Clements who moved for its adoption, seconded by Ronald Kuhl:
65 Hicks Road. The applicant proposes construction of a 768 square foot second garage and a
1 .26 acre parcel. The relief required is from the number of allowable garages on a parcel as
per Section 179-5-020D and relief requested from the rear yard setback requirements as per
Section 179-3-040. In making the determination the Board should consider whether an
undesirable change will be produced in the character of the neighborhood or a detriment to
nearby properties will be created by granting of this Area Variance. Minor impacts may be
anticipated. Number Two, whether the benefit sought by the applicant can be achieved by
some other method feasible for the applicant to pursue other than an Area Variance. There
are limited feasible alternatives. Number Three, whether the requested Area Variance is
substantial. It may be considered moderate. Number Four, whether the proposed variance
will have an adverse effect or impact on the physical or environmental conditions in the
neighborhood? Minor impacts may be anticipated. Also the applicant has agreed to remove

Dear Mr. Richards:
I am writing to you in response to my review of your building permit plans submitted
depicting the proposed construction of a 768 sq. ft. detached garage and to document our past
conversations and the conversations between you and Keith Oborne of my office.
Upon review of the plans submitted to this office, I find that an Area Variance will be
necessary in order for you to construct the project as planned. Specifically, the detached
garage proposed is considered to be a second garage as you have an existing attached garage
on the property; a variance is needed for a second such structure. In addition, you will need
a variance for rear yard setback relief from the MDR zone. The minimum rear yard setback
requirement is 30 ft. and your plan shows the proposed garage to be setback at 10 ft.
I understand that you are preparing the necessary applications. Please note our established
submittal deadlines when compiling your application materials.
