PRESENTATION
SUPERVISOR STROUGH introduced Mark Donahue Chairman of the Adirondack Balloon
Festival who expressed his gratitude for all that Supervisor Strough does for the Balloon
Festival. Mr. Donahue thanked the Town of Queensbury and presented Supervisor Strough with
a custom sign from the Adirondack Balloon Festival Board and Committee for 50 years of
sponsorship along with their other sponsors over 50 years, Glens Falls National Bank and
Whiteman Chevrolet.
SUPERVISOR STROUGH introduced Chris Harrington, Water Superintendent and Director of
Wastewater wanted to give a public announcement that we are doing a lead service line inventory
for lead pipes still being used. We are hanging pink door hangers at houses that need to be
inventory. Please help us inventory the service that comes into your home. The inventory is due
by October 16''. I want to thank everyone that has helped with this mandate. I want to thank the
public.

1.1 Public hearing—Sewage Disposal Variance Application of Steven Rowe

Supervisor Strough reviewed the application asking for three variances. It is listed as a four-
bedroom house but want to replace it with a three-bedroom house. If the Town Board is inclined
to approve this tonight. I cannot speak for them we will condition our approval based on the
Boards approval of the new structure which would be three-bedrooms. Okay, Town Counsel?
TOWN COUNSEL SCHACHNER-Okay, okay, if you want to.
SUPERVISOR STROUGH-Okay, so like I said we are putting in a leach field and it is already in
a high raised position. It is not a parking area. I think it is the perfect spot for it but introduce
yourself and feel free to elaborate on anything I said?
BOB HOLMES-Good evening, my name is Bob Holmes with Holmes Engineers on behalf of
Steven Rowe. Mr. Supervisor, I think you summarized the project quite well. One item just a
note on that is the existing septic tank we plan to reuse because we have found it to be in good
condition, appropriate size. We will be adding a small chamber adjacent to it for an effluent
filter just for further removal of solids from the waste stream. You had asked a question at our
on-site meeting today, what would this system work as if it was for four-bedrooms? I did a bit of
research when I returned to my office after the on-site meeting and utilizing the Eljen in drain,
New York State designing, this is specifically from the manufacturer for replacement systems
they do allow an accelerated application rate when it comes to sizing the system. That if we use
the manufacturers recommended accelerated application rate the system I have designed would
work for four-bedrooms. But bear in mind the way we have it designed right now, straight up
meets New York State Department of Health standard meets the current Town standard. And in
my discussions with my clients and our discussions on-site that yes, we think it is prudent that
the Board wishes to place a restriction or condition on the approval that all other approvals for
redevelopment on the property must be obtained before anything can be done.
SUPERVISOR STROUGH-Also, to summarize you are saying the system that you designed
would be suitable for a four-bedrooms.
MR. HOLMES-Correct.
SUPERVISOR STROUGH-But you have no problem with us conditioning...

SUPERVISOR STROUGH-It on approval of the new house which would be three-bedrooms.

COUNCILMAN DIXON-I just have a comment, John. So, when we do get to the point of the
Resolutions since you are keeping, you said you are keeping the existing 1,000-gallon septic
tank. Let's see but you also had a stipulation in there if deficiencies are found during an
inspection the existing septic tank will be replaced with a new 1,250-gallon dual compartment
septic tank. Is that something we should put in the Resolution here as well to just so there is
clarification that the 1,000-gallon septic tank is to remain?

1. 2'±from the north property line in lieu of the required 10' setback;
2. 4'±from the east property line in lieu of the required 10' setback;
3. 84'±from the Glen Lake shoreline in lieu of the required 100' setback;
on property located at 59 Barber Road in the Town of Queensbury, and
WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's
official newspaper and the Local Board of Health duly conducted a public hearing concerning the

or other adjoining properties nor otherwise conflict with the purpose and objectives of
any Town plan or policy; and
2. the Local Board of Health finds that the granting of the variances is necessary for the
reasonable use of the land and are the minimum variances which would alleviate the
specific unnecessary hardship found by the Local Board of Health to affect the
Applicants; and

need an extension to do so. I will open the public hearing.

SUPERVISOR STROUGH-Okay, the first one is basically to do SEQRA. The State
Environmental Quality Review and I did not want the Town Board, we got Part I completed. It
has been a matter of public record. But I do not want the Town Board to do Part II because
sometimes the public gives us information that we did not know and would be important as we
do Part II of the SEQRA review. So, and then the second part of this 2.113, is approving the
extension of the Sewer System to the Barrett Auto place. Okay, so I figured I would just have
one public hearing. I will open the public hearing. Is there any member of the public that wishes
to speak to this Consolidated Sanitary Sewer District Extension? Seeing none I will close the
public hearing.
PUBLIC HEARING CLOSED
SUPERVISOR STROUGH- I did not think anybody would have any excitement over this.
Town Counsel and Town Board has reviewed we have had it for a while and I know you have
reviewed it Part I. So, we are going to do Part II of the Short Environmental Assessment Form
and Town Counsel would you please lead us through that since you are one of the State
authorities on SEQRA anyways.
TOWN COUNSEL SCHACHNER-I do not think that is critical right this minute but that is fine.
So, what is critical is that at some point you need to get Part I of the Environmental Assessment
form dated and signed.
SUPERVIOSR STROUGH-Oh, okay.
TOWN COUNSEL SCHACHNER-Let's make note of that. And we are going through as
Supervisor said the Short Environmental Assessment Form which has excuse me only ten
questions on it. Each question has two choices of answers. One is a No or Small Impact may
occur, second choice is in a Moderate to Large Impact may occur. The impacts we are talking
about are potential Environmental Impacts.

