WASTES IN TOWN OF QUEENSBURY

WHEREAS, POLYCHLORINATED BIPHENYL WASTES AND SOILS CONTAMINATED WITH
SUCH WASTES (COLLECTIVELY REFERRED TO AS ' ' PCB" WASTES ) HAVE BEEN DIS-
COVERED RECENTLY AT SEVERAL SITES IN THE TOWN OF QUEENSBURY AND
WHEREAS, THE COMMISSIONER OF THE NEW YORK STATE DEPARTMENT OF HEALTH
HAS DECLARED THAT SUCH WASTES HAVE CREATED A CONDITION DANGEROUS TO
HEALTH ON AND AROUND SOME OF SAID SITES ; AND
WHEREAS, IN THE INTEREST OF THE HEALTH OF PERSONS RESIDING OR WORKING
ON OR AROUND SUCH SITES CONCERNING WHICH CONDITIONS DANGEROUS TO HEALTH
HAVE BEEN DECLARED TO EXIST , IT IS NECESSARY TO REMOVE THE PCB WASTES
FROM SUCH SITES AND TO DISPOSE OF SUCH PCB WASTES IN A SECURE LOCATION ,
AND
WHEREAS, THE COMMISSIONER OF THE NEW YORK STATE DEPARTMENT OF ENVIRON-
MENTAL CONSERVATION HAS ASSUMED THE RESPONSIBILITY FOR DEVISING
APPROPRIATE METHODS BY WHICH SUCH REMOVAL AND DISPOSAL CAN BE EFFECTED,
AND
WHEREAS, THE NEW YORK STATE DEPARTMENT OF ENVIRONMENTAL CONSERVATION
HAS DEVELOPED A REMEDIAL PROGRAM FOR THE REMOVAL OF THE PCB WASTES
AND THE DISPOSAL OF SUCH WASTES AT A SECURE LAND BURIAL FACILITY TO
BE CONSTRUCTED IN THE TOWN OF QUEENSBURY, AND
WHEREAS, A PROPOSED AGREEMENT AMONG THE PEOPLE OF THE STATE OF NEW YORK
ACTING BY AND THROUGH THE NEW YORK STATE DEPARTMENT OF ENVIRONMENTAL
CONSERVATION , THE NEW YORK STATE DEPARTMENT OF HEALTH , THE COUNTY OF
WARREN , THE CITY OF GLENS FALLS AND THE TOWN OF QUEENSBURY HAS BEEN
PREPARED IN WRITING WHICH PROPOSED AGREEMENT SETS FORTH THE TERMS AND

CONDITIONS FOR THE IMPLEMENTATION OF SAID REMEDIAL PROGRAM OF THE NEW
YORK STATE DEPARTMENT OF ENVIRONMENTAL CONSERVATION ,
NOW, THEREFORE , BE IT
RESOLVED, THAT THE TOWN OF QUEENSBURY SHALL COOPERATE FULLY WITH ALL
GOVERNMENT AGENCIES TO ACCOMPLISH THE REMOVAL AND DISPOSAL OF PCB
WASTES LOCATED IN THE TOWN OF QUEENSBURY , WHEREVER THEY MAY BE FOUND
AND BE IT FURTHER
RESOLVED, THAT THE TOWN OF QUEENSBURY SHALL COOPERATE WITH AND ASSIST
THE COUNTY OF WARREN IN IMPLEMENTING THE REMEDIAL PROGRAM BY
(A) PROVIDING EQUIPMENT AND PERSONNEL TO THE COUNTY OF WARREN FOR
USE IN THE IMPLEMENTATION OF THE REMEDIAL PROGRAM AND
~" (B ) CONTROLLING THE MOVEMENT OF TRAFFIC ON TOWN ROADS DURING THE
IMPLEMENTATION OF THE REMEDIAL PROGRAM IN ACCORDANCE WITH THE DEVELOPED
SAFETY PLAN, AND BE IT FURTHER
(C ) THE MAXIMUM ELEVATION OF THE CONTAINMENT AREA SHALL BE NO MORE
THAN TWELVE FEET ( 12 ' ) AS COMPARED TO THE EXISTING GRADE OF THE
SURROUNDING AREA.
RESOLVED , THAT THE SUPERVISOR OF THE TOWN OF QUEENSBURY BE AND HE HEREBY
IS AUTHORIZED AND DIRECTED TO EXECUTE, WITH THE COUNTY OF WARREN ON
BEHALF OF THE TOWN OF QUEENSBURY, AN AGREEMENT SETTING FORTH THE
OBLIGATIONS OF ALL PARTIES WITH RESPECT TO THE IMPLEMENTATION OF THE
REMEDIAL PROGRAM AND ANY AND ALL OTHER DOCUMENTS NECESSARY TO EFFECTUATE
THE IMPLEMENTATION OF THE REMEDIAL PROGRAM , IN SUCH FORM AS SHALL BE
APPROVED BY THE COUNSEL TO THE TOWN BOARD.

QUEENSBURY TO CLEAR WOOD FROM THE TOP OF GRAVEL PIT AT THE QUEENSBURY
GLENS FALLS LANDFILL AND BE IT FURTHER
RESOLVED, THAT MR. TIM SPERRY PAY 30% OF HIS REVENUE TO THE TOWN AND
THAT PROPER INSURANCE COVERAGE BE PRESENTED BY THE LOGGER TO THE TOWN
CLERK.
