2013-09-30- Mtg 38 SPECIALTOWN BOARD MEETING 09-30-201 MTG #38 409 SPECIAL TOWN BOARD MEETING MTG. #38 SEPTEMBER 30, 2013 RES. 392-393 6:30 p.m. TOWN BOARD MEMBERS PRESENT SUPERVISOR RONALD MONTESI COUNICLMAN ANTHONY METIVIER COUNCILMAN BRIAN CLEMENTS COUNCILMAN JOHN STROUGH COUNCILMAN TIM BREWER Stu Baker-Senior Planner Craig Brown-Zoning Administrator Representatives of the Real Estate Companies RESOLUTION RESOLUTION CONCERNING ABANDONED OR NEGLECTED PROPERTIES IN TOWN OF QUEENSBURY RESOLUTION NO.: 392,2013 INTRODUCED BY: Mr.John Strough WHO MOVED ITS ADOPTION SECONDED BY: Mr.Brian Clements WHEREAS,the Town of Queensbury's Director of Building and Codes Enforcement (Director)has reported to the Town Board that the following properties in the Town of Queensbury are in a state of serious neglect: 1. 260 Aviation Road 2. 210 Sunnvside Road 3. 368 Dixon Road 4. 75 Dixon Road 5. 13 Carlton Drive 6. 12 Jerome Avenue 7. 121 West Mountain Road 8. 43 Warren Lane 9. 25 Glenwood Avenue;and WHEREAS, the Director reports that each of these properties has excessive weeds exceeding 10 inches in height in the front, side and/or rear yards, and WHEREAS,the QueensbunT Town Board has concluded that the condition of the properties creates a public health hazard due to concerns regarding fire and the harboring of ticks and other vermin in the tall grass,and SPECIALTOWN BOARD MEETING 09-30-201 MTG #38 410 WHEREAS, the Director reports that he has attempted to contact each of the owners of record by certified letter and/or posting of the properties,and WHEREAS, the Director reports that his efforts have been to no avail and he has been unable to reach anvone or to obtain an-,-resolution of the situation, and WHEREAS, in accordance with Town Law §64 (5-a), the Town Board may require the owners of land to cut, trim or remove from the land owned by them, brush, grass, rubbish or weeds or to spray poisonous shrubs or weeds on such land, and upon default, may cause such grass, brush, rubbish or weeds to be cut, trimmed or removed and such poisonous shrubs or weeds to be sprayed by the Town and the total expense of such cutting, trimming, removal or spraying may be assessed by the Town Board on the real property on which such grass, rubbish, weeds or poisonous shrubs or weeds were found and the expense so assessed shall constitute a lien and charge on the real property on which it is levied until paid or otherwise satisfied or discharged and shall be collected in the same manner and at the same time as other Town charges, NOW,THEREFORE, BE IT, RESOLVED,that the Town Board directs that: A final notice shall be sent to the Property Owner of Record as set forth above requiring that they mow the lawn on their land within 10 days and failing to do so,the Town will cause such action to be taken and the cost thereof as reasonablv calculated by the Town Budget Officer based on date and input provided b`-the Director of Parks and Recreation will be assessed b`-the Town Board on the real property and the assessment shall constitute a lien and charge on the real property until paid or otherwise satisfied or discharged and shall be collected in the same manner and at the same time as other Town charges,and BE IT FURTHER- RESOLVED, that the Town Board further authorizes and directs the Director of Parks and Recreation to assign employees to perform the initial task of mowing and/or trimming weeds on the subject properties,and BE IT FURTHER- RESOLVED, that the Town Board further authorizes and directs that records be maintained of the employees used and the time expended to perform the work on each of the properties where the cost of such employees shall include all ancillary fringe benefits,and BE IT FURTHER- RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Director of Building and Codes Enforcement, Director of Parks and Recreation and/or Town Budget Officer to take all actions necessary to effectuate the terms of this Resolution. Duly adopted this 30th day of September,2013,by the following vote: AYES: Mr. Metivier,Mr. Clements,Mr. Strough, Mr. Brewer,Mr. Montesi SPECIALTOWN BOARD MEETING 09-30-201 MTG #38 411 NOES : None ABSENT: None DISCUSSIONS: ZONING EXIT 18 AREA Items suggested to be added - • Bank as useful permitted by site plan review - • Add fast food establishments as a use permitted by site plan review Zoning Administrator Craig Brown-Noted that drive thru as associated with those suggestions the Zoning Code would have to be changed to allow drive thru - • Allow limited pet services such as grooming as in minor accessory use to retail Mr. Stephen Borgos-spoke about doggie day care in this area Zoning Administrator Brown-I do not think you want to allow kennels in the Main Street Zone- no outdoor but maybe if it's all indoors, - no noise or smells .. a pet store, doggie spa, I think that is ok. - vet clinic discussed • Parking - add parking structure and parking lot—subject to site plan review • Seasonal Produce Businesses— recommending produce stands— permitted by site plan review supports residential development and also pedestrian activity • Plaza —design element— no recommendation for change • Density -floor area ratio of 30%there are other elements that will come into play on the site design - onsite parking and onsite management of storm water ratio would have to be added • Building Height—suggested allow minimum height of one story, concerned that the comprehensive plan specifically states two or three stories ... if the Board wishes to change to one story they would have to change the comprehensive plan...recommended to keep to two or three stories... Unknown-Concerned that some retailers might want to have a single story building because they want to be all on one floor... be open minded about the minimum two story regulation, judge it individually. Councilman Strough-Mayor Diamond would like to have his planning people sit down with our planning people and see if we can develop a uniform zone coming from Exit 18 into the City. I said I would welcome that. Unknown-spoke on traffic issues in that area...noted the traffic is slow now... Councilman Strough-If you want longevity you have to get away from your suburban type of zoning and move to the urban type of zoning like the rest of the world is. If you want higher revenues and lower taxes, you want lower infrastructure costs and quicker paybacks, you want to encourage more walkable pedestrian friendly communities, you want to support window shopping, you want to inspire places like plazas and benches. You want long term growth that innovated, diverse and dynamic. You want planning that encourages the use of shared parking. You want to give opportunity to self-motivated entrepreneur, you want to foster independently owned and diverse retail offerings. You want to discourage the plain appearing single story boxes and you want to discourage polluting and emerging waste with suburban development, and you want to encourage a nice appearing building, and its offerings is what the public is SPECIALTOWN BOARD MEETING 09-30-201 MTG #38 412 presented with not pavement and parked cars then zoning does matter. Zoning that calls for mixed use down town types of development like this Main Street Zone is more likely to accomplish the above then suburban commercial zoning. Unknown-Keep in mind you are limited to a degree as to what can go there. You have a basic conflict here, vision verses reality. That is the major road going into the City ... Unknown-Need of a long term plan that connects South Street, Broad Street all the way through and past to West Mountain. If you don't think ahead now you will never be able get that back.
