Private Swimming Pools. Private swimming pools, permanent and portable, which shall be accessory to a principal , non-commercial dwelling use shall be regulated as follows: except that these regulations shall not apply to portable swimming pools which shall be not more than three (3) feet in height nor more than fifteen (15) feet in length. a) May be erected only on the same lot as the principal structure. b) May be erected only in the rear yard of such structure an.d shall be of a distance not less than twenty (20) feet from the rear lot lines or buffer zone where appropriate nor less than ten (10) feet from the side lot line, or buffer zone where appropriate principal structure or attached or detached accessory structure. c) Such use-- shall not adversely affect the character of the neighborhood. d) All private swimming pools shall be enclosed by a permanent fence of durable material at least four (4) feet in height. e) In the case where a lot fronts on two (2) or more public rights-of-way, a private swimming pool shall be erected only on that portion of the said lot that is directly adjacent to that side of the principal building which is directly opposite the architectural main entrance of said building and the neighboring side lot line. In no case shall the pool be any nearer to the lot lines abutting any public right-of-way than the required front setback for the principal building of the zoning district in which it is located. Furthermore, the pool shall be screened from the view of the public right-of-way and the neighboring property by means of landscaping. Inspection revealed that the gate lacks a self-closing device to force the gate closed as required by Section 720 .1 F of the New York State Uniform Building Code (see copy attached) . Whitney Russell, former Building Inspector had been at your residence on May 28, 1991 and on October 28, 1991 to try to close out the permit. Both slips indicate that the pool gate and deck were not complete and no further inspections were requested through this department according to our records . You must install some type of hinge or spring on the gate to comply with the above- referenced section of New York State Code, please contact this office for reinspection, so we can close out the permit . Outdoor swimming pools shall be provided with an enclosure which shall comply with the following: (a) shall be at least four feet in height and have a maximum vertical clearance to grade of two inches; (b) where a picket-type fence is provided, horizontal openings between pickets shall not exceed 4 inches; (c) where a chain-link fence is provided. the openings between links shall not exceed 2% inches; (d) enclosure shall be constructed so as not to provide footholds; (e) pickets and chain-link twists shall extend above the upper horizontal bar;and (f) such enclosure shall have railings and posts within the enclosure,which shall be capable of resisting a minimum lateral load of 150 pounds applied midway between posts and at top of posts respectively.Enclosure,fence material or fabric shall be capable of withstanding a concen- trated lateral load of 50 pounds applied anywhere between supports on an area 12 inches square, without failure or permanent deformation. Gates provided in the enclosure,shall be self-closing and self-latching with the latch handle located within the enclosure and at least 40 inches above grade.
