Dear Chairman Hunsinger and Planning Board Members:
Attached is a site plan application for the proposed modification of the public water supply for
the City of Glens Falls Watershed Property located off of Butler Pond Road.
The City of Glens Falls is a 3.9 square mile municipality that has operated a public water system
within the Town of Queensbury to support the municipal fire protection, its resident's potable
water needs, and the needs of its industrial and commercial business users. The public water
system has been in use since the late 1800's and much of the infrastructure is in need of
replacement and upgrades. The City of Glens Falls has experienced a diminishing residential
population, industrial and commercial base of customers in its public water system with an
inversely proportional increase in rates for the remaining users within the system. Alternatives to
tax levy revenue streams are very limited. The City of Glens Falls has determined it is reasonably
necessary and appropriate to install a new drilled well as a source of public water for sale to a
user within the existing water district.
The City of Glens Falls through its agent; JUST Beverages LLC, has prepared a study of its
watershed properties for the purpose of determining the most desirable location for a potable
water well. JUST Beverages retained Hanson Van Vleet, LLC to perform a study to determine
the most desirable locations for test wells, oversee the installation of test wells and determine
which location was most viable for a public water well source. The conclusion of this study
determined that a well located within the Butler Pond Watershed near the Butler Storage
Reservoir was the optimum location. An 8 inch diameter Production Well was drilled in the area
of the Butler Pond Watershed Test Well and is currently in the permitting process with the NYS
DOH.
The current plan for the public water well source is to allow an agent; JUST Beverages, LLC, to
install, operate & maintain the City -owned well and transport water from the well site to the
company's water bottling facility in the City. All work within the watershed properties will be
approved and monitored by the City of Glens Falls Water Superintendent. The water from the
well will be pretreated at the well site with ozone and sediment filters, transported via water
delivery vehicle from the well site to the agent's facility within the City where it will be treated
per NYS DOH requirements and bottled for wholesale.
The proposed new well water source will result in no significant individual or cumulative
adverse environmental impacts on the quantity or quality of the water source or the water
dependent natural resources. The hydrogeological report prepared by Hanson Van Vleet clearly
documents that the proposed groundwater well does not influence either the Butler Storage
Reservoir or neighboring wells.
If the new well water source is approved it will actually reduce the quantity of water used in the
overall public water system as the new revenue stream will allow the City to reinvest in
infrastructure maintenance and improvements thus reducing leaks in the distribution system.
The proposed modification will occur on tax map parcel 294.4-1 which is zoned LC -10. The
disturbances have been limited to existing logging roads that have been improved with
stormwater and erosion and sediment controls. There are no new hard surface areas proposed for
this application and the Loading Station is proposed to be of a temporary nature. The Loading
Station is a converted shipping container that can be removed and relocated if needed.
It is our understanding that the Town of Queensbury is currently reviewing a potential change in
the uses within the LC -10 zone, adding water extraction as an allowed use.
This project will require approvals / permits as follows:

S 179-9-080 Requirements for Site Plan ApProval. The Planning Board shall not approve a Site Plan
unless it first determines that such site plan meets the following Standards. Please prepare responses to each of
the following topics.

proposed project furthers or is consistent with the policies of the Town's Comprehensive Plan.
The proposed project would be consistent with the Towns Comprehensive Plan as the proposed development of a
new public water source for use by the City of Glens Falls is an extension of their existing use of the watershed
lands for protecting, diverting and obtaining water from the watershed for supply to customer within City limits.
B The proposed project complies with all other requirements of this Chapter, including the site plan review standards as set forth in
Paragraph F of this section, the dimensional, bulk, and density regulations of the zoning district in which it is proposed to be located
(Article 3 and Table 1), the applicable requirements of all other Articles that apply.

