4.14 WASTBWATBR\Greater Qby Consolidated Sanitary Sewer Bxt#6—674 Quaker Road—Barrett-Set Public Hearing—8-5-2024 ORDER SETTING PUBLIC HEARING CONCERNING PROPOSED EXTENSION #6 TO GREATER QUEENSBURY CONSOLIDATED SANITARY SEWER DISTRICT TO SERVE 674 QUAKER ROAD RESOLUTION NO.: ,2024 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Town of Queensbury wishes to extend the Greater Queensbury Consolidated Sanitary Sewer District(GQCSSD)to serve a commercial property owned by James E. Barrett (Property Owner) and located at 674 Quaker Road in the Town of Queensbury, New York (Tax Map No.: 303.15-1-13) referred to as the "Property" in accordance with New York Town Law Article 12-A, and WHEREAS, a Map, Plan and Report has been prepared by RU Holmes Engineers, PLLC (Map, Plan and Report) concerning proposed Sanitary Sewer District Extension 46 (Extension 46) to connect the Property to the existing GQCSSD as more specifically set forth and described in the Map, Plan and Report, and WHEREAS, the Map, Plan and Report has been filed in the Queensbury Town Clerk's Office and is available for public inspection, and WHEREAS,the Map,Plan and Report delineates the boundaries of the proposed Extension 46, a general plan of the proposed system, a report of the proposed method of operation, all outlets and the terminus and course of each proposed main sewer or drain together with the location and a general description of all sewage disposal plants, pumping stations and other public works, if any, and is consistent with, so far as possible, any comprehensive plan for sewers developed and maintained pursuant to General Municipal Law §99-f, and WHEREAS, Part I of a Short Environmental Assessment Form has been prepared and presented at this meeting and the engineer has indicated that it is an Unlisted Action and the Action will undergo an Uncoordinated Review, NOW, THEREFORE, IT IS HEREBY ORDERED: 1. The boundaries of the proposed Extension 46 are as set forth in the Map, Plan and Report and as follows: All that certain piece or parcel of land situate, lying and being in the Town of Queensbury, County of Warren, and the State of New York, more particularly bounded and described as follows: BEGINNING at an iron rod found in the southerly bounds of Quaker Road, being the northwest corner of the lands as conveyed to TWAS Quaker Road LLC by deed book 6320 at page 67; thence running in a southerly direction, along the westerly bounds of TWAS, the following three courses and distances: 1.) South 31 degrees, 02 minutes, and 07 seconds West, a distance of 300.00 feet to an iron rod; thence 2.) South 09 degrees, 57 minutes, and 37 seconds West, a distance of 471.37 feet to apoint; thence 3.) Along a curve to the left, having a radius of 50.00 feet, for a distance of 78.54 feet to a capped iron rod found in the northerly bounds of Dix Avenue; thence continuing in a westerly direction, along the northerly bounds of Dix Avenue,North 80 degrees,02 minutes, and 23 seconds West, a distance of 150.00 feet to a point marking the southeast corner of the lands as conveyed to Garvey Sisters, LLC by deed book 6498 at page 103; thence continuing in a northerly direction, along the bounds of Garvey Sisters, LLC the following five courses and distances: 2 1.) North 31 degrees, 02 minutes, and 07 seconds East, a distance of 366.18 feet to a point in the southerly bounds of Quaker Road; thence continuing in an easterly direction, along the southerly bounds of Quaker Road, the following four courses and distances: 1.) South 49 degrees, 11 minutes, and 13 seconds East, a distance of 79.39 feet to a concrete monument; thence 2.) South 64 degrees, 39 minutes, and 03 seconds East, a distance of 86.57 feet to a concrete monument; thence 3.) South 58 degrees, 57 minutes, and 53 seconds East, a distance of 104.88 feet to an iron rod; thence 4.) South 58 degrees, 57 minutes, and 53 seconds East, a distance of 285.00 feet to an iron rod marking the place and point of beginning, containing 5.16 acres of land to be the same more or less. Bearings given in the above description refer to Grid North. SUBJECT to easements of record. 