Attached are three maps, which show the described property. That section of Vermont Avenue which extends south of fi- Central Avenue has never been developed. A check with the Town Clerk's Office, the Town Attorney � and the Highway Superintendent verified that this parcel of land is unowned. Can file with Warren County is a map of 'Western Park", filed by Corliss Realty a'tsout 1920. Western Park was the name of the subdivision that encompasses the "States Avenues". This map clearly shows Vermont Avenue extending south of Central Avenue for about 224 feet. Evidently because previous owners did not develop their properties the road was not improved. Then back in 1963 when the Town of Queensbury measured and adopted all existing and known roads, this section of Vermont Avenue, south of Central Avenue was not measured therefore not adopted as part of it's highway system. While it would be in my best interest if the Town adopted and improved the road I realize that's not likely. I talked with Mister Naylor, the Highway Superintendent, and he has no desire to add this section of Vermont Avenue to the system. The tax map shows the three parcels of property Today's Modern Homes owns, 128-9-7, 128-9-9 and 128- 9-10- As you can see on the tax map, the only access to lot 128-9-10 is the paper street Vermont Avenue. -)(c- Which brings me to the reason for writing to you. Attached is a petition asking that the Town of Queensbury issue Today's Modern Homes a ,quitclaim deed to this property. Thank you for taking the t1ine to talk :with me about my project, on Vermont Avenue. Enclosed is some information abox:t that project. As I mentioned there are questions that need answered by the totivn which will determine the use of the land. Some of those questions are addressed here. But first some background. The enclosed tax map shows the four parcels that need subdivided. One parcel, is already on the paved section of Vermont Avenue. The other three parcels are on the unimproved section of Vermont Avenue. When purchased, I believed the lots where already subdivided into thirty (30') foot lots. Unfortunately that is not the position of the town. I also thought the town would install the read. Well now I'm a lot smarter, but not totally dejected. I have talked with engineers, attorneys and town officials. It seems that with every answer a new question arises. Enclosed is a copy of the survey man of the property in question. As you can see that section of Vermont Avenue south of Central is marked "Paper 'Street". The town of Queensbury does not claim that part of Vermont Avenue as belonging to the town. In 1963 when the roads where physically measured and adopted, that section south of Central Avenue was left an orphan. Mr. Dusek has checked the town's records and has found no deed to that property. The original map of "Western Park", as this area was known, filed with Warren County August 11, 1927, shows that Vermont Avenue was supposed to extend south of Central Avenue. However since it was not paved, nor in use, it was not adopted by the town. I believe it was merely overlooked as at least one ether paper street was adopted at that time. Being that as it may, it would surly be in my best interest to have the town correct this oversight, by adopting this part of Vermont Avenue and improving it. Another option, as explained by Mr. Dusek, would be for me to petition the town to abandon the property allowing me to develop the road or subdivide the property in another manner. If there is another option please advise me. r ��f Another area of concern is the minimum lot size. This area is zoned MR-5, there is some question as to the minimum lot size. (attached is page 43 of the zoning regulations). It says "...one (1) dwelling unit for every 5,000 S.F. of land area or one principal building for every 10,000 S.F. of land area...". Then latter it describes the "MINIMUM LOT SIZE" as 10,000 S.F., with an asterisk relating to duplex or multi- family projects. My question is, is the 10,000 S.F. lot the minimum for duplex units, or is it the minimum for single family homes? Regarding the road, is a straight dead end acceptable or will a cul-de-sac be required? Needless to say a cul-de-sac would cut into the lot sizes, but maybe that's the way it has to be. Another option is to not use the road for access, but rather have the lots run perpendicular toCentral, this would save on road construction, and road maintenance. Also attached is a rough drawing of the proposed subdivision, it shows the four tax parcels broken down into ten lots. The objective of this project is to provide affordable housing for those unable to purchase site built homes. No government subsidies are needed nor asked for. The free market capitalistic society we live in already provides the answer. Only misinformation and unwarranted fears stand in the way. I speak of manufactured homes, commonly called mobile homes. They are not "trailers" any more. They are safe, efficient and comfortable Homes. For those who have not seen these homes in the last few years I urge them to investigate this alternative. Most of the homes I sell are manufactured in Fair Haven, Vermont. A tour of the factory could easily be arranged, just call me.