character and size of the proposed use and the description and purpose of the district in which such use is proposed, the nature and
intensity of the activities to be involved in or conducted in connection with the proposed use and the nature and rate of any increase in
the burden on supporting public services and facilities which will follow the approval of the proposed use.
The proposed use is in harmony with the current land use. The temporary loading station will be finished with a
paint scheme that will allow it to blend in with the existing woods. The disturbance for the access drive has been
kept to the limits of the existing logging road and log lay down area which has existed on the land for some time.
The establishment, maintenance and operation of the proposed use will not create public hazards from traffic, traffic congestion or the
parking of vehicles and/or equipment or be otherwise detrimental to the health, safety or general welfare of persons residing or
working in the neighborhood or to the general welfare of the town. Traffic access and circulation, road intersections, road and
driveway widths, and traffic controls will be adequate.
The traffic from this proposed use will be minimized during the initial years of operation. The initial water delivery vehicles will be on the
average of 2 to 3 round trips per day for the first couple of years. The vehicles proposed to transport the water will be hybrid vehicles as soon as
a vehicle can be configured.
off-street parking and loading facilities will be appropriately located and arranged and sufficient to meet traffic anticipated to be
generated by the new use. The establishment of vehicle links between parking areas of adjacent properties are provided where
feasible. This furthers the Town's goal of reducing curb cuts and reducing congestion. A twenty -foot wide connection is required If
adjacent properties are either undeveloped or previously developed without having made provision for future linkage, then a future
connection must be identified and provided for in the site plan under review for such future linkage when the time arises. The
Planning Board may require proof that the applicant has made contact with adjacent property owners for purposes of coordinating
linkages with adjacent properties.
The loading facility has been located within the limits of an existing disturbed area where logs were stored.
The project shall not have an undue adverse impact upon the natural, scenic, aesthetic, ecological, wildlife, historic, recreational or
open space resources of the town or the Adirondack Park or upon the adequate provision of supporting facilities and services made
necessary by the project, taking into account the commercial, industrial, residential, recreational or other benefits that might be derived
from the project In making the determination hereunder, the Planning Board shall consider those factors pertinent to the project
contained in the development considerations set forth herein under § 179-9-080 of this chapter, and in so doing, the Planning Board
shall make a net overall evaluation of the project in relation to the development objectives and general guidelines set forth in § 179-9-
080 of this Article.

I. The provision for and arrangement of pedestrian traffic access and circulation, walkway structures, control of intersections with
vehicular traffic and overall pedestrian convenience shall be safe and adequate for pedestrian movement. Pedestrian connections
between adjacent sites shall be provided to encourage pedestrian use.
Delivery vehicle circulation has been designed to be limited to existing logging road area and adequate space has
been provided to enter and exit the site onto Butler Pond Road at the existing logging road entrance, limited access
provided for maintenance of the well and adequate improvements for delivery vehicles to access the loading
station.
J. Stormwater drainage facilities will prevent an increase of post development drainage flows as compared to pre -development drainage
flows Drainage of the site shall recharge ground water to the extent practical. Surface waters flowing off-site shall not degrade any
streams or adversely affect drainage on adjacent properties or public roads Facilities shall be in conformance with the drainage
standards of Chapter 147 of the Town Code and the Town of Queensbury Subdivision Regulations where applicable.
The proposed improvements to the existing logging road will be mitigated by the use of pervious pavement in the
unloading station area and construction of a swale with check dams and a sediment basin along the improved
logging road to be used as maintenance access to the well.
K. The water supply and sewage disposal facilities will be adequate and will meet all applicable and current requirements set forth by
Department of Health regulations and Chapter 136 of the Town Code.

§ 179-9-050 Application for Site Plan Review
Application for site plan approval shall be made to the Planning Board using forms supplied by the Board. Application materials
and the site plan shall include sufficient information for the Board to make its findings under § 179-9-070 and 179-9-080 below.
In determining the content of the site plan and supporting documentation, the Planning Board may waive certain requirements if
the Planning Board deems such requirements or information unnecessary for the type of project proposed. Any such waiver
shall be made in writing, and shall contain statements of the reasons why the waived information requirements are not
necessary for an informed review under the circumstances. The Planning Board may grant such waivers on its own initiative or
