4.12 4.12 FINANCIAL\2024\PURCHASE—Cemetery—Asphalt Paving Materials—Peckham-Piggybacking Warren County—Transfer Capital Reserve 64 Perm Referendum—9-9 RESOLUTION AUTHORIZING ASPHALT PAVING WORK AT PINE VIEW CEMETERY BY PECKHAM INDUSTRIES, INC. RESOLUTION NO.: ,2024 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the New York State Legislature adopted legislation allowing any political subdivision in New York State to"piggyback"off an existing County Bid, and WHEREAS,the Town of Queensbury's Cemetery Superintendent has requested Town Board approval to engage Peckham Industries,Inc. (Peckham)for additional asphalt paving work at the Pine View Cemetery by the Town"piggybacking"with Warren County in accordance with Warren County Heavy Highway Construction Bid#WC 62-21 as set forth in Peckham's Hot Mix Asphalt Pavement Estimate dated 8/29/2024 for an amount not to exceed$141,896.10, and WHEREAS, in accordance with New York State General Municipal Law §6(c), the Town Board is authorized to withdraw and expend funds from Capital Reserve 464 subject to permissive referendum and the Town Board wishes to approve this work, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board approves and authorizes engagement of Peckham Industries,Inc. (Peckham)for asphalt paving work at the Pine View Cemetery by the Town "piggybacking" with Warren County in accordance with Warren County Heavy Highway Construction Bid #WC 62-21 as set forth in Peckham's Hot Mix Asphalt Pavement Estimate dated 8/29/2024 in the form substantially presented at this meeting for an amount not to exceed$141,896.10 to be paid from Misc. Contractual Account No.: 002-8810-4400, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes a $141,900 transfer from Capital Reserve No.: 64 to Misc. Contractual Account No.: 002-8810-4400, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to amend the Town Budget and increase appropriations and revenues as follows: • Revenue Acct No. —002-0000-55031 (Interfund Revenue) - $141,900; • Expense Acct No. —002-8810-4400 (Misc. Contractual - $141,900; • Increase Appr 001-9901-9128-0064 Transfer to Operating Funds - $141,900; and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor/Deputy Supervisor, Cemetery Superintendent and/or Budget Officer to sign any needed documentation and take any other actions necessary to effectuate the terms of this Resolution, and BE IT FURTHER, RESOLVED, that this Resolution is subject to a permissive referendum in accordance with the provisions of Town Law Article 7 and the Town Board hereby authorizes and directs the Town Clerk to publish and post such notices and take such other actions as may be required by law.