1. Will the proposed action create a material conflict with an adopted land use plan or
zoning regulation? NO
2. Will the proposed action result in a change in the use or intensity of use of land? NO

SUPERVISOR STROUGH-No, and again when we say No, I want to point out there maybe a little
impact. We are not saying no, there is no impact. The other option is a Moderate to Large Impact.
So,we just said no but some people I think I am reading your mind. It is going to have an impact on
sewer, yeah it will but the impact would be relatively small and that is part of our no response. So,
this is a Negative SEQRA and that is tied in with our Resolution. So, let's do 2.1 A first which is the
SEQRA we just did.
COUNCILAMAN DIXON-John,can I just make a quick comment because I always just like to make
note of it. When we did section 1, the applicant had filled it out is the project site any portion of it
located in or adjacentto an area designated as sensitive for archaeological sites on the New York State
Historic Preservation Office and that answered yes. I will tell you just about everything that comes
in front of Queensbury that is always marked yes,but certainly not a significant concern.
SUPERVISOR STROUGH-Well, and that is largely due to the fact that we had a huge Native
American presence here. A huge part of the French and Indian War was fought here because we were
on that what I call the great war path. It was almost all a water route from the Atlantic Ocean into
interior Canada. You had the Hudson River; you had a short carry of about fourteen miles to Lake
George. And then you had the Lachuete River, and it carried to Champlain. And the Richelieu River
into the St. Lawerence almost an all-water route. And before roads you can imagine it is a whole lot
easier to take a boat or a canoe than try and deal with the woods and the terrain and everything else.
So,this was a major path,even the Native American,well they established it really thousands of years
before the Europeans came. And then when the Dutch came fur traders used the same route and then
when tensions became kind of nasty between the Canadians, the French and the Colonies the British
if you will. Whoever had control of that little fourteen-mile carry between the Hudson River and
Lake George, you controlled the whole pathway. The only other way of getting there, and it was
brutal was to go up to Fort Ann and catch Woods Creek. But you know if you take a look off of
Route 4, you can see it is almost all swamp and that is just not fun to travel through. So, taking the
Lake George Route was so much preferable and I could get into more of this if you want me to. I
could go on for a long time, but we won't. Okay,be thankful. All right, so let's vote on 2.1A.

46, a general plan of the proposed system, a report of the proposed method of operation, all outlets
and the terminus and course of each proposed main sewer or drain together with the location and
a general description of all sewage disposal plants, pumping stations and other public works, if
any, and is consistent with, so far as possible, any comprehensive plan for sewers developed and
maintained pursuant to General Municipal Law §99-f, and
WHEREAS, on August 5�', 2024 subsequent to the filing of the Map, Plan and Report with
the Town Clerk,the Town Board adopted an Order(Public Hearing Order)reciting(a)the boundaries
of the proposed Extension 46; (b)the proposed improvements; (c)the maximum amount proposed to
be expended for the improvements; (d)the fact that all costs of the improvements will be paid for by
the Developer and not the Town of Queensbury; (e) the estimated cost of hook-up fees (if any) and
the estimated annual cost of Extension 46 to the developed Property in Extension 46; (f)the proposed
method of financing to be employed; (g) the fact that a Map, Plan and Report describing the
improvements is on file in the Town Clerk's Office; and(h)the time and place of a public hearing on

WHEREAS, the Town Board duly held a public hearing on proposed Extension 46 on
Monday, September 9 h, 2024 and considered the evidence and information, and
WHEREAS, the Town Board has considered the establishment of the Extension 46 in
accordance with the provisions of the State Environmental Quality Review Act and has adopted a
Negative Declaration concerning environmental impacts, and
WHEREAS, the Town Board wishes to establish proposed Extension 46 in accordance with
Town Law Article 12-A,
NOW, THEREFORE, BE IT
RESOLVED,that the Queensbury Town Board hereby determines that:
I. Notice of Public Hearing was published and posted as required by law and is otherwise
sufficient;
2. All property and property owners within the Extension 46 are benefited thereby;
3. All property and property owners benefited are included within the limits of the
Extension;
4. It is in the public interest to establish, authorize, and approve the Greater Queensbury
Consolidated Sanitary Sewer District Extension 46 to the Greater Queensbury Consolidated Sanitary
Sewer District as described in the Map, Plan and Report on file with the Queensbury Town Clerk
with the boundaries and benefited properties of the Extension 46 to be as described in the Map,Plan
and Report and Public Hearing Order; and
BE IT FURTHER,
RESOLVED, that the Town Board hereby approves, authorizes and establishes the Greater
Queensbury Consolidated Sanitary Sewer District Extension 46 in accordance with the boundaries
and descriptions set forth above and in the previously described Map, Plan and Report and Public
Hearing Order and construction of the improvements may proceed and service provided subject to
the following:
I. The obtaining of any necessary permits or approvals from the New York State
Department of Health;
2. The obtaining of any necessary permits or approvals from the New York State
Department of Environmental Conservation;
3. The obtaining of any necessary permits or approvals from the New York State
Department of Transportation and any other required permits;

