SEEK LEAD AGENCY STATUS REGARDING PROPOSED ZONING
AMENDMENT AND CITY OF GLENS FALLS'S SITE PLAN APPLICATION
FOR PROPOSED MODIFICATION OF PUBLIC WATER SUPPLY AND
CONSENTING TO PLANNING BOARD

WHEREAS, the Queensbury Town Board is considering amending the Town Zoning Code to
define "Water Extraction" and provide for and regulate such land use within the Town of Queensbury,
and
WHEREAS, the Town of Queensbury Planning Board is in receipt of a Full Environmental
Assessment Form relating to a Site Plan Review Application submitted to the Town Planning Board by
"JUST Beverages, LLC," on behalf of the City of Glens Falls concerning its proposed modification of
the public water supply for the City of Glens Falls Watershed Property located off of Butler Pond Road
(the"Project'), and
WHEREAS, the Project will require the following approvals/permits:
• Town Board—Addition of Water Extraction as an allowed use within the LC 10 zone;
• Town Planning Board— Site Plan Approval;
• NYS DOH—Permit for Water Source;
• NYS DEC—Water Supply Permit Modification and Water Withdrawal Permit;
and
WHEREAS, prior to the Town Board taking any further action or making a decision about
water extraction as an allowed use in the Town's LC I O Zone, it will be necessary for the proposed
zoning change and Site Plan review to be reviewed as one"Action" in a Coordinated Review under the
New York State Environmental Quality Review Act (SEQRA), and
WHEREAS, since the Project requires Site Plan Review approval by the Town's Planning
Board, the Planning Board will be undertaking a detailed review of the Action, and
WHEREAS, the Planning Board has the necessary knowledge and experience to review and
evaluate the potential environmental effects of the Action, and
WHEREAS, the Town Board believes that the Town Planning Board is the most involved
agency and should be Lead Agency for the purposes of SEQRA review relating to the overall Action,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby requests that the Queensbury Planning
Board seek Lead Agency status for purposes of conducting the Coordinated Review of the overall
Action, and
BE IT FURTHER
RESOLVED, that in the event the Queensbury Planning Board seeks to be Lead Agency for
SEQRA Coordinated Review of the Action, the Queensbury Town Board hereby consents to the
Planning Board serving in that capacity, and
BE IT FURTHER
RESOLVED, that the Town Board hereby directs the Applicant to provide any and all
information about the proposals, whether or not the information was previously supplied to the Town
Board, to make the necessary copies of all such information and provide it to the Planning Board for its
use in evaluating the potential environmental effects of the Action, and
BE IT FURTHER
RESOLVED, that the Queensbury Town Board hereby authorizes and directs the Town
Supervisor to execute any documents and take any other necessary actions to effectuate the terms of
this Resolution and further authorizes and directs the Town's Department of Community Development
to notify, if and when appropriate, any other Involved Agencies of the Town Board's consent to the
Planning Board serving as Lead Agency for SEQRA Coordinated Review of the Action.
