Duly adopted this 7 h day of October, 2024 by the following vote: AYES: Mr. Strough, Mr. Metivier, Mr. Dixon, Mr. McNulty NOES: None ABSENT: None 2.0 PUBLIC HEARING—Proposed Local Law Prohibiting Parking on Certain Portion of Property at the Town Visitors Welcome Center at Main Street and Media Drive Publication Date: September 28, 2024 SUPERVISOR STROUGH-People use this as a park and ride. It's not the park and ride. Park and ride is two tenths of a mile down Media Drive. It has a sign telling the people that this is not a park and ride, this is a visitors center. So the park and ride is two tenths of a mile north of here. So there is no parking signs being placed here because we have a very difficult time plowing this little parking area and there's EV stations there and there is people that park in front of them that aren't using them. So we're trying to put up signage that will clean this up and direct people down to the actual park and ride which is next to the Warren County, the West Glens Falls EMS station. So there is a public hearing on this. If anybody would like to speak to what we're proposing, the no parking signs and so forth at the little visitors center on the corner of Main Street and Media Drive. COUNCILMAN MCNULTY-John, if I may. We also have a problem with overnight parking there and RV's and vans on a regular basis, not the family that is stuck for a night but there is some people that have been using it overnight. We've got some complaints from some residents and I appreciate you moving forward on this. SUPERVISOR STROUGH-And we have two signs because of your request stating, no overnight parking. And adopting these signs and this protocol for this particular area will help the Sheriff's Department make the arrest they have to make here for people that are abusing this area. Okay, I've opened the public hearing and the public hearing is open on this. If there is anybody here that would like to speak to it. I don't see any attendees; I don't see any hands up. Alright, I will close the public hearing and entertain a motion to approve. PUBLIC HEARING CLOSED Regular Town Board Meeting, 10-07-2024, MTG# 30 434 RESOLUTION TO ENACT LOCAL LAW PROHIBITING PARKING ON CERTAIN PORTION OF PROPERTY AT THE TOWN VISITORS WELCOME CENTER LOCATED AT THE NORTHWEST CORNER OF MAIN STREET AND MEDIA DRIVE RESOLUTION NO.: 365,2024 INTRODUCED BY: Timothy McNulty WHO MOVED ITS ADOPTION SECONDED BY: Mr.Anthony Metivier WHEREAS, the Queensbury Town Board wishes to consider adoption of a Local Law which would prohibit and/or limit parking and/or overnight parking of any vehicle on a portion of property at the Town's Visitors Welcome Center located at the northwest corner of Main Street and Media Drive specifically along the western side of the property beginning at the property's southernmost entrance heading in a generally northern direction to the property's northernmost entrance a distance of 240'± and accordingly authorize the installation of no parking, overnight parking,handicapped and/or electric vehicle signage in this specific area in order to prevent unauthorized motor vehicles as designated, and WHEREAS, such legislation is authorized in accordance with New York State Town Law, Vehicle and Traffic Law§1660(18)and the Municipal Home Rule Law, and WHEREAS,the Town Board duly conducted a public hearing concerning the proposed Local Law on Monday, October 7`",2024 and heard all interested persons, NOW, THEREFORE,BE IT RESOLVED,that the Queensbury Town Board hereby adopts and enacts the"Local Law Prohibiting Parking on a Portion of Town's Visitors Welcome Center Property Located at Northwest Corner of Main Street and Media Drive in the Town of Queensbury,"substantially in the form presented at this meeting to be known as Local Law No.: 5 of 2024, and BE IT FURTHER, RESOLVED, that the Town Board hereby authorizes and directs the Queensbury Town Clerk to file the Local Law with the New York State Secretary of State in accordance with the provisions of the Municipal Home Rule Law, and the Local Law will take effect immediately and as soon as allowable under law, and BE IT FURTHER, RESOLVED,that the Town Board further authorizes and directs the Town Supervisor,Town Highway Superintendent and/or Town Budget Officer to take all actions necessary to effectuate the purchase and posting of the needed no parking, overnight parking,handicapped and/or electric vehicle signage and take any actions necessary to effectuate this Resolution. Definitions: For the purpose of this Local Law, the words "Motor Vehicle," "Vehicle," "Person," and"Park" shall have the same meanings as set forth for the definitions of such words in the Vehicle and Traffic Law of the State of New York. 3. No Parking on Portion of Property at the Town's Visitor Welcome Center at Main Street and Media Drive in the Town of Queensbury: No motor vehicle or other vehicle of any kind shall be allowed or permitted to park and no person(s) shall park a motor vehicle or other vehicle for any period of time on a portion of property at the Town's Visitors Welcome Center located at the northwest corner of Main Street and Media Drive specifically along the western side of the property beginning at the property's southernmost entrance heading in a generally northern direction to the property's northernmost entrance a distance of 240'±. 