WHEREAS, the Queensbury Town Board serves as the Town's Local Board of Health and is
authorized by Town Code Chapter 136 to issue variances from the Town's On-Site Sewage Disposal
Ordinance, and
WHEREAS, Charles Crew has applied to the Local Board of Health for a variance from
Chapter 136 to install a fill absorption system 160' from the Lake George shoreline in lieu of the
required 200' horizontal separation on property located at 111 Assembly Point Road in the Town of
Queensbury,
NOW, THEREFORE, BE IT
RESOLVED, that the Town of Queensbury Local Board of Health will hold a public hearing
on Monday, June 15ffi, 2015 at 7:00 p.m. at the Queensbury Activities Center, 742 Bay Road,
Queensbury, to consider Charles Crew's sewage disposal variance application concerning property
located at 111 Assembly Point Road in the Town of Queensbury(Tax Map No.: 239.7-1-1.12) and at
that time all interested persons will be heard, and
BE IT FURTHER,
RESOLVED, that the Local Board of Health authorizes and directs the Queensbury Town
Clerk to publish the Notice of Public Hearing presented at this meeting and send a copy of the Notice
to neighbors located within 500 feet of the property as required by law.

Submitted for your distribution and review are nine sets of a septic variance application for an
Assembly Point Road lakeshore property. Attached with the Town's application form and
variance plan set is a Project Description narrative which provides an explanation for this
somewhat different request. I will be available at the convenience of the Board for a site visit to
explain the site conditions and the need for the variance relief requested. If it would be advisable
I could also attend your workshop meeting(June 10th)prior to the meeting at which the public
hearing (June 15th)would be scheduled.

Project Description:
The subject property is a 1.12 acre vacant parcel exists under separate deed
description and has been approved under the Town subdivision process as a
legal lot for development. This lot is contiguous to the lot containing the
residence of the Owner and in fact includes the wastewater system serving the
Owner's residence. Rights to that wastewater system for the Owner's
residence is included within the property deed.
It is the Owner's intent to design and gain Town approval for a wastewater
system to serve a future four bedroom house on the subject parcel. Should the
current Owner plan to sell the existing lot the knowledge that it already has
the ability for an approved wastewater system will be a benefit to the seller
and buyer alike.
The Town of Queensbury Codes - Chapter 136, Sewers and Sewage Disposal
under Section 136-9 Special Standards Paragraph B requires a 200'
horizontal separation to the shoreline of Lake George for a fill system. It has
been determined that this site will require a raised system. Relief from the
200' standard is therefore required. The absorption bed proposed will range
from 170' to 190' and the toe of slope will be at 160' at its closest location. It
should be noted that fill systems for replacement of existing systems can be
within 100' of the shoreline.
The proposed absorption field system will be an Eljen Geotextile Sand Filter
in a bed configuration. Eljen GSF systems are recognized by the NYS
Department of Health to provide an advanced level of treatment prior to
dispersal to the native soils.

BOARD OF HEALTH VARIANCE REQUEST
The proposed wastewater system is designed to serve a future four bedroom
house to be built on the currently vacant but zoning compliant parcel adjacent
to 111 Assembly Point Road. Upon discussions with the Town of Queensbury
Director of Buildings & Codes it has been determined that a Town Board of
Health variance will be required. As proposed the raised wastewater
absorption field will need a variance from to two following provisions of the
Town of Queensbury Codes - Chapter 136
• Chapter 136-9 B. - horizontal separation to the shoreline from a fill
system : 200'required- 160'proposed 40'of relief sought.
• Chapter 136 Appendix A : Table 1 Horizontal Separation Distances
fill system to Lake George : 200'required- 160'proposed
These sections refer to the same dimensional standard simply stated in two
different locations within the Code. Only one variance for horizontal relief is
being requested.

Zoning Compliance
The subject property is a pre-existing 1.12 acre vacant parcel located adjacent to
Owner Charles Crew's residence at 111 Assembly Point Rd. It is the desire of Mr.
Crew to gain an approval for a wastewater system to serve a future four (4)
bedroom house. He does not plan to build a house on the parcel at this time but
rather to make available for sale a building lot with an approvable wastewater
system. The house as shown is a'generic' four bedroom house that would be
compliant with Queensbury zoning requirements ... i.e. setbacks, building height,
permeability and FAR(floor area ratio) . The setbacks are indicated on the
proposed site plan with the proposed house in full compliance. The building
height standard is 28' which can be easily met for even a two story house on this
very level site. The 75% permeability standard would allow impervious area of up
to 12,197 sf. As proposed the area of the house footprint, the driveway and access
drive is 8,800+/- sf. Compliance with the permeability standard will not be an
issue.
The Floor Area Ratio (FAR) at 22% of the land area of this lot equals 10,733 sf of
allowable floor area. As proposed, the building footprint of 2400 x 2(stories) plus
the garage area(720) is approximately 5520 sf. Due to the ground water
conditions at this site no basement area greater than 5' in height would be
constructed. The expected floor areas of a four bedroom house at this site would
be typical of this depiction so compliance with floor area ratio for the
development on this site will not be an issue.
Based on site review and discussions with the Town's Director of Building &
Codes it has been determined that a Board of Health variance will be required for
the proposed wastewater system. Refer to the attached Board of Health Variance
Request description which cites the section of the Town Sanitary ordinance from
which relief is sought.
