Denial letter CLTOWN OF QUEENSBURY 742 Bay Road, Queensbury, NY 12804-5902 518-761-8201 May 15, 2015 Concord Pools, Inc. 15 Sparrowbush Road Latham,NY 12110 Re: Concord Pools 60 Big Boom Road Tax Map Parcel: 309.17-1-24 Dear Concord Pools: I am writing you to in response to my review of a plan submitted to this office relative to the above-referenced project and to document the recent conversations between your agent, Tom Nace and Laura Moore, of my office, regarding the same. I have reviewed the plans and find that the project will require Area Variances from our Zoning Board of Appeals as well as Site Plan Review from our Planning Board. Specifically, an Area Variance is required as your proposal calls for the construction of a pool in the front yard on the property at 60 big Boom Road and such structures are only allowed in a rear yard. Further, I note that your proposed plan calls for the removal of the access drive on your frontage along Big Boom Road in favor of a new access drive across the neighboring southerly parcel. The Town Zoning Ordinance requires that all parcels to be developed must have a minimum amount of road frontage and that the access to the parcel must be across your own frontage. An area variance, for access across an adjoining parcel, will be necessary with your current plan. Additionally, it appears as though the proposed deck on the front of the building does not meet the minimum front property line setback, as such area variance relief will be needed. Site Plan Review will be necessary for the proposed site improvements planned to accommodate your new Concord Pools facility. Based on my review of the plans submitted to date, the following items that need to be addressed are, but not limited to,the following: ® Stamped, signed survey map depicting the proposed setbacks to the deck and pool. m Addition of southerly property (Giovanone) as co-applicant on both Area Variance and Site Plan Review applications due to the site work (grading), trees to remain note and proposed access drive on their property. United Parcel Service is noted on your application as an APPLICANT however, no site work is planned for their parcel. Please clarify. "HOME OF NATURAL BEAUTY. . .A GOOD PLACE TO LIVE" SETTLED 1763 May 15, 2015 Concord Pools 60 Big Boom Road Tax Map Parcel: 309.17-1-24 Page 2 ® Site lighting - lighting cut sheets and a lighting grid will be necessary for all proposed lighting (existing and proposed) The FLI fixtures along the west property line and the WPI fixtures on the building do not appear to be compliant cut off lighting fixtures. ® Deeds depicting Concord Pools and Giovanone ownership or signature from current listed property owner(s). ® Stormwater Management Report and necessary SWPPP and required NYS DEC SPDES information. I understand that you and your agent have begun the preparation of the necessary application materials. Please note our established pre-submission meeting requirements and our submittal deadline when preparing your application materials.
