FOR PROVISION OF PROFESSIONAL ENGINEERING SERVICES RELATED TO SIDEWALK IMPROVEMENTS RESOLUTION NO.: ,2024 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Queensbury Town Board wishes to engage LaBella Associates, P.C. (LaBella) for professional engineering services associated with performing survey, design, RFP and bid document/specifications preparation services for construction of a new sidewalk along the west side of Western Avenue between Barber Avenue and Grant Avenue Extension for an amount not to exceed $17,000 as delineated in LaBella's Professional Engineering Services Proposal dated April 24, 2024 presented at this meeting, and WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and award the bid to the lowest responsible bidder(s) meeting New York State statutory requirements and the requirements set forth in the Town's bid documents/specifications to be prepared by LaBella and/or the Town Purchasing Agent, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes and directs the engagement of LaBella Associates, P.C. for professional engineering services associated with performing survey, design and RFP and bid document/specifications preparation services for construction of a new sidewalk along the west side of Western Avenue between Barber Avenue and Grant Avenue Extension for an amount not to exceed $17,000 as delineated in LaBella Associates, D.P.C.'s Professional Engineering Services Proposal dated April 24, 2024, such services to be paid for from Sidewalk Construction and Rehabilitation Capital Project No.: 250 Account No.: 250-5410-2899, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town's Purchasing Agent to publish an advertisement for bids in the official newspaper for the Town of Queensbury for the construction of the proposed sidewalks as will be set forth in bid documents/specifications to be prepared by LaBella and/or the Town Purchasing Agent, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Purchasing Agent to open all bids received, read the same aloud and record the bids as is customarily done and present the bids to the next regular or special meeting of the Town Board, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes the Town Supervisor and/or Deputy Town Supervisor to execute the Professional Engineering Services Proposal substantially in the form presented at this meeting and/or any other necessary documentation and the Town Supervisor, Deputy Town Supervisor, Town Budget Officer and/or Town Purchasing Agent to take all actions necessary to effectuate the terms of this Resolution. Please find our current project understanding, scope of services, and associated fee schedule below. Project Understanding The Town is seeking to construct a sidewalk at the above referenced location. In order to facilitate this process, LaBella will perform a survey to identify existing property and right- of-way boundaries, and will prepare an RFP for contractors to submit bids to construct the sidewalk. LaBella Associates P.C.i zo Elm Street,Suite 10o I Glens Falls,NY 12801 www.labellapc.com Scope of Services Task os - Right-of-Way and Topographic Survey Scope LaBella will complete boundary surveys of parcels 302.19-1-22,302.1g-1-23, 302.19-1-24& 302.1g-1-25 in the Town of Queensbury and parcels 302.19-6-1,302.19-6-2&302.19-6-3 in the City of Glens Falls to determine the westerly right of way of Western Avenue. (Refer to Figures 1, 2, and 3 below). The municipal boundary between the Town of Queensbury and the City of Glens Falls will be shown as approximate. All surveying will be completed in accordance with the"Code of Practice"as adopted by the New York State Association of Professional Land Surveyors. The survey will demonstrate the location and description of property boundaries, site improvements, easements and rights of way of record. LaBella will complete research which is normal to the completion of surveys completed under the above referenced code. Concurrent with the completion of the boundary survey, LaBella will complete a conventional topographic for the project site as outlined in red on "Project Details". Topographic limits will extend 15'beyond the westerly right of way of Western Avenue. The easterly topographic limits will extend to the westerly edge of the existing sidewalk or the bottom of curb. The contour interval will be 1-foot.The Horizontal datum will be based on New York State Plane Coordinates(NAD83)and the vertical datum will be based on NAVD 88 as observed from GPS observations. A minimum of 2 permanent site benchmarks will be established. Topographic survey will include structures visible at ground surface, edge of woods lines, roads, drives, and visible utilities. Underground utilities will be shown to the extent possible based on surface evidence and maps of record. LaBella will attempt to contact public utility owners and obtain existing underground utility locations within the project area. This coordination will be facilitated through the appropriate"One Call"center requesting "design mark out". However,we are increasingly finding that some utility companies will not perform mark out for design surveys. Invert elevations will be determined based on measurements taken from the surface without entering the