3.14 3.14 NON-SIGNIFICANCE\Consent to Plaminig Board Lead Agent—City of Glens Falls—Water Supply Modification—2-23-15 RESOLUTION REQUESTING QUEENSBURY PLANNING BOARD TO SEEK LEAD AGENCY STATUS REGARDING PROPOSED ZONING AMENDMENT AND CITY OF GLENS FALLS'S SITE PLAN APPLICATION FOR PROPOSED MODIFICATION OF PUBLIC WATER SUPPLY AND CONSENTING TO PLANNING BOARD SERVING AS LEAD AGENCY RESOLUTION NO. ,2015 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Queensbury Town Board is considering amending the Town Zoning Code to define "Water Extraction" and provide for and regulate such land use within the Town of Queensbury, and WHEREAS, the Town of Queensbury Planning Board is in receipt of a Full Environmental Assessment Form relating to a Site Plan Review Application submitted to the Town Planning Board by "JUST Beverages, LLC," on behalf of the City of Glens Falls concerning its proposed modification of the public water supply for the City of Glens Falls Watershed Property located off of Butler Pond Road (the"Project'), and WHEREAS, the Project will require the following approvals/permits: • Town Board—Addition of Water Extraction as an allowed use within the LC 10 zone; • Town Planning Board— Site Plan Approval; • NYS DOH—Permit for Water Source; • NYS DEC—Water Supply Permit Modification and Water Withdrawal Permit; and WHEREAS, prior to the Town Board taking any further action or making a decision about water extraction as an allowed use in the Town's LC 10 Zone, it will be necessary for the proposed zoning change and Site Plan review to be reviewed as one"Action" in a Coordinated Review under the New York State Environmental Quality Review Act (SEQRA), and WHEREAS, since the Project requires Site Plan Review approval by the Town's Planning Board, the Planning Board will be undertaking a detailed review of the Action, and WHEREAS, the Planning Board has the necessary knowledge and experience to review and evaluate the potential environmental effects of the Action, and WHEREAS, the Town Board believes that the Town Planning Board is the most involved agency and should be Lead Agency for the purposes of SEQRA review relating to the overall Action, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby requests that the Queensbury Planning Board seek Lead Agency status for purposes of conducting the Coordinated Review of the overall Action, and BE IT FURTHER RESOLVED, that in the event the Queensbury Planning Board seeks to be Lead Agency for SEQRA Coordinated Review of the Action, the Queensbury Town Board hereby consents to the Planning Board serving in that capacity, and BE IT FURTHER RESOLVED, that the Town Board hereby directs the Applicant to provide any and all information about the proposals, whether or not the information was previously supplied to the Town Board, to make the necessary copies of all such information and provide it to the Planning Board for its use in evaluating the potential environmental effects of the Action, and BE IT FURTHER RESOLVED, that the Queensbury Town Board hereby authorizes and directs the Town Supervisor to execute any documents and take any other necessary actions to effectuate the terms of this Resolution and further authorizes and directs the Town's Department of Community Development to notify, if and when appropriate, any other Involved Agencies of the Town Board's consent to the Planning Board serving as Lead Agency for SEQRA Coordinated Review of the Action. The City of Glens Falls is a 3.9 square mile municipality that has operated a public water system within the Town of Queensbury to support the municipal fire protection, its resident's potable water needs, and the needs of its industrial and commercial business users. The public water system has been in use since the late 1800's and much of the infrastructure is in need of replacement and upgrades. The City of Glens Falls has experienced a diminishing residential population, industrial and commercial base of customers in its public water system with an inversely proportional increase in rates for the remaining users within the system. Alternatives to tax levy revenue streams are very limited. The City of Glens Falls has determined it is reasonably necessary and appropriate to install a new drilled well as a source of public water for sale to a user within the existing water district. The City of Glens Falls through its agent; JUST Beverages LLC, has prepared a study of its watershed properties for the purpose of determining the most desirable location for a potable water well. JUST Beverages retained Hanson Van Vleet, LLC to perform a study to determine the most desirable locations for test wells, oversee the installation of test wells and determine which location was most viable for a public water well source. The conclusion of this study determined that a well located within the Butler Pond Watershed near the Butler Storage Reservoir was the optimum location. An 8 inch diameter Production Well was drilled in the area of the Butler Pond Watershed Test Well and is currently in the permitting process with the NYS DOH. The current plan for the public water well source is to allow an agent; JUST Beverages, LLC, to install, operate & maintain the City-owned well and transport water from the well site to the company's water bottling facility in the City. All work within the watershed properties will be approved and monitored by the City of Glens Falls Water Superintendent. The water from the well will be pretreated at the well site with ozone and sediment filters, transported via water delivery vehicle from the well site to the agent's facility within the City where it will be treated per NYS DOH requirements and bottled for wholesale. The proposed new well water source will result in no significant individual or cumulative adverse environmental impacts on the quantity or quality of the water source or the water dependent natural resources. The hydrogeological report prepared by Hanson Van Vleet clearly documents that the proposed groundwater well does not influence either the Butler Storage Reservoir or neighboring wells. If the new well water source is approved it will actually reduce the quantity of water used in the overall public water system as the new revenue stream will allow the City to reinvest in infrastructure maintenance and improvements thus reducing leaks in the distribution system. The proposed modification will occur on tax map parcel 294.