SUPERVISOR STROUGH-One thing I want to announce to the public that the Town Board has
received the Tentative Budget tonight so they will get a chance to review it, and I just announced
that they have it. The second announcement is Councilperson McNulty would like to say a little
something and then we'll carry on with the regular agenda so.
COUNCILMAN TIMOTHY MCNULTY- Thank you Supervisor Strough. Where jealousy and
selfish ambition exist, there is disorder in every vile practice. The Resolution introduced at our
September nineth meeting called for the orderly filling of the vacancy on the Town Board, a
process this Board has successfully followed three times over the past four years. Nothing more
and nothing less. Unfortunately, some have demonized this orderly transition with baseless
accusations of corruptions, gross negligence and even personal attacks. Those and those who
propagated these inane arguments should be ashamed of themselves for misrepresenting both
themselves and the process of filling vacancies. However, this reflects our current political
climate, even here in little old Queensbury where truth and precedent seem to matter less than
the distortion of facts. While we still believe appointing an interim fill is the right thing to do for
the Ward H residents to avoid further strife and to have the Town move forward and to focus on
the two candidates in the election, we will not be forwarding or moving forward on the
Resolution to appoint an interim fill for the Ward H vacancy. Thank you.

SUPERVISOR STROUGH reviewed the proposed sewage variance application and the five
variances being requested. So, we have the applicant's agent before us tonight,please introduce
yourself and feel free to expand on anything I just said.
NICK ZEGLEN-Yes, good evening, Nick Zeglen with Environmental Design Partnership here
tonight on behalf of the applicant Jeff and Emilee Greenhouse. Yes, so this is a replacement
wastewater project. the current wastewater system is a seepage pit that failed inspection so, so
we proposed the, an alternative system that'll have an ETU that flows to a pump, pump tank
which then pumps up the hill 100 feet away from the Lake to a stone absorption bed. So new
technology greatly increasing the wastewater capacity in getting it up to code so overall a big
positive for the property.

provisions of the Town of Queensbury On-Site Sewage Disposal Ordinance, Chapter 136 to install a
wastewater replacement system with certain of the components to be installed as follows:
1. Absorption field to be located 0' from the property line in lieu of the required 10'
setback;
2. Absorption field to be located 13'from the dwelling in lieu of the required 20' setback;
3. Wastewater tanks to be located 0'from the dwelling in lieu of the required 10' setback;
4. Wastewater tanks to be located 0' from the property line in lieu of the required 10'
5. Force main to be located 1' from the dwelling in lieu of the required 10' setback;
on property located at 364 Cleverdale Road in the Town of Queensbury, and
WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's
official newspaper and the Local Board of Health duly conducted a public hearing concerning the
variance requests on Monday, September 23rd, 2024, and
WHEREAS, the Town Clerk's Office has advised that it duly notified all property owners
within 500 feet of the subject property,

RESOLVED,that
1. due to the nature of the variances, the Local Board of Health determines that the
variances would not be materially detrimental to the purposes and objectives of this
Ordinance or other adjoining properties nor otherwise conflict with the purpose and
objectives of any Town plan or policy; and
2. the Local Board of Health finds that the granting of the variances is necessary for the
reasonable use of the land and are the minimum variances which would alleviate the
specific unnecessary hardship found by the Local Board of Health to affect the
Applicants; and

MR. KEMPF-The only question that I had was on the actual, once, once these amounts are
approved in terms of the actual work that's done who actually decides what gets done with the
money? Is that the Glen Lake...Association.
SUPERVISOR STROUGH-The Advisory Committee makes a recommendation to the Town
Board and it's up to us to approve it or not. Generally, we have great trust for the Advisory
Committee for Glen Lake, and we approve generally what they want to do. It's their money but
we do control it. That's the way that New York State Government works. Does that answer your
question?
MR. KEMPF-But who is the Advisory Committee?
SUPERVISOR STROUGH-The Advisory Committee is for the most part and Paul Derby's here,
he might be able to explain, but you know are you a member of the Glen Lake Protective
Association?
MR. KEMPF-Yes, yes.
SUPERVISOR STROUGH-Most of the members of the Advisory Committee are also on that
group too. So...

