermunicipal
Agreement which sets forth the terms and conditions upon which the Town will participate and
pay for such services with the term of the Intermunicipal Agreement to be from January 1, 2024
through December 31, 2024,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves and authorizes the
Intermunicipal Agreement between the County of Warren and the Town of Queensbury Relating
to Solid Waste and Recycling Disposal and Hauling Services (WC 55-23) with the services for
each of the Town's two transfer stations to be provided on the terms and conditions set forth in the
County's Intermunicipal Agreement, with such services to be provided by Waste Management of
New York, LLC, and

Promotion and Convention Development Agreement (Agreement) entered into between the Town
and Warren County, and
WHEREAS, the Agreement provides that specific expenditure of the funds provided under
the Agreement are subject to further Resolution of the Town Board, and
WHEREAS,the 2024 New York State High School Basketball Championships are being held
at the Cool Insuring Arena in Glens Falls in March, 2024, attracting many persons to the Queensbury
area and providing an economic boon to the community, and
WHEREAS, the Town Board wishes to provide funding to the Adirondack Civic Center
Coalition, as a host of the New York State High School Basketball Championships at the Cool
Insuring Arena, in the amount of$10,000 with occupancy tax revenues received from Warren County
and accordingly enter into an agreement with the Adirondack Civic Center Coalition, and
WHEREAS, a proposed Agreement has been presented at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes the 2024 Agreement
between the Town and the Adirondack Civic Center Coalition and authorizes and directs the Town
Supervisor to execute the Agreement substantially in the form presented at this meeting,with funding
for the Agreement in the sum of$10,000 and to be provided by occupancy tax revenues the Town
receives from Warren County,to be paid for from Account No.: 050-6410-4412, and
BE IT FURTHER,
RESOLVED that the Town Board authorizes and directs the Town Budget Officer to take all
actions necessary to amend the Town Budget and increase appropriations and revenues as necessary as
follows:

the Agreement are subject to further Resolution of the Town Board, and

Conservancy(QLC) in an amount not to exceed$30,000 with occupancy tax revenues received from
Warren County and accordingly enter into a 2024 Agreement with the QLC for the purpose of helping
to preserve open space in the Town,thereby helping to promote recreational opportunities, attracting
many persons to the Queensbury area and providing an economic boon to the area, and
WHEREAS, a proposed Agreement has been presented at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes the 2024 Agreement
between the Town and the Queensbury Land Conservancy and authorizes and directs the Town
Supervisor to execute the Agreement in substantially the form presented at this meeting,with funding

WHEREAS, by Resolution No.: 305, 2011, the Queensbury Town Board adopted its Final
Order authorizing, approving and establishing the Glen Lake Aquatic Plant Growth Control District,
and
WHEREAS, by Resolution No.: 323, 2023, the Town Board adopted the 2024 Glen Lake
Aquatic Plant Growth Control District Benefit Tax Roll, and
WHEREAS, the Town Board wishes to authorize engagement of Ready Scout, LLC Lake
Consulting & Services (Ready Scout) for the preparation and filing of New York State Department
of Environmental Conservation Applications for: 1)an Aquatic Herbicide Permit for the management
of invasive and nuisance plants in Glen Lake in 2024 for the amount of$1,900; and 2) Wetlands
Permit for the treatment of invasive plants in designated DEC wetlands, wetland check zones and
wetland buffers at Glen Lake for the amount of$2,500; for a total cost of$4,400 as delineated in
Ready Scout's December 21, 2023 letter proposal presented at this meeting,

RESOLVED, that the Queensbury Town Board hereby authorizes engagement of Ready
Scout,LLC Lake Consulting&Services for the preparation and filing of New York State Department
of Environmental Conservation Applications for: 1)an Aquatic Herbicide Permit for the management
of invasive and nuisance plants in Glen Lake in 2024 for the amount of$1,900; and 2) Wetlands
Permit for the treatment of invasive plants in designated DEC wetlands, wetland check zones and
wetland buffers at Glen Lake for the amount of$2,500; for a total cost of$4,400 as delineated in
Ready Scout's December 21, 2023 letter proposal substantially in the form presented at this meeting
contingent upon Ready Scout providing a certificate of insurance in form acceptable to the Town, and

RESOLVED, that the Town Board authorizes and directs the Town Budget Officer to pay
expenses incurred from appropriations in the Glen Lake Misc. Contractual Account No.: 051-8790-
4400 not to exceed $4,400 and/or take any actions necessary to provide for such payment, and
BE IT FURTHER,
RESOLVED,that the Town Board further authorizes and directs the Town Supervisor to sign
Ready Scout's December 21, 2023 letter proposal substantially in the form presented at this meeting,
the New York State Department of Environmental Conservation Aquatic Herbicide Permit and
Wetlands Permit Applications and/or any other submission required of the Town and further
authorizes the Town Supervisor, Town Budget Officer and/or Town Purchasing Agent to take any
and all action necessary to effectuate the terms of this Resolution.