4. Responsibility of Motor Vehicle Owner: Should any vehicle be found parked in violation of this Local Law, it shall be presumed that the owner of the motor vehicle is the person responsible for parking the motor vehicle in violation and this presumption shall only be rebutted upon a showing by the vehicle owner that another person clearly identified had custody and control of the motor vehicle at the time of such violation. Penalty: Any person violating any provision or paragraph of Section 3 of this Local Law shall,upon conviction, be punishable for a first offense by a fine not to exceed $25, and for a second offense by a fine not to exceed $50. COUNCILMAN METIVIER seconded the motion to amended resolution. 4.0 RESOLUTIONS RESOLUTION AUTHORIZING AGREEMENT WITH ECONOMIC DEVELOPMENT CORPORATION- WARREN COUNTY FOR 2025 RESOLUTION NO.: 366,2024 DEFEATED INTRODUCED BY: Mr.Timothy McNulty WHO MOVED FOR ITS ADOPTION SECONDED BY: Mr.Anthony Metivier Regular Town Board Meeting, 10-07-2024, MTG# 30 438 WHEREAS, the Town and the Economic Development Corporation - Warren County (EDC) recognize the need to revitalize the local economy by increasing the number of jobs for Town residents by attracting high technology and other industries to the area, and WHEREAS, in accordance with the Not-for-Profit Corporation Law §1411(a) and EDC's Certificate of Incorporation, the purposes of the EDC are the exclusively charitable or public purposes of relieving and reducing unemployment,promoting and providing for additional and maximum employment, bettering and maintaining job opportunities, instructing or training individuals to improve or develop their capabilities for such jobs, carrying on scientific research for the purpose of aiding a community or geographical area by attracting new industry to the community or area or by encouraging the development or retention of an industry in the community or area and lessening the burdens of government and acting in the public interest, and WHEREAS, the Not-for-Profit Corporation Law specifically finds that corporations organized under §1411 perform an essential governmental function, and WHEREAS, the Town Board strongly supports EDC's important mission to improve employment opportunities and economic development in the Town and therefore wishes to enter into an agreement with EDC for 2025, NOW, THEREFORE,BE IT RESOLVED, that the Queensbury Town Board hereby approves, authorizes and ratifies the Agreement with the Economic Development Corporation - Warren County for July 1, 2024 —June 30, 2027 (Agreement) and in accordance with the Agreement, authorizes and directs the Town Budget Officer to take all actions necessary to effectuate payments to EDC as follows: 1. For the year of 2025 the sum of$114,000; to be paid from the appropriate account(s)as determined by the Town Budget Officer, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor/Deputy Town Supervisor to execute the Agreement in substantially the form presented at this meeting and the Town Supervisor/Deputy Town Supervisor and/or Town Budget Officer to take such other and further actions as may be necessary to effectuate the terms of this Resolution. So for Proposition 1,since we have Look TV and we've got everybody out in the audience, I want to remind you,November 5`",when it's time to vote,you've got to flip your ballot over and on the backside there's going to be other propositions on there. I believe the Library is on there as well as Proposal 1. I don't think it's going to be called Proposition 1,it's Proposal 1. Since we have such an audience here, I want to comment on how I view things. First of all, there's been mention of God in this environment tonight and I guess where I want to go with this, God doesn't make mistakes. So each and everyone of you that are in here,whether you are gay,straight,transgender,God did not make a mistake. That's spoken by a Republican and Conservative right now. So,I want to let everyone know it is not political divide. It's about who we are. There are components to it,in this because there is lack of clarity talking about sexual orientation, gender identity, gender expression,pregnancy,pregnancy outcomes, reproductive healthcare and autonomy,there are rights here but without the clarity,there is danger. Sexual orientation,there is danger that children going to school may not have to talk to their parents, they may be talking to the teachers and getting guidance. Will children need guidance, absolutely but it shouldn't come from the teachers. Gender identity, the risk with that. I have no problems with gender identity. Where the risk comes,the potential risks. We talk about bathroom. We've got two bathrooms out here. Yes,women have the right to privacy and they shouldn't have to worry about that. I know people are saying males just won't walk into a bathroom but, I'm sorry, for all the men in here, guys do really stupid things. Women's reproductive rights, absolutely. Women should have the ability to have this right, and they do have that right in New York State. They're protected by laws. By making this a constitutional right though, I