4.12 4.12 BIDS\AWARD Bid—Gurney Lane Park Improvements—Grasshopper Gardens—Increase Capital Project—8-5-2024 RESOLUTION AUTHORIZING AWARD OF BID TO GRASSHOPPER GARDENS, INC. FOR GURNEY LANE PLAY AREA IMPROVEMENT CAPITAL PROJECT RESOLUTION NO. , 2024 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Queensbury Town Board previously established Capital Reserve No. 64 (Fund No. 64) for future capital projects and by Resolution No.: 124,2006 authorized establishment of Capital Project Fund 4157 to fund expenses associated with improvements at the Gurney Lane Recreation Area, and WHEREAS,by Resolution No.:432,2023,the Town Board authorized an increase in funding and appropriations for Parks and Recreation Department capital improvements and certain maintenance projects including those at the Gurney Lane Recreation Area/Park(Project), and WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and award the bid to the lowest responsible bidder meeting New York State statutory requirements and the requirements set forth in Town's bid documents and specifications, and WHEREAS,by Resolution No.: 103,2024,the Town Board authorized and directed the Town Purchasing Agent to publish an advertisement for bids for the Project as described in bid documents/specifications prepared by the Director and/or Town Purchasing Agent in the official newspaper for the Town of Queensbury and/or through the New York State Office of General Services Procurement Program, and WHEREAS, the Purchasing Agent published such advertisement for bids and on July 25 h, 2024, duly received and opened all bids, and WHEREAS, the Purchasing Agent and the Parks and Recreation Director (Director) have reviewed the received bids and have recommended that the Town Board authorize the bid award to the lowest responsible bidder, Grasshopper Gardens, Inc. (PPS) for a total bid amount not to exceed $271,260, and WHEREAS, Director has advised that there may be times when Change Orders may become necessary and therefore has requested authorization to approve and sign certain Change Orders up to a five-percent (5%) contingency ($13,500) for Change Orders that he deems necessary or appropriate, and WHEREAS, by Memorandum dated July 30, 2024, the Director advised the Town Board that he anticipates that an approximately $292,510 budget increase for the Project is needed, and WHEREAS, in accordance with New York State General Municipal Law §6(c), the Town Board is authorized to withdraw and expend funds from Reserve 464 subject to permissive referendum, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby accepts and awards the bid for the Gurney Lane Play Area Improvements Capital Project(Project)from the lowest responsible bidder, Grasshopper Gardens, Inc., for a total bid amount not to exceed $271,260, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes the Parks and Recreation Director to approve and sign Change Orders up to a five-percent(5%) contingency or in the total amount not 2 exceeding $13,500 that he deems necessary or appropriate, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs that payments for such Project up to the total of$312,510 shall be from the Gurney Lane Capital Construction Account No.: 157-7110-2899, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes a$312,510 transfer from Reserve No.: 64 to Gurney Lane Capital Construction Account No.: 157-7110-2899 and in the event that there are funds remaining in such Fund after completion of the Project or in the event that the Project is not undertaken,the moneys in such Fund shall be returned to the Reserve, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to amend the Town Budget and increase appropriations and revenues as follows: • Revenue Acct No. — 157-0000-55031 (Interfund Revenue) - $312,510; • Expense Acct No. — 157-7110-2899 (Capital Construction - $312,510; • Increase Appr 001-9950-9030-0064 Transfer to Cap Project- $312,510; and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor/Deputy Town Supervisor to execute any needed Agreement between the Town and Grasshopper Gardens,Inc.,and/or any other needed documentation in form acceptable to the Town Supervisor/Deputy Town Supervisor, Parks and Recreation Director, Town Budget Officer and/or 3 Town Counsel and authorizes and directs the Town Supervisor, Purchasing Agent, Parks and Recreation Director and/or Town Budget Officer to take any actions necessary to effectuate this Resolution, and BE IT FURTHER, RESOLVED, that this Resolution is subject to a permissive referendum in accordance with the provisions of Town Law Article 7 and the Town Board hereby authorizes and directs the Town Clerk to publish and post such notices and take such other actions as may be required by law.