DEPUTY TOWN CLERK MURPHY-Supervisor Report was received from Buildings and Codes
for December 2023 and is on file in the Town Clerk's Office.
6.0 PRIVILEGE OF THE FLOOR(LIMIT—4 MINUTES)
STEPHANIE BITTER, ESQ. AND STARR BAKER MOWERY, property owner-Spoke regarding
an ongoing complaint with O'Reilly's Auto Sales making their deliveries using tractor trailers as
opposed to box trucks as was the agreement with the Planning and Zoning Boards when the site was
approved. Ms. Mowery owns property on Glendale Drive in Queensbury adjacent to O'Reilly's and
has been having ongoing issues with them making deliveries with tractor trailers, parking on and
blocking Glendale Drive and delivering at all hours of the day and night disrupting the residents of
Glendale. Requested help from the Town Board assisting with posting signage to prevent tractor
trailers on Glendale and help in coming to a resolution on this issue. (The presentation was handed
out and on file in the Town Clerk's Office)
7.0 TOWN BOARD DISCUSSIONS
COUNCILMAN MCNULTY(WARD IV)
• Reported that he is still working to get a weight limit sign put on Burnt Hills Drive to eliminate
tractor trailers.
• Reported that he spoke with Spencer Montgomery about his issues with the water and trying
to get approval for a liner for one of his lakes. He has some work to do but I told him to
prepare something formal and send it to the Board to share with State Legislation that I would
support him on it. It hasn't come through yet so that is all I have on that.
• Don't forget Christmas tree pick up, I don't have the list, but they are still picking up.
COUNCILMAN DIXON(WARD III)
• Mentioned the need for future discussions on picking up Zoom meeting discussions around
Planning Boards and ZBA. Being as open as we can with Government, I think, is a good
thing. How we get there may require policy and expense review. It isn't a simple thing or an
easy process, but I think it is on our radar and a good goal.
• Confirmed that Saturday January 27 h at the Adirondack Thunder game there will be
representation from the CSEA,who's going to have several Towns, School Districts there and
they are going to conduct a job fair. I will be there if you'd like to meet me.
COUNCILMAN METIVIER(WARD 1)—Nothing to report.
SUPERVISOR STROUGH
• Reported that Angio Dynamics announced that they will likely be moving out of the Town in
the next two years, and it made me think after ESSITY and Lehigh now its three major
manufacturers out of the area.It just made me wonder if maybe we have to be more pro-active
than reactive. We've been in the reactive stage. We pride ourselves in this locality as being
the home of the medical device center and we have several medical device companies. Noted
that he wrote a letter to State Senator Dan Stec and Assemblyman Matt Simpson commenting
on the need to be more pro-active with focusing on some of our industries in trying to keep
them here. What is the issue? What can we help you with?Is there something that we need to
improve? Reported that letter was received favorably.
• Glens Falls Hospital. As most of you know, on January 5 h, 2024 we had a horrible bus
accident where we had one fatality and one serious injury so we want to thank a lot of people.
A lot of our EMS and Fire people were involved in that event. Fort William Henry, Kathy
Muncil deserves credit for opening up her place to those people that needed food and a place

to stay. All in all a lot of people were treated at Glens Falls Hospital and the Post Star I don't
know think mentioned this but the Glens Falls Hospital deserves a lot of credit for putting the
resources together to respond to the multiple calls at this particular incident. I want to thank
Glens Falls Hospital and their quality of care that they provided these individuals in this
hugely unfortunate incident.
• Recently attended three banquets, Queensbury Central Fire, West Glens Falls EMS and West
Glens Falls Fire. I love getting invited to their annual banquets not only to meet the people,
the volunteers, and paid workers,these are the people that uphold our community in the sense
that they respond to our emergencies. Three banquets down and four more to go. All
worthwhile and I wanted to thank them.
• Martin Luther King Day,there was a beautiful event that Sunday. Town Councilman Michael
Dixon, Councilman Harrison Freer and his wife Trish also attended. A lot of the local high
school students put together a very nice performance following the parade.
• Thanked Joel Barlow and Jesse Jackson for Look TV. Thank you, Mark Schachner from
Miller, Mannix, Schachner and Hafner. Thank you, Betty Murphy, Deputy Town Clerk, and
Town Board, and thank you public for coming.