believe it's going to be challenged and there could be that one off, and all it takes is one that does a late term abortion. Will it happen,I hope to God it doesn't but is it a risk, yes. The other one, country of origin. It sounds so simple.We're not going to discriminate against somebody from Poland, from Ireland. I mean,we've all got our heritage but what is not in here is the details. So,in New York State,if this goes through,we will not be able to discriminate against the people coming into this country illegally. That can be a problem. We've already got a problem in New York City and it's blossoming into the rest ofNew York State. This,it's a tremendous problem. And yes,I heard somebody mention and by example, FEMA announced that they are running out of money while giving millions to fund illegals in New York City where people in the Carolinas are getting a check for$750.00,the illegals,and yes they are illegal,they did not come to this country legally. Do I hate them? Am I going to discriminate them? Would I not give them, I work in health care as well,would not give them the care if they came to that hospital? Absolutely not. I would care for each and every individual. We had discussions about individuals with AIDS,when there was the AIDS crisis. I worked through that. Not once did I turn my back on an individual. Not once did I walk away. I stayed there when we didn't even know what was going on. If this was a really good bill, what I would also like to see in there, let's talk about military. Military was discriminated after the Vietnam War. So there's so much it could be and there's so much that's missing,it's how it's written. With all of that,I just,I have concerns about that and since everybody had an opportunity to speak,I felt I had an opportunity to speak for everybody regardless of whether you're for it or against it,you're all wonderful people. I love this Town, and I love the people that I work with, that's why I want to do this job. Yes, I represent Ward 3 but I represent everybody else. I may not have the exact view as some of you all of the time but these are my opinions, these are my views and I'm not going to shelter it. You need to know who I am because next year, if you don't like these opinions,you're not going to vote for me and that's your right. That's what I love about this country,you have the right to be heard. You can vote. You can choose your elected official and you need to do so. Now I'm going to get off my soapbox because I know everybody is getting tired. COUNCILMAN MCNULTY-First off,thank you to all of you that came out tonight. The discussion that why this is on the agenda, I can't get into that, I can't answer that either but the fact that you are all here to share Regular Town Board Meeting, 10-07-2024, MTG9 30 442 your opinions, we greatly appreciate it. This Town is fully committed to equal rights. However, as it was written in one of the numerous articles that I read today that I will not bring up,when the Government gets into the business of making new rights, it pays to look out for the ones that you're going to lose. As already mentioned,this Constitutional Amendment fails to protect parental rights,business owner's rights,the right to medical and religious professionals and the right to New York State citizens who are going to ultimately bear the financial burden to having to pay for this poorly written and overly vague Constitutional Amendment. And while I'm not a lawyer, I'm not a Constitutional Lawyer, I do disagree with some of the comments regarding the effect this Constitutional Amendment would have on current State laws. When the State law violates the Constitution,the Courts can strike down the law. In addition, State Officials can be sued to prevent them from enforcing the State law that conflicts with the Constitution. So all of the laws that we have on the books now to protect us from all of those inequalities, all of those issues that we've raised over the last two hours become secondary to this Constitutional Amendment. That's why I will not vote for it, I will vote no on this proposed amendment. Thank you. FOR SERVICES RELATED TO WINDOWS 11 UPGRADES RESOLUTION NO.: 377,2024 INTRODUCED BY: Mr.Michael Dixon WHO MOVED ITS ADOPTION SECONDED BY: Mr.Anthony Metivier WHEREAS,by Resolution No.: 31, 2022, the Queensbury Town Board authorized a five (5)year extension of the Agreement between the Town and Stored Technology Solutions, Inc., (StoredTech) for continued provision of professional information technology services, and WHEREAS, StoredTech has submitted Quote Nos: STSQ21903-01, STSQ21904-01, STS 121905- 03, STSQ21951, STSQ21909-01 and STSQ21919-01 for equipment and professional services related to the Town's four-phase Windows 11 upgrade project for an estimated total amount of$31,650, and Regular Town Board Meeting, 10-07-2024, MTG# 30 450 WHEREAS,the Town Board wishes to engage StoredTech in accordance with such Quotes as such professional services are consistent with StoredTech's existing provision of information technology services and StoredTech has the skill, expertise and an established familiarity and comfort level with the Town's building infrastructure, NOW, THEREFORE,BE IT RESOLVED, that the Queensbury