-1-1 which is zoned LC-10. The disturbances have been limited to existing logging roads that have been improved with stormwater and erosion and sediment controls. There are no new hard surface areas proposed for this application and the Loading Station is proposed to be of a temporary nature. The Loading Station is a converted shipping container that can be removed and relocated if needed. It is our understanding that the Town of Queensbury is currently reviewing a potential change in the uses within the LC-10 zone, adding water extraction as an allowed use. The traffic from this proposed use will be minimized during the initial years of operation.The initial water delivery vehicles will be on the average of 2 to 3 round trips per day for the first couple of years.The vehicles proposed to trauspot t the water will be hybrid vehicles as soon as a vehicle can be configured. G. Off-street parking and loading facilities will be appropriately located and arranged and sufficient to meet traffic anticipated to be generated by the new use. The establishment of vehicle links between parking areas of adjacent properties are provided where feasible. This furthers the Town's goal of reducing curb cuts and reducing congestion.A twenty-foot wide connection is required. If adjacent properties are either undeveloped or previously developed without having made provision for future linkage. then a future connection must be identified and provided for in the site plan under review for such future linkage when the time arises. The Planning Board may require proof that the applicant has made contact with adjacent property owners for purposes of coordinating linkages with adjacent properties. The loading facility has been located within the limits of an existing disturbed area where logs were stored. H. '. * ' ' Illa ''''',, 4,1.,. , , .,,,,, „ . 4, !- (_i....., ,; ) 1 '• ;.r' ANSON GEOLOGIC& ENVIRONMENTAL CONSULTANTS VAN VLEET, LLC EXECUTIVE SUMMARY HYDROGEOLOGIC EVALUATION Bottled Water Source Glens Falls Watershed Properties Town of Queensbury Warren County,New York INTRODUCTION HVV performed an evaluation in to determine the feasibility of developing a spring and/or bottled water groundwater source on "water shed" properties (Study Area) owned by the City of Glens Fall. The evaluation was performed in conjunction with the City of Glens Falls and Just Goods, Inc. The purpose of the evaluation was to determine the potential for the developing a spring and/or bottled water groundwater supply source on the City of Glens Falls "water shed" properties capable of meeting the appropriate quantity and quality for a viable bottled water source. The evaluation also was performed to confirm that the area has sufficient recharge so as not to impact recharge to Butler Reservoir System and other groundwater users in the area. Once a potential source was located, a production well was installed, tested and evaluated. The ultimate objective was to develop a groundwater source, which meets the quality standards for a bottled water source established by JUST Goods, Inc., does not impact the City of Glens Falls reservoirs and complies with the New York State Sanitary Code Part 5, Subpart 5-6 Bottled and Bulk Water Standards. The following summarizes the results of the evaluation, testing and development of the bottled water groundwater source. 1. Literature Search/Evaluation and Interviews: A literature search was conducted to identify the geologic and hydrogeologic conditions within the watershed properties owned by the City of Glens Falls, with respect to the potential for developing a bottled water groundwater source. Mr. Steven Gurzler, P.E., City of Glens Falls Engineer and Mr. George Stec, long time resident of Queensbury and former State Forest Ranger familiar with the Glens Falls watershed properties were interviewed with respect to their knowledge of the watershed properties. The result of the literature search and interviews indicated the best potential for encountering groundwater aquifer of the quality desired for a bottled water source was within the granitic rocks on the Luzerne Mountains west of West Mountain Road. 2. Fracture Trace/Lineament Analysis: HVV performed a fracture trace/lineament analysis to determine optimal areas to explore for a source of groundwater for the proposed project in bedrock aquifers on watershed properties. Priority was placed on areas exhibiting springs and/or seeps. A fracture trace/lineament analysis identifies linear features on topographic maps and orthoimagery (aerial photographs), that may represent water bearing fractures, paleo-faults, shear zones and/or bedding planes. Field reconnaissance was performed on March 26, 2014, with multiple follow-up visits to identify hydrogeologic features in the field, estimate set back requirements, evaluate potential surface water sampling areas, determine possible access routes and identify the specific proposed drilling target areas. The reconnaissance included the entire area within and surrounding the watershed properties,but focused on the area near Butler Pond and Butler Storage Reservoir. Four preliminary target areas were identified based on the information reviewed, fracture trace analysis, access and the field reconnaissance. It should be noted that sites accessible with minimal tree cutting were given priority. 3. Test Well Drilling: Four six-inch test wells were installed on City property in the area of Butler Pond and Butler Storage Reservoir. The test wells were drilled to depths ranging from 235 to 360-feet. Test well TW-2,near Butler Storage Reservoir appeared to have sufficient groundwater to be considered a viable source. The three other test wells did not identify sufficient water to be a viable bottled water source. 