AVIATION ROAD/DIXON ROAD/FARR LANE INTERSECTION
IMPROVEMENT PROJECT

WHEREAS, by Resolution No.: 232, 2012, the Queensbury Town Board authorized and
approved the Aviation Road/Dixon Road/Farr Lane Intersection Improvements Project in the Town of
Queensbury(The Town), Warren County, P.I.N. 1759.06 (the Project), and
WHEREAS, by Resolution No.: 89, 2014, the Town Board reaffirmed the Project and
authorized and directed the Town Supervisor and/or Town Budget Officer to pay in the first instance
100% of the federal and non-federal share of the cost of Design, Right-of-Way (ROW) Incidentals,
ROW Acquisition and Construction phases for the Project or portions thereof, and
WHEREAS, by Resolution No. 105, 2014 the Queensbury Town Board authorized the
Town Budget Officer to advertise for bids, and
WHEREAS, General Municipal Law § 103 requires that the Town advertise for bids and
award the bid to the lowest responsible bidder meeting New York State statutory requirements
and the requirements set forth in the Town's bidding documents, and
WHEREAS, in compliance with General Municipal Law § 103 and New York State

Department of Transportation (NYSDOT) Federal-Aid Project requirements, the Town of
Queensbury advertised the project in the Post-Star and in the New York State Contract Reporter,
and
WHEREAS, the Town Budget Officer received and opened four (4) bids on Wednesday,
April 16, 2014, 2:00 PM with the apparent lowest responsible bidder being Rifenburg
Construction, Inc., 159 Brick Church Road, Troy, NY 12180 for the sum of$1,114,967.00; and
WHEREAS, the Town's Engineering consultant, Creighton Manning Engineering LLP,
has reviewed the apparent low bidder's proposal to ensure completeness and conformance to
State and Federal requirements and provided a recommendation that the Town award the contract
to Rifenburg Construction, Inc., contingent upon NYSDOT and Federal Highway Administration
(FHWA) concurrence with the award; now, therefore be it
RESOLVED, that the Town of Queensbury Supervisor is hereby authorized to award the
Aviation Road/Dixon Road/Farr Lane Intersection Improvement Project construction contract to
Rifenburg Construction Inc., for the total price of$1,114,967.00 contingent upon NYSDOT and
FHWA concurrence with the award; and
BE IT FURTHER,
RESOLVED, that, upon concurrence by NYSDOT and FHWA, the Town Budget Officer
be and hereby is authorized to pay Rifenburg Construction Inc., the sum of$1,114,967.00 in the
manner detailed in the bidding documents and upon approval and acceptance by the Senior
Planner; and
BE IT FURTHER,
RESOLVED, that expenses for this project shall be paid for from the Aviation
Road/Dixon/Farr Lane Intersection Improvement Project Grant Fund#192, and

BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute the Agreement in a form acceptable to the Town Supervisor and Town Counsel, and any
necessary forms or agreements related to this Project and further authorizes and directs the Town
Supervisor, Senior Planner and/or Town Budget Officer to take all action necessary to effectuate the
terms of this Resolution.