PAUL DERBY-Paul Derby, Glen Lake, I'm also Chair of the Advisory Committee so yes Mr.
Kempf I have got your letters and some of the other things so I first strongly encourage you to a,
we have an Association meeting tomorrow night, Tuesday night at seven o'clock at the Warren
County Municipal Center and we will be discussing 2025 plant management. So, it's a good
place to go for that. And just for your information the Advisory Committee is made up of
residents who are on different parts of the Lake, and they currently are myself, Pam Sembrook
who's on the West side, Margaret Wallace, who's also here tonight at the...head, Paul
McPhillips on the East side, Michelle Mayer near Barbers Bay.
SUPERVISOR STROUGH-And thank you and not only do you have to receive the Town
Board's permission to go ahead with it, but we deal with the DEC as well.
MR. DERBY-Correct and this year we have a lot of pond weed so we're going to have to do
some type of management for next year.

Queensbury Town Board has prepared the 2025 South Queensbury —Queensbury Avenue Sanitary
Sewer District Benefit Tax Roll assessing the expense of district improvements of general sanitary
sewers located in the South Queensbury—Queensbury Avenue Sanitary Sewer District and bled the
completed Tax Roll in the Town Clerk's Office, and
WHEREAS,the Town Clerk posted and published the required Notice of Public Hearing,and
WHEREAS, the Town Board duly conducted a public hearing on Monday, September 23rd
2024 and heard all interested persons,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves, confirms and adopts the
2025 South Queensbury—Queensbury Avenue Sanitary Sewer District Benefit Tax Roll for payment
of public improvement expenses within the District in accordance with New York State Town Law
§202 and§202-a at the following rate:

purchase of a generator to service Town Hall and the Activities Center and an advertisement for bids
for installation of the generator, and
WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and
award the bid to the lowest responsible bidder, and

WHEREAS, the Town Purchasing Agent opened all received bids on August 30"', 2024 and
with the Town Facilities Manager and LaBella Associates,reviewed the bids and have recommended

the amount of $110,700 as set forth in Stilsing's Bid Form dated 8/29/2024 presented at this
meeting, and
WHEREAS, the Town Board concurs with this recommendation, and
WHEREAS,the Town Board wishes to authorize a withdrawal and expenditure in the amount
of$110,700 from Capital Reserve No. 64 toward this Capital Project, and
WHEREAS, in accordance with New York State General Municipal Law §6(c), the Town
Board is authorized to withdraw and expend funds from Reserve 464 subject to permissive
referendum,

RESOLVED, that the Queensbury Town Board hereby accepts and awards the bid for the
generator installation Project(Project) from the lowest, responsible bidder, Stilsing Electric, Inc.,
for the amount of$110,700 as set forth in Stilsing's Bid Form dated 8/29/2024 substantially in the
form presented at this meeting to be paid from Capital Construction Account No.: 203-1620-2899,
and

RESOLVED, that the Town Board hereby finds that the withdrawal and expenditure for this
Project are expenditures for a specific capital project for which the Capital Reserve Fund 464 was
established and therefore authorizes and directs the transfer of$110,700 from Capital Reserve Fund
464 to Capital Construction Account No.: 203-1620-2899, and

RESOLVED that the Town Board further authorizes and directs the Town Budget Officer
to take all actions necessary to amend the Town Budget and increase the following appropriations

Town's receipt of occupancy tax revenues from Warren County in accordance with the Local Tourism
Promotion and Convention Development Agreement (Agreement) entered into between the Town
and Warren County, and
WHEREAS, the Agreement provides that specific expenditure of the funds provided under
the Agreement are subject to further Resolution of the Town Board, and
WHEREAS, the Town of Queensbury received a request for funding from the Queensbury
Union Free School District(School)to assist in funding multiple New York State Public High School
Athletic Association events including the Queensbury Invitational, Foothills Council and Section 2