4. Preliminary Testing and Water Quality Analysis: Preliminary testing indicated the test well was capable of a yield of approximately 43 gpm. Water quality samples collected at the conclusion of the pumping test were analyzed according to the New York State Sanitary Code, Part 5, Drinking Water Standards, including radiological, with additional samples collected for Bromide, Hexavalent Chromium and UV Transmittance. The water quality at test well TW-2 was in compliance with the New York State Sanitary Code, Part 5, Sub-Part 5-1 standards for public water supplies, including radiological analysis and within the range acceptable to JUST Goods for a bottled water source. 5. Production Well Installation: Based on the results of the pumping test performed on Test Well TW-2, it was determined that sufficient water of acceptable quality was present in the fractured bedrock aquifer. A production well was designed based on the site specific conditions and installed in compliance with New York State Department of Health(NYSDOH)and NYSDEC standards. 6. Production Well Testing and Evaluation: A 72-hour pumping test was performed from December 1 to 4, 2014 in compliance with NYSDEC and NYSDOH guidelines. The evaluation of the test data indicated the production well (PW-1) was capable of a long term yield of 47 gallons per minute. No influence from pumping was identified at test well TW-4, located approximately 875-feet from PW-1. No influence from pumping was identified at Butler Storage Reservoir, located 233.5-feet from production well PW- 1. Field water quality(Temperature,pH and Conductivity) was monitored at production well PW-1 and from Butler Storage Reservoir for the duration of the pumping test to evaluate for potential interconnection between the bedrock aquifer and the surface water within the reservoir. No correlation between the surface water and the groundwater data was identified. 7. Specific Capacity: The specific capacity of production well PW-1, based on the data collected at the conclusion of the 72 hour pump test is 0.58 gallons per minute per foot of drawdown (gpm/ft). At a maximum available drawdown of 105-feet, this would equate JUST Goods,Inc. Executive Summary Bottled Water Source Exploration January 30,2015 Page 3 of 4 to a theoretical maximum yield of 60.9 gpm. 8. GWUDI (Ground Water Under Direct Influence) Evaluation: Monitoring of temperature, pH and conductivity of both the reservoir water and water from production well PW-1 did not identify any correlation to indicate a connection between the surface water reservoir and the bedrock aquifer. A microscopic particulate analysis (MPA) sample collected prior to the completion of the pumping test did not identify any biological materials indicative of surface water. 9. Water Quality: Water quality samples were collected at the conclusion of the pumping test for analysis in accordance with the New York State Department of Health Bulk and Bottled water quality standards. Based on the analytical results, the water is in compliance with New York State Department of Health Bulk and Bottled water quality standards. 10. Aquifer/Watershed Recharge Evaluation: An evaluation of the recharge capacity of the watershed contributing to Butler Pond and Butler Storage Reservoir was performed to confirm that the proposed withdrawal of groundwater would not impact the City of Glens Falls water supply. a) The static water level at production well PW-1 prior to the test varied was well above the level of Butler Storage Reservoir. The ground surface at the test well is approximately 806.5 feet above mean sea level. The high water level at Butler Storage Reservoir is approximately 758.45 feet above mean sea level. The difference in elevation indicates that the source of groundwater at production well PW-1 is not Butler Storage Reservoir. b) The proposed bottled water source, at maximum capacity, will only draw 4 to 11% of the excess capacity of the recharge basin, not utilized by the City of Glens Falls. The proposed bottled water source will not impact the City of Glens Falls water supply. 11. Potential Impacts to Groundwater Users: No drawdown influence was observed at test well TW-4, located approximately 850-feet from production well PW-1, during the 72-hour pumping test. The nearest residential well is approximately 1,500-feet from the production well. In addition, the elevation of production well PW-1 is significantly above that of any of the property owners. Production well PW-1 will be drawing water from an elevation that is actually above the ground elevation of the other groundwater users on Butler Pond Road and the nearby roads at the base of the mountain. There is no correlation between the production well PW-1 and any other private well and there should be no impacts to any other groundwater wells in the area. CONCLUSIONS • Production well PW-1 is located within an artesian fractured bedrock aquifer. Groundwater was encountered at approximately 122-feet below the surface. • The well appears to intersect the source of a spring/seep located approximately 105-feet east of the well. • The Butler Reservoir System appears more than capable of supporting the desired JUST Goods,Inc. Executive Summary Bottled Water Source Exploration January 30,2015 Page 4 of 4 demand of 25,000,000 gallons per year, without any adverse impacts to the capacity of the reservoir system. • The aquifer appears capable of a long term continuous safe yield of at least 47 gpm, without creating any adverse impacts to the Butler reservoir system and other groundwater users. • The water meets the water quality desired by Just Goods for a bottled water source and is in compliance with the New York State Department of Health Bulk and Bottled water quality standards. • No evidence of surface organisms was identified and no correlation was found within the field water quality between Butler Storage Reservoir and the well. The well is not considered GWUDI(ground water under direct influence). • The well does not impact any surface water reservoirs within the Glens Falls water shed. • There is no evidence to indicate the use of the well will have an impact on any other ground water wells within the area.
