In a, jurisdictional inquiry form submitted.by you and ,
received on June .5, 1980, the following facts were. set forth:
1 James Denouyer owns a . 39 .acre parcel 'of land located

be used-for .residential purposes" on the. property _ --

project ' 77-370. ; Condition 4 'of.the permit provides
"the :existing ' single :family dwelling on_,the: 0 39.
acre'.parcel shall-'be; removed. :: Further, no" new

acre parcel, and this parcel may be sold separately
from the 5+ acre `par,cel::only if; the intended, use, of

The basis for this determination is as follows . A
residential garage is considered an accessory structure, that
is, a structure customarily incidental or subordinate to a`
principal land use and that customarily accompanies or -is
associated with such land use. The construction and use of -
-such a residential garage is not a Class A or B .regional project '.
-- subject to Agency review. Further, an accessory _,
ystructure does
not constitute a "principal building" as defined by §802(50) of
the Adirondack Park Agency Act ;and would therefore not.violate
the above-referenced permit condition. Also, Condition 4 of
Permit P78-13B/R referred to above expressly indicates that. the
construction of an accessory use structure on the .39• acre
parcel is permissible.
I should point out to you that this letter is based on
information supplied by you and recited herein. Should the
facts differ from those recited, our nonjurisdictional deter-
mination could vary accordingly. Furthermore, this letter
cannot serve to exempt your proposal from approval or permit
requirements of other state or local governmental bodies .
Finally, this letter does not change the fact that other
state and local agencies may require that permits be issued before
you commence the project. And while an Adirondack Park Agency �.'..
permit is not necessary for your proposal, you should check with '
authorities of the Town of Queensbury and with other state ..:
agencies as to whether they will require such permits