Town Board hereby authorizes and directs the engagement of StoredTech in accordance with StoredTech Quote Nos: STSQ21903-01, STSQ21904-01, STS121905-03, STSQ21951, STSQ21909-01 and STSQ21919-01 for equipment and professional services related to the Town's four-phase Windows 11 upgrade project for an estimated total amount of$31,650 to be paid from AccountNo: 001-1680-4335 (up to $27,000),AccountNo: 040-1680-4335 (up to $5,000)and AccountNo: 032-1680-4335 (up to $1,000) and authorizes and directs the Town Supervisor to sign any needed documentation, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to amend the Town Budget and take all actions necessary to transfer: • Up to $27,000 from the Town General Fund's Unappropriated,Undesignated Fund Balance Account No.: 001-0000-0909 to AccountNo.: 001-1680-4335; • Up to $5,000 from the Water Department's Unappropriated, Undesignated Fund Balance Account No.: 040-0000-0909 to AccountNo.: 040-1680-4335; • Up to $1,000 from the Wastewater Department's Unappropriated, Undesignated Fund Balance AccountNo.: 032-0000-0909 to AccountNo.: 032-1680-4335; and take any other actions she deems necessary to effectuate payment, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor/Deputy Town Supervisor and/or Town Budget Officer to take such other and further actions as may be necessary to effectuate the terms of this Resolution. Supervisor Strough Regular Town Board Meeting, 10-07-2024, MTG9 30 451 bled Declaration and Emergency Order regarding Tee Hill Road Culvert. All on file in the Town Clerk's Office. 6.0 PRIVILEGE OF THE FLOOR(LIMIT—4 MINUTES) DOUG HERSCHLEB referred to resolution 4.7, `Resolution Consenting to Town Counsel's Representation of Queensbury Union Free School District in Certain Assessment Litigation and asked what the certain assessment was. SUPERVISOR STROUGH noted that there is a group of people challenging their assessment so the School and the Town, instead of hiring two different attorneys because we're in the same direction, we're arguing the assessment is accurate. 7.0 TOWN BOARD DISCUSSIONS COUNCILMAN MCNULTY(WARD 4) • I was disappointed that you decided to add this Proposition 1 to the agenda tonight. Two weeks ago, you were adamant that the Town Board should not fill the vacancy in Ward 2, insisting that the residents should make that decision. Yet tonight you interjected your personal views into a very divisive election matter. You have consistently stated that you are an equal member of the Town Board,one of currently four of us,I'd like to get back to thinking that we can all work together for the benefit of the Town. COUNCILMAN DIXON(WARD 3) • Would like to remind everyone that today marks a very sad milestone, it was October 7 h one year ago in Isreal that they were attacked. We have a Jewish community, and Israel has every right to defend themselves. More importantly,my heart goes out to everybody being impacted by this war. • Referred to the many local non-for-profit organizations and announced that the Glens Falls Hospital is doing a fundraising event to expand their Emergency Room and recommended donating if at all possible to them as well as the emergency services that will be utilizing this facility. • Noted that he had an opportunity last week to visit Adirondack Indoor Gun Range,it is unique to Queensbury on Route 9, it's a fantastic service that they can provide if you are a pistol owner. I think it's great to have in our area, it keeps people informed and teaches safety when handling guns. • Referred to the Tee Hill Culvert Emergency situation and commended John Strough for doing a great j ob to push this along as best as possible. COUNCILMAN METIVIER (WARD 1) • Would like to echo those comments regarding the work John has done on the Tee Hill Culvert Emergency situation. SUPERVISOR STROUGH • Referred to the Tee Hill Culvert situation and noted that it used to be a bridge 30 years ago but was destroyed and replaced with a culvert which has now deteriorated, and travel was unsafe. I declared an emergency declaration, made it into two phases and phase one had to be completed so as not to disturb the stream or trout after October 1". The second phase with new standards will be a bridge which Fort Pierce is designing and constructing which Regular Town Board Meeting, 10-07-2024, MTG# 30 452 will take four weeks to complete. I'm hoping to have it completed by the first part of December. • Announced that the Town of Queensbury is conducting a sewer rehabilitation project for Pershing Road, Ashley Place, Broad Acres Road, Luzerne Place and Roosevelt Avenue. It is anticipated that construction will last one month requiring some temporary shutdowns. Those being affected will be notified prior to shutdown. They will be relining the pipeline with an epoxy which will last another 30 years. The underground work may cause some emergency shutdowns but thank you for your patience and understanding, this from your Queensbury Wastewater Director, Christ Harrington who does a very good job. • Announced and reviewed the Queensbury Highway Annual Fall 2024 Residential Lawn and Leaf pickup schedule with the required specifications. • Thanked everyone for attending,there was a lot of good points brought up.