$28,000 with occupancy tax revenues received from Warren County and accordingly enter into an
agreement with the School as presented at this meeting,

RESOLVED, that the Queensbury Town Board hereby approves and authorizes the Local
Tourism Promotion and Convention Development Agreement between the Town and the Queensbury
Union Free School District and authorizes and directs the Town Supervisor to execute the Agreement
in substantially the form presented at this meeting with funding not to exceed $28,000 and to be
provided by occupancy tax revenues the Town receives from Warren County, to be paid from
Account No.: 050-6410-4412, and

actions necessary to amend the Town Budget and increase appropriations and revenues as necessary as

WHEREAS,the Town of Queensbury is a regulated municipality under the NYS Department
of Environmental Conservation Municipal Separate Storm Sewer System Program (MS4 Program),
which MS4 Program regulations help protect and improve the quality of public water bodies, and to
comply with State requirements, in 2009 the Town Board added Chapter 146 "Storm Sewer System
Discharges, Activities and Connections"to the Town Code, and
WHEREAS, to assist implementation of Town Code Chapter 146, the Town Board has
authorized annual MS4 Stormwater Management Services Agreements with the Warren County Soil
and Water Conservation District(District), and by Resolution 270,2024,the Town Board adopted an
updated MS4 Stormwater Management Program Plan as presented by the District, and
WHEREAS,by letter proposal dated September 17, 2024,the District has proposed to renew
its MS4 Stormwater Management Services Agreement through December 31, 2027 and the Town
Board wishes to accept such letter proposal and authorize the Agreement,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes the September 17, 2024
MS4 Stormwater Management Services letter proposal from the Warren County Soil & Water
Conservation District (District) and authorizes and ratifies the Agreement for MS4 Stormwater
Management Services with the District through December 31, 2027 and authorizes and directs the
Town Supervisor/Deputy Supervisor to execute the Agreement in substantially the form presented at
this meeting and any other needed documentation, and
BE IT FURTHER,
RESOLVED, that the Town shall pay the District the following amounts for the following
dates:
1. $10,000—July 1, 2024—December 2024;

2. One (1) Western MVP Steel Snowplow for the amount of $9,764 and one (1) Western
Electric Spreader for the amount of$8,340(the"equipment")by piggybacking with Trius,

WHEREAS, the Facilities Manager has requested further approval to advertise for bids for
the purchase of a stainless-steel dump body for the Truck as will be described in bid

and
WHEREAS, the Town wishes to purchase the vehicle through the New York State Office of

advertisement for bids in the Town's official newspaper, then open, read aloud and record all bids
received and present the bids to the next regular or special Town Board meeting, and

RESOLVED, that the Town Board further authorizes and directs the Town

WHEREAS, the Town Water Superintendent/Wastewater Director (Director) has requested
Town Board approval to purchase a 2024 John Deere 331G Compact Track Loader (Loader) from
United Construction & Forestry (United) for the amount of $113,542 to replace the Department's
back-up Backhoe (Town Asset 43370) in accordance with United's 09 September 2024 Quote Id:
30813042, and
WHEREAS, New York State Bidding is not required as the Loader purchase is under New
York State Office of General Services Contract 4PC70139, and
WHEREAS, the New York State Legislature adopted legislation allowing any political
subdivision in New York State to"piggyback"off an existing County Bid, and
WHEREAS, the Director has requested approval to piggyback with Monroe Tractor, a
participating member of the cooperative, municipal purchasing program Sourcewell Contracting,
and purchase a Towmaster Flat Bed Trailer(Trailer)for the amount of$22,289.60 in accordance with
Monroe Tractor's 9/16/24 Purchase Agreement per Sourcewell Contract 4092922-MNR, and
WHEREAS, the Director has requested an additional $4,000 to purchase needed ancillary
equipment/accessories to make the Trailer department-ready,
NOW, THEREFORE, BE IT
RESOLVED,that the Queensbury Town Board hereby approves of and authorizes the Town
Water Superintendent/Wastewater Director's purchase of a:
1. 2024 John Deere 331 G Compact Track Loader (Loader) from United Construction &
Forestry(United)for the amount of$113,542 in accordance with United's 09 September
2024 Quote Id: 30813042 per New York State Office of General Services Contract
4PC70139; and

