an agreement of cooperation between the parties hereinafter mentioned for

DISCUSSION
LOCAL LAW #1 Appointment instead of election of the Superintendent of
Highways-referendum
Councilman Barber-I have been opposed to the present faskion in which the
h**hway dept. is being administrated. I have for at least two years been
a proponent of converting structure of the Highway Dept. from elected
,position to an appointed position with the ultimate menna of looking at
a D.P.W. A, D.P.W. wound be for the betterment of the Town, will provide
more efficiency to the residents and be more economical to administer.
Commented on the Public Hearing noting that it was 1 tv,: 1 opposed and
in favor of the propositionosince then. a number of people have. contacted
me and noted their opposition to an appointed position. . . .if € am truly
representative of the populas of our community then I will have to respond
accordingly, but I must say, hat in hand, the residents of our community are
upset because they feel it is an offense upon their sacred right to elect
an individual, with this position they feel we are taking this right away
from them� it is diffinult for them to understand the rational. or our reasoning.
Supervisor Brandt-It has to be understood that we are not attempting to
dictate anything to the people, but merely giving them a chance to vote
and decide for themselves in the next general election at a very minimal
cost of whether they want or do not want to reorsgnize the function.
As I see it, yes, you are taking away the privilege of electing an official
there- is no question about it, on the other hand you are taking an elected
officals that are already there and you are giving them full responsibility
for funding and delivering highway improvements. I think that the public still
�#ill have elected officials reaponsible, only.:now totally responsible, for the
whole package. I think the people should have the right to decide which way
they want it and which ever way they want it,we will certaitly honor it, I
think that there is no question of that.
.ouncilman Robertson- This is not a new idea, it goes back to discussion held
in 1967 and it came up from time to time it has never been acted upon and
never been resolved. It is my personal opinion it is in the best interests
of the Tmn of Queensbury to go the route of an appointed official however,
I do understand and am perfectly willing to accept the decision of the public,
if the public feels that they are better served by an elected official. I am
most interested in seeing this issue go to the public and not to be decided
by myself or any other group of four or five people. . . the public should
consider very carefully the pros and cons of this measure and not take an
emotional stand on it.
Councilman Barber- I feel that this should go to referendum and the entire
town should have the opportunity to vote on this .

Supervisor Brandt- It should be knowwthat this is in no way is motivated
aroudil personalities from my view point, it is strictly a matter of business
organization and accountability in determining an easy accountability
for roads. It is very important to have someone accountable in total in
funding and for delivering the rand main*nce. I realize the Town Board
will be taking on a lot move responsibility and more world I do not think
anyone is looking for the work or needs it, but I think it is the proper
orga*ization to deliver the best service for the dollar.
Councilman' Oldon- After hearing the Public Hearing last week and receiving
a number of calks, and the indication that I got from the Public Hearing and
the calls they did not want this one position taken akay from the electorate.
t. . . they felt. . .it would be much easiee to remove one person then to
remove three members of the Twsn Board which make up the majority of the
five . . .I have not made up my mindfl probably am opposed to going
to a referendum on it. . .
Councilman Barber- I would probably be in a powition to;-agreet-*ith.you
until about fifthen minutes ago, Councilman, and I apolog)lr-to the Board
and the audience fbrbeing >iagl. . .many of the dtscrepanc*es that I have
found and the inefficiencies that I have found in the Highway Dept. over
the years was kind of a glaring tonight on my way up to the Town Hall on
Bay Road, I noticed that as I passed the Harvest Rest. that our brand new
3/4 ton four wheel drive was at the Harvest parking lot at 7: 30 P.M. this
evening. This smakks in my face, as a representative of this Town Board
and to you as a member of the. Highway Committee that this is utilizing
highway equipmentAsitting down at some restaurant or what ever at this
hour of the evening, I think that is trespassing upon the good faithookat
has bean rendered in that office by residents of this community and it smakks
in our face as guardians *of tzhe`bn4get. That is one of the reasons I was
tianing very heavily toward coinciding with your philosophy tonight until I
saw that, I felt that maybe perhaps things were turning around abit tut it is
the same old nonsense� I will be damned if I will live with it much longer.
To give the people an opportunity to see these problems as they exist and
I am not going th hide them anymore. I am not going; to keep them in my arm
pit or underneath hhe table or win&peer abutit hhmm as they arises they are going
to come forth. I am going to make the gentlemen of the press aware of it
so that they can investigate and make the public aware of it so that they
can intelligently vote on the integrity of the highway dept.

OF ELECTION OF THE SUPERINTENDENT OF. HIGHWAYS OF THE T014N OF OUEENSBURY
RESOLUTION NO. 123, Introduced by Mr. Michel Brandt who moved its adoption,

WHEREAS, the office of Town Superintendent of Highways is presently an
elective office in the Town of Queensbury and
WHEREAS, Section 23 of the Municipal Home Rule Law authorizes the Town
r- Board to adopt a local law changing the office of Town of Queensbury
Superintendent of Highways from elective to appointive and
WHEREAS, such local law is subject to a mandatory referendum pursuant to '
Municipal Home Rule Law Section, 23 (2) (e) and
WHEREAS, such a local law would become operative only if adopted by- -the
Town board and if approved at a Special or General Election by the affirma-
tive vote of a majority of the qualified electors of the Town of Queensbury
voting upon the proposition and
WHEREAS, a •proposed local law has been prepared and has been presented for
adoption by the Town Board in accordance wit# law, and
WHEREAS, a public hearing has been held concerning the desirability of the
adoption of said local law, and