WHEREAS,a six-foot culvert over the Glen Lake outlet/stream on Tee Hill Road in the Town
of Queensbury near its intersection with Moon Hill Road recently failed resulting in the closure of
Tee Hill Road from the Moon Hill Road entrance and the culvert must be removed and an
approximately replacement 40 foot bridge must be built and installed before Tee Hill Road may
be completely reopened (Project), and
WHEREAS, Tee Hill Road is an important thoroughfare and is an invaluable route for Fire,
Emergency Services and Police personnel and its closure threatens public safety due to increased
response times for and potentially dangerous limits on such Fire, EMS and Police personnel, and

WHEREAS, Tee Hill Road is also an important school bus route for the Lake George and
Queensbury Union Free School Districts and its closure has resulted in increased busing time and
longer commutes for young children as a result of extensively redirected busing routes, and
WHEREAS, the Town Supervisor accordingly has declared this Project an emergency in
accordance with New York State Executive Law Section 24, and
WHEREAS, this essential emergency Project must be commenced and completed as soon
as possible before the arrival of poor weather conditions and inclement winter weather compounds
the situation, and
WHEREAS, the Town Supervisor sought and engaged the services of 1) Kubricky
Construction (TKC) as General Contractor for the Project; and 2) LaBella Associates, D.P.C.
(LaBella) for professional engineering services (collectively referred to as the "Emergency Repair
Services"), such Emergency Repair Services sought and provided on an emergency basis for public
health and safety reasons, and
WHEREAS, the Town may also need to obtain Temporary Easements from the Glen Lake
Protective Association regarding access to their property to complete the Project, and
WHEREAS,the Town Board hereby determines that the Emergency Repair Services for this
Project constitutes an emergency procurement needed to best serve the Town's residents and protect
public health and safety and therefore the Town Board wishes to waive its requirement under General
Municipal Law §103 and the Town Purchasing Policy's self-imposed requirement for two written(2)
quotes for the needed Professional Engineering Services in this instance, and
WHEREAS, such Project may be authorized in accordance with General Municipal Law
§103, and
WHEREAS, the Town Board wishes to establish a Capital Project to provide for this
Project and authorize withdrawals and expenditures in the amount of $750,000 from the Town's
General Fund Unappropriated Undesignated Fund Balance Account No.: 001-0000-0909,

RESOLVED, due to the emergency nature of the Tee Hill Road Culvert Replacement Capital
Project and in this circumstance, the Queensbury Town Board hereby waives its requirement under

CONNIE GOEDERT-11 Centennial Drive, spoke regarding the 8,000 people who will be at the
Queensbury School this Saturday for a Cross-Country Meet.
7.0 TOWN BOARD DISCUSSIONS
COUNCILMAN METIVIER (WARD I)
• Nothing to report.
COUNCILMAN DIXON (WARD III)
• Congratulations to Mark Donahue and the Adirondack Balloon Festival and what they do
for the Town of Queensbury.
• Mentioned that Harrison Freer's service was beautiful and will be dearly missed.
• Toured the Cemetery with Connie Goedert and discussed what will be happening in the
future. We may have to add another Crematorium so there will be no delays with the
ageing population. Connie mentioned adding another access road.
COUNCILMAN MCNULTY (WARD IV)
• Mentioned another accident this morning on Corinth and Carey Road. A head on
collision. I have contacted Supervisor Gerahty and Kevin Hajos for help with
implementing the Corinth Traffic Study. The cost is $21 Million dollars and would go to
exit 18. The next step is for the County to acknowledge that improvements need to be
made. Once that is a formal record, I have talked with Congresswoman Stefanik's office,
and she will try to find some money. We need a County Resolution to implement the
study. We need do something there.

0 Received a card for the Town Board from Harrison Freer's Family.

• Received a card from North Queensbury Volunteer Fire Department thanking us for our
support well deserved for Harrison Freer and our sympathies.
• Requested a speed reduction on Tuthill Road we would like it to be 30 and it is 40 and
were rejected by the State. Town's over 50,000 can set their own speed limits but
Queensbury is 30,000.
• Received complaints from residents that live on Clark Road about a dilapidated shed
• Announced that there is a Queensbury Monopoly game.
• Thanked Joel Barlow, Jesse Jackson, Look TV, Town Counsel Mark Schachner, Deputy
Town Clerk Colleen Rathbun, Town Board, and the members of the public for attending.