structure. Mapping will be completed in AutoCAD Civil 3D format.The ALTA/NSPS map will have a Border with Title Block, Name of Surveyor, Map Notes and References, Legend and Site Location Map. Deliverables will be a PDF copy of signed and sealed map and an AutoCAD Civil 3D file. Assumptions and Limitations • The client will arrange for all necessary permissions to allow LaBella and their employees to enter upon the lands of others as necessary to complete this proposed project,and to save and hold harmless LaBella its agents,servants, and employees from any claims for damages for trespass on the subject premises and adjoining lands. • Boundary Survey depicts the position of boundaries with respect to existing field evidence and title information. The Boundary Survey must be based on sufficient record information and sufficient field evidence to enable LaBella to render a professional opinion as to the boundary location. This proposal and fee have been estimated with the assumption that the record information and field evidence is adequate to perform the survey. LaBella reserves the right to negotiate additional fees for this project, if the evidence is inadequate to render an opinion. • Easement mapping or descriptions are not included. 4 • Staking of missing or disturbed property corners is not included as part of this proposal. • LaBella is prepared to begin work upon authorization. It is expected that the final mapping would be available for delivery approximately three(3)weeks from authorization to proceed. In the event that we are obstructed or delayed by inclement weather,then the time therein shall be extended for a period of time equivalent to the time lost. Task 02 - Bid Documents and RFP Scope Under this task, LaBella will prepare design drawings with short form specifications on them as a basis for construction. If required, some elements of work may be further described in written specifications. The design is anticipated to include the following elements: • Sidewalk improvements, including ramps and detectable warning strips. • Tree and landscaping removal. • Erosion and sediment controls. We will provide a draft of the design plans for the Town to review and comment on. Upon receipt of comments,we will finalize the design plans. We will proceed to construction once the comments are incorporated into the design plans. Under this Task, LaBella will also develop a Request for Proposals(RFP)to solicit contractors to bid on the construction of the proposed sidewalks. Deliverables • PDF of signed and sealed design plans. Assumptions and Limitations None. 5 LJ Task o3 - Bid Phase Services Scope During the bid period, LaBella will respond to all queries from prospective bidders and prepare any necessary addenda to the Contract Documents in a timely manner. Upon completion of the bid period, LaBella will review,tabulate and evaluate the bids received.The Town will be informed of any informality in the bids and if the bids are unbalanced or non-responsive.A background check will be completed by LaBella to verify the qualifications of the lowest bidder. LaBella will provide the Town with a written recommendation for the award of a construction contract,along with the basis for this recommendation. Upon the Town's selection of the most responsive and responsible bidder, LaBella will prepare the necessary Agreements, Notice of Award and Notice to Proceed for execution by the Town and Contractor. LaBella will assist the Town and Town's counsel in verifying the adequacy of the contractor submitted agreements, bonds and insurances. Upon execution, LaBella will provide original copies of the executed construction contract to both the Town and the selected contractor. Deliverables • Bid tabulation and award recommendation. • Draft agreement between the Town and Contractor. Assumptions and Limitations • A pre-bid meeting is not included in this scope. 6 Task 04 - Construction Phase Services Scope Labella will provide the following construction administration services: • Review the contractor's shop drawings and submittals for the material and equipment to be incorporated into the project for conformance with proposed design. • Review the contractor's payment applications. • Review work change requests made by the contractor and provide the Town with recommendations on the validity of the proposed changes. • Issue a set of final record drawings based on contractor provided As-Builts,which reflect any construction phase modifications to the design drawings. We will also issue any other pertinent documents collected during construction to the Town. Deliverables • Record drawings based on Contractor as-built drawings. Assumptions and Limitations • Construction observation services are not included in this scope. • LaBella will not monitor the construction site for overall safety and LaBella's presence on the project site will not alter the contractor's obligation of being solely responsible for construction site safety. • Work under this task will be performed on a time and materials basis. LaBella will not exceed the approved budget without written authorization from the Village. Fees and Anticipated Schedule LaBella proposes to bill each task as indicated in the following table.
