RESOLUTION ENACTING LOCAL LAW NO. _ OF 2024
TO REPEAL TOWN CODE CHAPTER 146 AND REPLACE IT WITH
NEW CHAPTER 146 "STORM SEWER SYSTEM DISCHARGES,
ACTIVITIES AND CONNECTIONS"

WHEREAS, the Queensbury Town Board wishes to incorporate certain State regulatory
amendments concerning regulation of non-stormwater discharges to municipal separate storm
sewer systems (MS4) into the provisions of Queensbury Town Code Chapter 146 entitled, "Storm
Sewer System Discharges, Activities and Connections," added to the Town Code in 2009 in
accordance with Resolution Nos: 66 and 67,2009, and
WHEREAS, proposed Local Law No. of 2024 entitled, "A Local Law Adopting Storm
Sewer System Regulations and Amending Stormwater Management Provisions of the Town Code"
has been prepared and presented at this meeting which, if adopted, would replace Town Code
Chapter 146 and update the Town's storm sewer and stormwater regulations in order to be
compliant with the current New York State Department of Environmental Conservation General
Permit for Stormwater Discharges from an MS4, GP-0-24-001, and
WHEREAS, in accordance with Municipal Home Rule Law §20, the Town Board duly
held a Public Hearing on the proposed Local Law on Monday, August 5, 2024 and heard all
interested persons,
NOW, THEREFORE, BE IT
RESOLVED, that adoption of Local Law No. of 2024 is consistent with the Negative
Declaration issued for the addition of Town Code Chapter 146 in 2009 and will not result in any
significant adverse environmental impacts, and the Queensbury Town Board hereby affirms the
SEQRA Negative Declaration, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby adopts Local Law No. of 2024, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Clerk to file
the Local Law with the New York Secretary of State in accordance with the provisions of the
Municipal Home Rule Law and acknowledges that the Local Law shall become operative
immediately and shall be effective upon filing by the office of the New York Secretary of State.
