Box 2168 One Washington Street Glens Falls,NY 12801 Re: Sign Lighting The Outlets at Lake George West 1415 State Route 9 Tax Map Parcels: 288.-1-53 Dear Mr. Lapper: I am writing you with regards to my review of the above-referenced project and to document the recent conversations between your office and Laura Moore of my office. Upon my review I find that your project will require a Sign Variance from our Zoning Board of Appeals. Specifically, your proposed project offers the construction of"up-lighting" which is a sign lighting method that is not allowed by the current Town of Queensbury Sign Ordinance. I note that you have already prepared the necessary application materials. As such this letter will serve as the necessary denial letter for your application processing. Should you have any questions or comments regarding your application, please do not hesitate to contact this office. Now that the Outlet West's construction is complete and the remodel of Outlets East is near completion, the Applicant is in the process of negotiating with future tenants. During these negotiations it has come to the Applicant's attention that the existing monument signs need additional lighting. Obviously, visibility and signage is important to all the Applicant's current and prospective tenants. Specifically, the monument signs require light to be projected from the ground, so that all of the tenants names are visible in the evening. The existing regulations in the Sign Code, specifically Section 140-5(B), prohibit any upward casting lighting. However, the Applicant believes this upward casting light is necessary for the names towards the bottom of the sign to obtain optimal visibility. As a result, the Applicant is seeking relief from Section 140-5(B). The Applicant does not believe this will have any negative impact on the area. The Project Engineer has put , Chairman Steven Jackoski Page Two Zoning Board of Appeals October 15,2014 together a footcandle plan that demonstrates that this light will not create any light spillage onto any adjacent lands. As a result, this should not be deemed a substantial request. Please place this on your November Zoning Board of Appeals agenda. I have enclosed pictures of the sign, the Sign Variance Application as well as the fee. If you have any questions, please contact me or Attorney Stefanie DiLallo Bitter. One Washington Street,PO Box 2168 Glens Falls New York 12801 THE OUTLETS AT LAKE GEORGE, LAKE GEORGE NORTHWAY,LLC MONUMENT SIGN UP-LIGHTING, Up turned floodlights are proposed to supplement the projecting sign spotlights on the monument signs for these two outlet centers. These will be LED Micro-Floods by Kim Lighting. The floods will be ground mounted and will be turned up at an approximate 60 degree angle to illuminate the bottom portion of the sign panel. Attached are the catalog cut sheet and the candela distribution diagrams for this floodlight. The candela distribution diagrams show a very focused light distribution with very little light spillage beyond 45 degrees of the focal point. This distribution coupled with the upward aiming angle from a ground mounted light will result in little or no light spillage past the sign face.