3 2. The new sewer system facilities necessary to serve the Property will connect to the GQCSSD sanitary collection system via a municipal sanitary manhole located on the south side of Dix Avenue (County Rt. 42)near the intersection of Dix Avenue and Barrett Drive. The sanitary manhole discharges to an 8"0 gravity sanitary sewer line that flows to the west northwest along Dix Avenue to the municipal boundary with the City of Glens Falls. At the City line the GQCSSD collection system discharges to the City of Glens Falls sanitary sewer collection system. The existing on-site septic tank and leaching system presently serving the property are proposed to be abandoned/demolished in place and replaced with a new 6"0 sanitary sewer connecting to the existing building sanitary outfall located on the west side of the building. The new 6" sanitary sewer would drain to the south parallel to the west side of the building to a new on-site sanitary pump station to the south of the existing parking lot. A new duplex sanitary pump station is proposed to be installed along the south side of the existing parking lot south of the building. A small diameter HDPE sanitary force main would run from the proposed pump station to the south along the east side of Barrett Drive to the intersection with Dix Avenue. 3. The facilities for this Sanitary Sewer District Extension 46 to be constructed and capital costs associated with this Extension 46 are estimated to be approximately $143,000+/- to be paid for by the Property Owner. The cost of hook-up and permit fees is estimated to be $2,503.28. There will be no construction costs to the Town. The Property Owner will be required to maintain all of its sewer infrastructure to the point of connection to the existing sewer main. No dedication of infrastructure will be necessary for this Extension 46. 4. The estimated annual cost of the Extension 46 to the Property will be calculated as detailed in the Map, Plan and Report filed in the Town Clerk's Office and also available on the Town of Queensbury Website: www.queensbury.net. There is no "typical property" which is a one or two family home in such proposed District as the one commercial lot/subject property is the only property in this Extension 46 and the "typical property." The cost of operation and maintenance would include the costs to operate, maintain, and supply the sewer system and is reflected in sewer rent charges. Based on an estimated annual usage of 89,000 gallons per year and an existing operation and maintenance rate of$7.00 per 1,000 gallons, the Property's yearly 4 amount would be $623 per year,paid quarterly. The Town also imposes a property's share of the Greater Queensbury Consolidated Sanitary Sewer District's debt service using a benefit tax. The estimated units are 33.95 total x $21.9115/Unit resulting in an estimated benefit tax of $743.90. The calculation of $623 in sewer rents annually plus the $743.90 in benefit tax would come to approximately $1,366.90 annually. This Property is the only property in this Extension 46 so it is the mode/typical property. 5. The Property Owner will pay all costs of the improvements including the one-time buy-in cost and Town connection fee, so there will be no financing required by the Town on behalf of the District or otherwise. 6. A detailed explanation of how the estimated costs of the Extension 46 were computed is included in the Map,Plan and Report which has been filed with the Queensbury Town Clerk and is available for public inspection. 7. The proposed improvements shall be constructed and installed as specifically delineated in the Map, Plan and Report and in full accordance with the Town of Queensbury's specifications, ordinances or local laws, and any State laws or regulations, and in accordance with approved plans and specifications and under competent engineering supervision. 8. The Town Board shall meet and hold a public hearing at the Queensbury Activities Center, 742 Bay Road, Queensbury at 7:00 p.m., on Monday, September 9 h, 2024 to consider the Map, Plan and Report and to hear all persons interested in the proposal and to take such other and further action as may be required or authorized by law. 9. The Town Board hereby authorizes and directs the Queensbury Town Clerk to duly publish and post this Order not less than ten (10) days nor more than twenty (20) days before the public hearing date, as required by Town Law §209-d, and complete or arrange for the securing of two(2)Affidavits of Publication of Notice and two(2)Affidavits of Posting of Notice of the Public Hearing required hereby and to file a certified copy of this Order with the State Comptroller on or about the date of publication. 5 10. The Town Board hereby declares that this action is an Unlisted Action pursuant to 6 NYCRR 617 et. seq., and will perform uncoordinated review of this Project.