accordance with Monroe Tractor's 9/16/24 Purchase Agreement per Sourcewell Contract

BE IT FURTHER,
RESOLVED, that the Town Board further authorizes the additional expenditure of
approximately $4,000 to purchase needed ancillary equipment/accessories to make the Trailer
department-ready, and
BE IT FURTHER,
RESOLVED,that the Town Board authorizes and directs the Town Budget Officer to amend
the Town Budget to transfer up to$139,832 from the Water Department's Undesignated,Unassigned
Fund Balance Account No.: 040-0000-0909 to Account No.: 040-8340-2040 and take all necessary
actions to effectuate payment, and
BE IT FURTHER,
RESOLVED,that the Town Board further authorizes and directs the Town Budget Officer to
engage the services of auction company GovDeals to sell/dispose of the replaced Backhoe (Town
Asset 43370) and deposit any sales proceeds into the appropriate revenue account(s) in accordance
with the Queensbury Town Code and New York State Laws, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town
Supervisor/Deputy Town Supervisor, Water Superintendent/Wastewater Director and/or Town
Budget Officer to take such other and further actions as may be necessary to effectuate this Resolution.

time hourly position of Water Meter Service Worker I and revised the title of the existing "Water
Meter Service Worker"position to "Water Meter Service Worker II," and
WHEREAS, the Town Water Superintendent has accordingly recommended that the Town
Board authorize the promotions of:
1. Scott Rivers from Water Meter Service Worker to Water Meter Service Worker I; and
2. Shane Reynolds from Water Meter Service Worker to Water Meter Service Worker 11;
and
WHEREAS,the Town Board wishes to authorize the requested promotions,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs the
promotion(s) of:
1. Scott Rivers from Water Meter Service Worker to Water Meter Service Worker I at the
2024 hourly rate for the position at$30.03; and
2. Shane Reynolds from Water Meter Service Worker to Water Meter Service Worker 11 at
the 2024 hourly rate for the position at$28.58;
as delineated in Resolution No.: 328,2024, and
BE IT FURTHER,
RESOLVED,that in accordance with the Town's Agreement with CSEA, such promotion(s)
shall be subject to a 90 day trial (probationary) period and any other applicable Civil Service
requirements, and

WHEREAS,Resolution No.: 331,2024 the Queensbury Town Board authorized engagement
of Peckham Industries, Inc. (Peckham)for asphalt paving work at the Pine View Cemetery (Project)
by the Town "piggybacking" with Warren County in accordance with Warren County Heavy
Highway Construction Bid#WC 62-21 for an amount not to exceed$141,896.10, and
WHEREAS, the Town Cemetery Superintendent has advised that additional shoulder back
up and shin/overlay work for this Project is needed as set forth in Peckham's two(2)Hot Mix Asphalt
Pavement Estimates dated 9/19/2024 and 9/23/2024 for the additional amounts of $67,493.78 and
$37,963.30 respectively for a total additional sum of $105,457.08 and therefore the Town Board
wishes to amend Resolution No. 331,2024 to provide for the additional work and expense,
NOW, THEREFORE, BE IT
RESOLVED,thatthe Queensbury Town Board hereby amends Resolution No.: 331,2024 and
authorizes and ratifies Peckham's additional work at the Pine View Cemetery as set forth in
Peckham's two (2) Hot Mix Asphalt Pavement Estimates dated 9/19/2024 and 9/23/2024 for the
additional amounts of $67,493.78 and $37,963.30 respectively for a total additional sum of
$105,457.08, for a total amount due to Peckham for this Project in an amount of$247,353.18 to be
paid from Misc. Contractual Account No.: 002-8810-4400, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes a $105,458 transfer from Capital
Reserve No.: 64 to Misc. Contractual Account No.: 002-8810-4400 and authorizes and directs the
Town Budget Officer to amend the Town Budget and increase appropriations and revenues as
follows:
• Revenue Acct No. —002-0000-55031 (Interfund Revenue) - $105,458;
• Expense Acct No. —002-8810-4400 (Misc. Contractual - $105,458;
• Increase Appr 001-9901-9128-0064 Transfer to Operating Funds - $105,458; and
BE IT FURTHER,

