Dear Mrs. Lecce:
Enclosed is your permit which was issued in accordance with the applicable provisions
of the Park Commission's rules and regulations (6 NYCRR 645 & 646) and the
Environmental Conservation Law. Please review the general and special conditions
included in the permit; these are intended to minimize any environmental disturbance
associated with the authorized activity. The Article 15 approval was issued under a
special delegation agreement with the Department of Environmental Conservation who
normally issues these approvals. This eliminates the need for separate application forms
and fees which would otherwise apply to this project.
Please note that it is the responsibility of the permittee and the permittee's agent to
comply with all permit conditions. Further, the permit is valid only for the activity
expressly authorized. Work beyond the scope of the permit shall be considered as work
without a permit. The notice enclosed with the permit must be displayed in a
conspicuous place near the project site during the entire period of construction and must
be suitable protected from the elements. Any failure to comply with the terms of the
permit may be treated as a violation of the Environmental Conservation Law. Questions
regarding this permit should be directed to the undersigned.
Should your plans change, you must contact this office to determine whether a
modification to the permit is required prior to initiating construction. Please note the
expiration date of the permit. If further time is required to complete the project, you must
request renewal of the permit prior to this date. Your interest in maintaining the

We are in receipt of the above-referenced application and have reviewed the same. By copy of this
letter we would like to respond with the following comments:
The property in question is within the Town of Queensbury zoning classification of Waterfront
Residential, (WR). A dock is listed as an allowable accessory structure within the WR zoning district
subject to applicable size and setback requirements. In my review of the proposed application, which
is identical to the Building Permit submitted to the Town for this project, I note the southern end of
the proposed dock appears to begin beyond the MLW mark as shown on the survey map. As the dock
is planned to be 40 feet long, and our maximum allowable length is 40 feet as measured from the
MLW mark, I informed the applicant of my findings. The applicant revised their Building Permit
application materials to show that the dock will be moved back towards the shore in order to comply
with the 40 ft MLW measurement requirements. I am sending you a copy of the revised plan that was
submitted to us today. As the plan submitted does not accurately show the location of the MLW mark
in the entire area of the proposed dock,the onus is on the applicant to ensure compliance.
