WHEREAS, the Town of Queensbury is considering extending the Queensbury
Consolidated Water District to serve the proposed Leuci Subdivision (Subdivision) on Peggy Ann
Road in accordance with New York Town Law Article 12-A, and
WHEREAS, a Map, Plan and Report (Map, Plan and Report) has been prepared by
Thomas Nace, P.E., concerning the proposed Water District Extension No. 49 to connect the
Subdivision to the existing Queensbury Consolidated Water District water main along the south
side of Peggy Ann Road, as more specifically set forth and described in the Map, Plan and Report,
and
WHEREAS, the Map, Plan and Report has been filed in the Queensbury Town Clerk's
Office and is available for public inspection, and
WHEREAS, the Map, Plan and Report delineates the boundaries of the proposed Water
District Extension No. 49, a general plan of the proposed system, a report of the proposed
method of operation, the source of water supply and mode of constructing the proposed water
district extension improvements, and
WHEREAS, the Queensbury Planning Board, as the Lead Agency, performed the State
Environmental Quality Review Act (SEQRA) review for the Subdivision, which included the
proposed Water District Extension No. 49, determined that the project would not have a significant
effect on the environment and issued a Negative Declaration,
NOW, THEREFORE, IT IS HEREBY
ORDERED:
1. The boundaries of the proposed Water District Extension No. 49 are as set forth in
the Map, Plan and Report and as follows:
All that certain tract or parcel of land situate in the Town of Queensbury, County of
Warren, State of New York being more fully described as follows:
Beginning at a point in the southerly boundary of Peggy Ann Road, said point being the
northwesterly comer of the Queensbury Forest Subdivision, running thence from the
point of Beginning southerly along the westerly boundary of Queensbury Forest
Subdivision South 06°39'25" West a distance of 926.13' to a point in the northerly
boundary of the lands now or formerly of Carol Mosher, as recorded in the office of the
Warren County Clerk in book 714 at page 258, running thence westerly along the
northerly boundary of said lands now or formerly of Carol Mosher, as recorded in the
office of the Warren County Clerk in book 714 at page 258 North 84°44'01" West a
distance of 624.04' to a point in the easterly boundary of Phase Two of the Oakwoods
Subdivision, running thence northerly along the easterly boundary of Phase Two of the
Oakwoods Subdivision North 05°37'59" East a distance of 61.60' to a point at the
southeasterly comer of Section Two Pheasant Walk Subdivision, running thence
northerly along the easterly boundary of said Section Two Pheasant Walk Subdivision
North 06'36' 59" East a distance of 1074.17' to a point in the southerly boundary of
Peggy Ann Road, running thence easterly along the southerly boundary of Peggy Ann
Road South 66°04'35" East a distance of 655.25' to the point and place of Beginning.
Containing 14.80 acres of land, being the same, plus or minus.
Subject to any other rights, covenants, easements or restrictions of record.
2. The proposed improvements consist of construction of infrastructure to support

the Subdivision, which includes a 6" ductile iron water supply to be installed from the existing
main on Peggy Ann Road along the new subdivision road and dead-ending at a fire hydrant at the
south side of the new Cul-de-Sac. Individual taps to serve each new building lot will be made to
this new 6" water line. Individual taps to serve each new building lot will be made to this new 6"
water line. All new installations and taps will be coordinated with the Town of Queensbury Water
Department. Maintenance of the existing and new facilities will be provided by the Town of
Queensbury Water Department.
3. All new capital costs associated with the installation of the new water supply
facilities, including materials, excavation and labor, will be paid by the Subdivision developer.
There is no cost to the Town or the District for this District Extension No. 49.
4. The capital improvements necessary for this service area will be provided and paid
for by the Subdivision developer and so there will be no debt service costs related to this District
Extension No. 49 to the District. The estimated annual cost of the District Extension No. 49 to
the typical property in the District Extension No. 49, which typical property is a one family home,
for operation and maintenance and other charges (assuming an average water usage) ranges from
$368.55 for a property assessed at $250,000 to $448.45 for a property assessed at $350,000.
There will be no hook-up fees and the cost to construct a water service connection from the new
6" water main to each new structure and the purchase and installation of a water meter would be
included in the total cost of each home.
5. A detailed explanation of how the estimated costs of the District Extension No. 49
were computed is included in the Map, Plan and Report which has been filed with the Queensbury
Town Clerk and is available for public inspection.
6. The developer of the Subdivision will pay all costs of the improvements so there
will be no financing required by the Town on behalf of the District.
7. The proposed improvements shall be constructed and installed as specifically

delineated in the Map, Plan and Report and in full accordance with the Town of Queensbury's
specifications, ordinances or local laws, and any State laws or regulations, and in accordance with
approved plans and specifications and under competent engineering supervision.
8. The Town Board shall meet and hold a public hearing at the Queensbury Activities
Center, 742 Bay Road, Queensbury at 7:00 p.m., on Monday, April 20th, 2015 to consider the
Map, Plan and Report and to hear all persons interested in the proposal and to take such other
and further action as may be required or authorized by law.
9. The Town Board hereby authorizes and directs the Queensbury Town Clerk to
duly publish and post this Order not less than ten (10) days nor more than twenty (20) days before
the public hearing date, as required by Town Law §209-d, and complete or arrange for the
securing of two (2) Affidavits of Publication of Notice and two (2) Affidavits of Posting of Notice
of the Public Hearing required hereby and to file a certified copy of this Order with the State
Comptroller on or about the date of publication.