WHEREAS, the Town of Queensbury's Facilities Manager wishes to advertise for bids for
roof repairs and/or roof replacement at the Town-owned building located at 195 Sunnyside Road due
to damage caused by fallen trees as will be set forth in bid specifications to be prepared by the
Facilities Manager and/or Purchasing Agent, and
WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and
award the bid to the lowest responsible bidder(s)meeting New York State statutory requirements and
the requirements set forth in the Town's bidding documents,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs the Town's
Purchasing Agent to publish an advertisement for bids in the official Town newspaper for the needed
roof repairs and/or replacement, open all received bids, read, record and then present the bids to the
next regular or special Town Board meeting.

5.0 CORRESPONDENCE
DEPUTY TOWN CLERK MURPHY-Supervisor's report from Buildings and Codes was received
for the month of August. Correspondence was received from Jackie Cordell to express her
disappointment in the Resolution about Ward II replacing the Councilperson.
6.0 PRIVILEGE OF THE FLOOR(LIMIT—4 MINUTES)
JEAN LAPPER spoke regarding the Equal Rights Amendment that will be on the Ballot in
November. She wanted to bring it to the Town Board's attention and to request their support and
endorsement.
MARY ENHORNING spoke to express her support of the Equal Rights Amendment in hopes
that the Board will support this Amendment.
7.0 TOWN BOARD DISCUSSIONS
COUNCILMAN METIVIER(WARD I)
• Reported that a friend was visiting from Texas and went to visit her brother in Pine View
Cemetery and was amazed how beautiful it was. It's absolutely beautiful in there and she was
happy to see that her brother's in a good place. I cannot say enough how well Connie and the
gang takes care of that Cemetery.
COUNCILMAN DIXON(WARD III)
• Balloon Festival was a wonderful success as always and what a fantastic job by all those
involved. Thank you to everybody that made that such a success.
COUNCILMAN MCNULTY(WARD IV)
Update to the residents that may have noticed in our bottle and can return establishments that
there are bottles and cans everywhere. This is not the fault of the vendor. There is one State
contractor that picks them up that is way behind. I went out and spoke to the vendors, the
Town's people and to Senator Stec and he's aware of the issue and he's working through his
office and DEC and the provider. We acknowledge there is an issue, and it isn't our residents'
fault, and they are working to fix it.
SUPERVISOR STROUGH
• Spoke regarding the Tee Hill Road culvert issue and declared it an emergency, put it on fast
track. Construction workers are there and trying to get that fixed. Hopefully will get that in
before Thanksgiving.
• Reported that the people that live on Old Forge Road,the Eastern terminus of PeggyAnn Road
and people that live on Clark Street, there was an old shed there and it was dilapidated and it
was an eye sore and they called me and asked if I had any pull with Glens Falls to see if they
could do something with that ugly shed so I called them and within two weeks they took the
shed down and cleaned it right up. So, thank you Glens Falls. Kathy Fisher was the one who

took the lead on this at 18 Clark Street, and she was thankful individual over there. The kids
in the neighborhood got together, handmade and sent thank you notes.