Project Description
The Leuci Subdivision encompasses 14.80 acres located on the south side of
Peggy Ann Road, just west of the intersection of Peggy Ann Road with Ferris
Drive in the Town of Queensbury. The project as approved by the Town of
Queensbury's Planning Board on September 23, 2014 will create 16 — 0.85 acre
single family residential lots which will be served by a 1,085'± road including a cul-
de-sac, to be known as Elk Ridge Drive. The entire parcel is currently vacant
wooded land that was formerly owned by the City of Glens Falls as part of its
watershed properties. The lots are to be served by municipal water from the Town
of Queensbury and will utilize on-site wastewater disposal systems.
Existing Water District
All parcels surrounding the proposed district extension are part of the Town of
Queensbury Consolidated Water District.
Proposed District Boundaries
It is proposed to extend the district to include the entire subdivision into the district.
A map showing a portion of the existing water district and the proposed district
extension in relation to this subdivision is included in the appendix of this report.
Proposed Facilities & Flows
The municipal water which will serve the subdivision is proposed to be provided by
the Queensbury Consolidated Water District which presently has a water main
along the south side of Peggy Ann Road. A 6 inch ductile iron water supply will be
installed from the existing main on Peggy Ann road along the new subdivision road
and will dead-end at a fire hydrant at the south side of the new Cul-de-Sac.
Individual taps to serve each new building lot will be made to this new 6 inch water
line. All new installations and taps will be coordinated with the Town of
Queensbury Water Department. Maintenance of the existing and new facilities will
be provided by the Town of Queensbury Water Department.
Water flows for each new building lot are designed at 222 gallons per day for the
on-site wastewater disposal systems, therefore the total daily water demand for
the new 16 residential building lots is estimated at 3,520 gallons per day. The
superintendent of the Town of Queensbury Water Department has stated that the
Queensbury water treatment plant and distribution system has sufficient capacity
to meet these demands. A letter stating this is included in the appendix of this
report.

Cost Estimates
Capital Costs
All new capital costs associated with the installation of the new water supply
facilities including materials, excavation and labor will be paid by the subdivision
developer. The installation cost of the water supply facilities will be approximately
$60,000. The Town of Queensbury will not finance any of the proposed new water
facility installation.
Operation and Maintenance Costs
The newly created properties will pay for the maintenance of the new facilities as
part of their Queensbury Consolidated Water District ad valorem tax and their
water use fees.
Individual homeowners will be billed for their respective water use in accordance
with the standard rates of the Queensbury Consolidated Water District. These
costs are currently $ 20 for the first 8,000 gallons per quarter and $1.85 for each
additional 1,000 gallons per quarter. Assuming the design flow of 222 gallons per
household per day, the quarterly use per household is estimated at 20,000
gallons; therefore the estimated quarterly cost per household is $42.20.
Hook-Up Fees
All individual water service connections to the new 6" water main will be made by
the developer during the installation of the 6" water main and under the
supervision of the Town of Queensbury Water Department. This phase of
individual connections will include the corporation stop, 3/4" copper piping from the
corporation stop to the property line and a curb stop and curb box at the property
line. The 3/4" copper piping from the curb stop to the building will be installed by
others during the house construction phase. The estimated cost for the service
connection/meter is between $950 and $1400 depending on length of service,
while the estimated cost for the 3/4" line from the curb box to the house is $ 800.
All hook-up costs are to be paid by the developer and all houses will be built move
in ready.
There is an equity buy-in to the Queensbury Consolidated Water District of$ 100.

Annual Costs
The typical taxable assessed value of the properties in the subdivision will likely
range from $250,000 to $350,000 per finished residence.
The costs assessed to the users in the proposed district extension will be the
same as to all of the other users in the Queensbury Consolidated Water District,
consisting of:
• Ad Valorem Tax Rate of Existing Queensbury Consolidated Water District
Projected 2015 rate = $.799 per$1000 assessed value
• Charge for metered water use
From above, typical estimated cost is $42.20 per quarter
= $168.80 per year

The Department of Environmental Conservation (DEC) has determined that your
proposal to develop a parcel located on Peggy Ann Road in the town of Queensbury is
not likely to result in the take of threatened or endangered species. This determination
is based on the information submitted by Nace Engineering on June 28, 2014 and
reviewed by staff from the Division of Fish, Wildlife, and Marine Resources. Though
Karner blue butterflies (Lycaeides melissa samuelis) are known to occur near your
project location, based on a site visit performed on July 3, 2014 the DEC does not
anticipate your proposed action to result in a take. Therefore, no permit is required at
this time pursuant to the implementing regulations (6NYCRR Part 182) of the New York
